At times, the law appears confusing and unfair. Criminal defendants receive the strictest of all standards of review: "guilt beyond a reasonable doubt." But why are the accused afforded greater constitutional protections than the victim? One reason may be found by examining the intent of the authors of the United States Constitution. Our founding fathers wanted Americans to escape the kind of persecution suffered under English rule. From its inception, the Constitution and the laws that followed were based on public policy and ethics. This legal precedence is used to interpret new laws. Improvement in a woman’s quality of life is a prerequisite for development of human resources, because the quality of children’s physical and mental development is inextricably tied to the health and welfare of women as future mothers. If a mother is well protected during the pregnancy, birth, and postpartum period, the risk of illness and other problems in fetuses and newborn babies will be reduced. In view of the complexity of the problems facing women, the document concludes that Indonesia needs a plan for the future with a gender perspective that prioritizes increased life expectancy, legal protection, and empowerment for women. This thesis will evaluate several proposals to reform the Medicare system and how those proposals differ in terms of focus on either financial restructuring or care delivery redesign. This thesis proposes that an emphasis on managed care strategies will represent an effective way to reform the Medicare system.

The purpose of the study is to consider how a shift in focus from acute care treatment to illness prevention and chronic disease management would salvage the Medicare program. Isolation Of The Virulence Gene(S) In The New, Live, Oral Vaccine Candidate Salmonella Typhimurium Sr-11 Fad, James H. Allen

A DNA fragment containing the defective virulence gene(s) in the live oral vaccine candidate Salmonella typhimurium SR-11 Fad was isolated. Genomic DNA fragments from the vaccine candidate, constructed by Tn10d::cam transposon mutagenesis, were probed with the 1.4 Kbp chloramphenicol resistance gene contained in Tn10d::cam and analyzed by Southern hybridization. Two of the fragments, an 8.0 Kbp Hind III fragment and a 4.5 Kbp Pst I fragment, were isolated, cloned into E. coli HB 101, and mapped. The Pst I fragment, containing approximately 2.9 Kbp of flanking genomic DNA, was subcloned into the sequencing vector pBluescript …

In Vitro Growth Characteristics Of Two Cryptococcus Neoformans Isolates, Kristy L. Jones, Juneann W. Murphy

Journal of the Arkansas Academy of Science

Cryptococcus neoformans is an opportunistic pathogen which attacks individuals with weakened immune systems. Two C. neoformans isolates, 184A and NU-2, were examined to determine characteristics that contribute to their difference in virulence. Both isolates were grown under tissue culture conditions, and different characteristics were tested at timed intervals. Isolate 184A was found to grow at a faster rate than isolate NU-2, with doubling times of 4 and 12 hours respectively. The polysaccharide capsule of isolate NU-2 doubled in size in four hours, while that of isolate 184A stayed approximately the same. The NU-2 yeast cell diameter without the polysaccharide capsule …

Blood As A Biological "Drug": Scientific, Legal, And Policy Issues In The Regulation Of Placental And Umbilical Cord Stem Cell Transplantation, Jennifer Kulynych

Not all blood cells are created equal. Some are born, carry out their appointed tasks-red blood cells oxygenating the blood, white blood cells fighting infection-and die. But an elusive subset have special properties: they are the progenitors of all the many types of peripheral (circulatory) blood cells, and as such, they have the potential to reconstitute an entire blood supply. Known as hematopoietic stem cells, these blood cells reproduce indefinitely. For patients with leukemia or other blood diseases, the transplantation of hematopoietic stem cells from another person's bone marrow can provide the gift of life.

OBJECTIVE: We describe results from 284,503 mammographic examinations and associated diagnostic workups provided to medically underserved women in an ongoing nationwide breast cancer early detection program. MATERIALS AND METHODS: We report the results of mammographic examinations and diagnostic workups on 230,143 medically underserved women 40 years old or older who underwent at least one mammographic examination from July 1991 through June 1995. Mammograms were obtained in hundreds of mammography and clinical facilities throughout the United States, including community health centers, health department clinics, private practitioners' offices, university based facilities, and mobile mammography units. Harbor Branch Oceanographic Institution (HBOI) has a worldwide collection of over 25,000 marine macro-invertebrates and algae representing diverse geographical, latitudinal, and depth (0-3000 ft) ranges. Samples are tested for biological activity in a panel of whole cell and enzyme/receptor assays, including antibacterial, antifungal, cytotoxicity, antitumor, and immunomodulatory assays. Of the taxa sampled, Porifera have the greatest incidence of activity within these screens and especially within the antimicrobial assays. Cnidaria, Chordata (Ascidiacea), Phaeophyta, and Chlorophyta also show strong antimicrobial activity. A comparison of bioactivity and depth of collection indicates that benthic organisms are active throughout the depth range of this study. …

OBJECTIVE: To study maternal and neonatal effects of combination nucleoside analog therapy administered to human immunodeficiency virus (HIV)-infected pregnant women for maternal indications.

METHODS: A multicenter, prospective observational study was undertaken at six perinatal centers in the United States and Canada that supported regional referral programs for the treatment of HIV-infected pregnant women. Demographic, laboratory, and pregnancy outcome data were collected for 39 women whose antiretroviral treatment regimens were expanded to include more than one nucleoside analog for maternal indications. Determinants Of Antepartum Human Immunodeficiency Virus Testing In A Non-Medicaid Obstetric Population., E Cardonick, S Daly, M Dooley, K Elles, N S Silverman

OBJECTIVE: To determine voluntary human immunodeficiency virus (HIV) testing rates and factors influencing testing in a private obstetric practice.

METHODS: Antepartum patients were offered HIV testing after completing a self-assessment questionnaire. Perceived risks and demographics were correlated with testing rates.

RESULTS: Overall, 348/600 (58%) women consented to HIV testing. In a univariate analysis, patients with "any" perceived risk(s) were more likely to be tested. Single women and those with an at-risk partner(s) or a history of sexually transmitted disease (STD) were more likely to desire testing. These factors remained independently associated with voluntary testing in a multivariate regression model. No …

Removing The Venom From The Snakehead: Japan's Newest Attempt To Control Chinese Human Smuggling, Ian Peck

This Note examines Japan's 1997 Amendment to the Immigration Control and Refugee Recognition Act as a response to illegal Chinese immigration. Part II of the Note identifies and explains the international human smuggling crisis. Part III examines Sino-Japanese human smuggling. Finally, Part IV analyzes the Immigration Control and Refugee Recognition Act in detail and suggests some of the Act's shortcomings.
