Kann Das Deutsche Verfassungsrechtsdenken Vorbild Fur Die Vereinigten Staaten Sein?, Donald P. Kommers Jan 1998

Kann Das Deutsche Verfassungsrechtsdenken Vorbild Fur Die Vereinigten Staaten Sein?, Donald P. Kommers

Journal Articles

No-Fault Laws And At-Fault People, Margaret F. Brinig, F. H. Buckley

Journal Articles

Absent transaction costs, the Coase Theorem suggests that divorce reform would work no change in the frequency of divorce but perhaps would alter the distribution of marital wealth. However, divorce does involve substantial process costs, which no-fault lowered. This paper explores the question of what happened to state divorce rates because of the legal changes wrought by the family law revolution that began in the 1970s, isolating the effect of the legal variable from other demographic and social factors that might also explain the variation in divorce rates across states and across time.

The Supreme Court's Impact On Marriage, 1967-90, Margaret F. Brinig Jan 1998

The Supreme Court's Impact On Marriage, 1967-90, Margaret F. Brinig

Journal Articles

In the twenty years following Loving, the Supreme Court decided a number of cases dealing with the family. Although the Court reasoned that it was protecting marriage and extending such protection to other forms of families, the perverse effect of these decisions was to weaken the most traditional family type of all, the nuclear family. Adults, and particularly pregnant women and unwed fathers, triumphed in this move towards autonomy and rights. The vanquished included those who depended upon the family for love and sustenance: minor children, elderly adults, and longtime homemakers.

This paper discusses these cases from a family law …

Natural Law And The Ethics Of Discourse, John M. Finnis Jan 1998

Natural Law And The Ethics Of Discourse, John M. Finnis

Journal Articles

This essay argues that Plato's critical analysis of the ethics of discourse is superior to Habermas', and more generally that Habermas has no sufficient reason to propose or suppose the philosophical superiority of "modernity." The failure of Hume and Kant and much modern philosophy to understand the concept and content of reasons for action underlies Habermas' attempted distinction between ethics and morality, and Rawls' concept of public reason. A proper study of discourse also yields a metaphysics of the person, and thus reinforces the ethics.

In Memoriam: Father Bill Lewers, Jay Tidmarsh Jan 1998

In Memoriam: Father Bill Lewers, Jay Tidmarsh

Journal Articles

There is an old and famous Irish blessing, the last line of which runs: "And may you be in heaven half an hour before the devil knows you're dead." If anyone ever deserved to be happily ensconced in heaven for the proverbial half-hour, it is Bill Lewers.

For the last fourteen years of his life among us, Bill spent his considerable energy improving our understanding and awareness of international human rights. It became Bill's great passion. In 1983, Bill was appointed as Director of the Office of International Justice and Peace for the United States Catholic Conference. When he returned …

Reflective Remote Method Invocation, George K. Thiruvathukal, Lovely S. Thomas, Andy T. Korczynski

Computer Science: Faculty Publications and Other Works

Remote Method Invocation (RMI) is available in the current Java language design and implementation, providing the much-needed capability of allowing objects running in different Java processes to collaborate using a variation on the popular Remote Procedure Call (RPC).

Although RMI provides features which are desirable for high-performance distributed computing, its design and implementation are deficient in key areas of importance to the high-performance computing community in general. This paper addresses the key deficiencies of RMI and how these deficiencies affect the design and implementation of distributed object applications.

Reflective RMI (RRMI) is an open RMI implementation which makes better use …

Wide-Area Implementation Of The Message Passing Interface, Ian Foster, Jonathan Geisler, William Gropp, Nicholas Karonis, Ewing Lusk, George K. Thiruvathukal, Steven Tuecke

Computer Science: Faculty Publications and Other Works

The Message Passing Interface (MPI) can be used as a portable, high-performance programming model for wide-area computing systems. The wide-area environment introduces challenging problems for the MPI implementor, due to the heterogeneity of both the underlying physical infrastructure and the software environment at different sites. In this article, we describe an MPI implementation that incorporates solutions to these problems. This implementation has beenconstructed by extending the Argonne MPICH implementation of MPI to use communicationservices provided by the Nexus communication library and authentication, resource allocation, process creation/management, and information services provided by the I-Soft system (initially) and the Globus metacomputing toolkit …

Executive Stock Options: The Effect On Discretionary Accruals And Earnings Manipulation, Suneel Kumar Maheshwari Jan 1998

Executive Stock Options: The Effect On Discretionary Accruals And Earnings Manipulation, Suneel Kumar Maheshwari

Electronic Theses and Dissertations 1990 - 1999

My objective is to evaluate whether managers, when executive stock options (ESOs) are part of their compensation, manipulate earnings by using discretionary accruals (DAs). Earnings manipulation requires managers to have some targets or expectations in mind. The target may be in the form of investors' expectations or the managers' own subjective expectations. Although meeting investors' expectations could result in income smoothing, executives might also manipulate earnings to achieve their own subjective expectations for private gains. I develop and test three hypotheses using logistic regression to address the issue of earnings manipulation by executives. The first hypothesis evaluates the likelihood of …

Immunoaffinity Purification Of Albumin From Fish Serum, Christine V. Apter Jan 1998

Immunoaffinity Purification Of Albumin From Fish Serum, Christine V. Apter

Electronic Theses and Dissertations 1990 - 1999

This study describes an affinity method which purifies albumin from fish serum. Hybridoma clones producing antibodies specific to fish albumin have been screened and propagated and their antibodies coupled to a cross-linked agarose gel matrix which has been activated with N-hydroxysuccinimide. The resulting gel with its ligand attached was then used to purify albumin from fish serum. The procedure was optimized for coupling, sample application and elution. The coupling optimization using varying pH values resulted in over 90% coupling efficiencies. The sample application optimization showed yields of 2 mg of protein per ml of serum at 1:5 dilution of sample. …

Information Systems Management And Outsourcing: A Study Of American City Governments, Yong-Mi Kim Jan 1998

Information Systems Management And Outsourcing: A Study Of American City Governments, Yong-Mi Kim

Electronic Theses and Dissertations 1990 - 1999

An information system is defined as "a system that uses information technology to capture, transmit, store, retrieve, manipulate, or display information used in one or more business processes" (Alter, 1996, p. 61). The use of information systems (IS) in local governments has dramatically increased and diversified over the past ten years. Because IS expenditures are expected to increase, IS management will be a key issue in city governments. In order to explore IS management and outsourcing in American city governments, three theoretical perspectives and three models are employed. The three theoretical perspectives influencing IS outsourcing are (1) economic factors, (2) …

A two-site, qualitative case study design was used and the primary sources of data were interviews, document analysis, and researcher non-participant observations. The sample of 20 included ten higher education faculty members who currently are teaching courses using distance learning technology and ten who are not, five from each category at each of the two sites. Findings were grouped and addressed by seven areas of influence: trappings …

Interfamilial Relationships Of Cactaceae Within The Dicot Order, Caryophyllales, James Evans Oliver Jan 1998

Interfamilial Relationships Of Cactaceae Within The Dicot Order, Caryophyllales, James Evans Oliver

Electronic Theses and Dissertations 1990 - 1999

The position of the cactus family, Cactaceae, within the order Caryophyllales was examined by outgroup analysis of chloroplast rbcL gene sequence data. Comparative data came from 28 outgroup species in 15 families and six ingroup species. Phylogenetic Analysis with PAUP 3.1 produced twelve equally parsimonious trees; these were used to generate a strict consensus tree. MacClade 3.06 was used to refine the polytomies in the consensus tree. Analysis indicates that the Cactaceae is a monophyletic clade; moreover, these results support the work of other analyses that the sister family to Cactaceae is the Portulacaceae. Other relationships within the order are …

Internet Advertising: New Media, New Models?, Eric James Karson Jan 1998

Internet Advertising: New Media, New Models?, Eric James Karson

Electronic Theses and Dissertations 1990 - 1999

Much of what we currently know about consumers' reaction to persuasive attempts (advertisements) comes from studying mass media communications which are largely one-way and image-centered. Internet-based advertising is neither given the focus on information and the ability to narrowly target such appeals (sites), as in direct marketing advertising. Given the emergence of Internet promotions, this is a substantial gap in our knowledge. This research seeks to both extend the boundaries of current direct marketing research (with its predominant focus on who will reply) and the domain of existing persuasion theories and models, attempting to gain a greater understanding of why …

Long-Term Survivorship In Women With Breast Cancer, Catherine Carpenter Marinak Jan 1998

Long-Term Survivorship In Women With Breast Cancer, Catherine Carpenter Marinak

Electronic Theses and Dissertations 1990 - 1999

The purpose of this study was to develop a theory of survivorship in long-term breast cancer patients, and a subsequent educational program to assist health care practitioners to guide these survivors. Seven women who had survived breast cancer for at least 10 years, were interviewed over a twelve month period. This qualitative study used Glaser & Strauss's grounded theory method to generate the process of survivorship for these women. The emergent core category, "life's journey" was characterized by two core variables, "caring with self" and "completing the grieving process". The following themes emerged from within these variables: coping strategies, maintaining …

Lived Experience Of Sexuality For Post-Menopausal Women, Susan Lynn Taylor Jan 1998

Lived Experience Of Sexuality For Post-Menopausal Women, Susan Lynn Taylor

Electronic Theses and Dissertations 1990 - 1999

Phenomenologic inquiry was used to answer the research question, "What is the lived experience of sexuality for the postmenopausal woman?" Three dimensions of the experience of sexuality were uncovered in the interviewing process. The first dimension was adjusting to postmenopausal puberty. This referred to the physical and emotional adjustment each participant went through while coming to accept and adjust to hormone related changes in their bodies. The second dimension was self perception as related to being and becoming through menopause. This referred to the personal growth that took place in each participant as she navigated through the menopause experience. The …

Notion Of Aggregation, Monika. Saksena Jan 1998

Notion Of Aggregation, Monika. Saksena

Electronic Theses and Dissertations 1990 - 1999

Most popular object-oriented modeling techniques (OOMTs) provide good support for the creation of conceptual models of system behavior and structure. A serious drawback of these techniques is that the concepts and notations used are not rigorously defined. This can lead to the creation of ambiguous models, and to disagreements over the proper use and interpretation of modeling constructs. An important modeling construct that is often loosely defined is aggregation. This thesis presents a precise characterization of aggregation that can help developers identify appropriate applications of the concept. Our characterization is the result of careful analysis of literature on conceptual modeling, …

The overall objective of this study was to answer the primary question: What is the relationship between diversification strategies and corporate performance? In addition, this study aimed to determine if the inconsistencies found in the diversification-performance relationship across studies is attributable to moderator variables such as: (1) measurement of diversification, (2) measurement of performance, (3) source of data, (4) time period, and (5) industry effects. A final objective of this study was to …

Para-Aminophenyl Alumina: A New Stationary Phase For High-Performance Liquid Chromatography, Mincs-Elie. Calixte Jan 1998

Para-Aminophenyl Alumina: A New Stationary Phase For High-Performance Liquid Chromatography, Mincs-Elie. Calixte

Electronic Theses and Dissertations 1990 - 1999

Surface-modified alumina containing covalently-bonded p-aminophenyl groups was prepared by refluxing chromatographic grade alumina with p-aminophenylphosphonic acid in n-butanol. The resulting material, p-aminophenylalumina (PAPA), was evaluated for use as a stationary phase in high performance liquid chromatography (HPLC). When used with mobile phases consisting of acetonitrile and water, retention of solutes on the PAPA phase exhibited normal phase behavior, as evidenced by the increases in solute retention times with increasing percentages of acetonitrile. Excellent separations of carbohydrate mixtures were obtained on the PAPA stationary phase. Comparisons of the chromatographic properties the PAPA phase with those of commercial aminoalkyl silica stationary phases …

Poetics Of The Affective-Expressive In The Novels Of Chinua Achebe, Patricia Rena Brown-Mcdonald Jan 1998

Poetics Of The Affective-Expressive In The Novels Of Chinua Achebe, Patricia Rena Brown-Mcdonald

Electronic Theses and Dissertations 1990 - 1999

Chinua Achebe is one of Africa's most renowned writers. However, the excellence of his work is compromised by the assumptions of Western poetics, that is, mimesis. European critics contend African writing suffers from the prevalent use of proverbs, and obtrusive authorship, among others. But, Earl Miner, through his discourse on the poetics of the affective-expressive, challenges mimesis. He shows that only Western poetics is rooted in drama, all others are rooted in lyric. This fact reverses the table. African writing, rather than being an oddity, represents a global poetics. Miner shows new ways of analyzing literature by incorporating monogatari, re-evaluating …

Reconstructing Predevelopment Conditions Of Lake Worth Creek Using Historical Maps, Accounts, And Aerial Photography, Susan O. Farnsworth Jan 1998

Reconstructing Predevelopment Conditions Of Lake Worth Creek Using Historical Maps, Accounts, And Aerial Photography, Susan O. Farnsworth

Electronic Theses and Dissertations 1990 - 1999

This thesis develops a technique that combines the use of historical geography with photo interpretation and physical geography to reconstruct the predevelopment landcover of an urban area in southeastern Florida. This technique differs from traditional map making methods by utilizing Geographic Information System modeling procedures to create a conceptual map and test it against independent historical maps and accounts. Historical maps and accounts provided new information about the historic landscape that could not be deferred from present physiographic information. The resulting maps had more detail about the most highly altered areas than the conceptual map created from physiographic information.

Relation Enigmatique Du Texte Et Des Images Dans "Nadja", Anne Claude Sutton Jan 1998

Relation Enigmatique Du Texte Et Des Images Dans "Nadja", Anne Claude Sutton

Electronic Theses and Dissertations 1990 - 1999

The reading of Nadja may seem effortless at first, given that the novel's two hundred pages include fifty pages of illustrations. These pictures are of two kinds, photographs and drawings. Breton's different expressive modes, verbal and graphic, combine two opposite worlds, the written reference to the real Parisian places and the surreal sphere depicted in the avant-garde portraits and drawings. One of the primary surrealist technique is to mix different elements, such as illusion, the fantastic, and the dream in order to create a new world, free of any banal reality or logic to transport the reader out of mundane …

The Effect Of Choline Supplementation On Maze Running Ability In Hypothyroid Rats, Jessica Ramer Jan 1998

The Effect Of Choline Supplementation On Maze Running Ability In Hypothyroid Rats, Jessica Ramer

Electronic Theses and Dissertations 1990 - 1999

The effects of perinatal hypothyroidism and perinatal choline supplementation on radial arm maze performance were assessed. Animals were made hypothyroid by the administration of propylthiouracil (PTU) to the mash of dams from prenatal day 15 until postnatal day 15. Choline chloride was administered prenatally in drinking water and postnatally through injections to the pups until day 24. Hypothyroid animals made significantly more reference and working memory errors than did euthyroid animals. Perinatal choline supplementation reduced the number of working memory errors, but not reference memory errors, in both euthyroid and hypothyroid animals.

Watershed Delineation In A Low Topographic Relief Landscape Of South Florida, Michael T. Rose Jan 1998

Watershed Delineation In A Low Topographic Relief Landscape Of South Florida, Michael T. Rose

Electronic Theses and Dissertations 1990 - 1999

Watershed delineations in low topographic relief landscapes with canal networks require hydrography. This hypothesis was tested by utilizing digital elevation models (DEMs). Seven DEMs were processed using two automated delineation methods. Both methods include filling of localized sinks, but an enhanced method incorporated incremental "tipping" to provide flow direction. In two watersheds studied, DEMs with only topography delineated watersheds within 24% and 84% of the manual delineation. With the addition of hydrography, including canals, both watersheds were delineated to within 85% and 92% of the manual delineation. Contrary to the assumption that tipping would improve delineation, tipping decreased the delineated …
