An employee who is injured in the course and scope of employment may be entitled to receive indemnity and medical benefits. However, the employer/carrier (E/C) also may be entitled to offset certain collateral benefits against workers' compensation indemnity benefits. The purpose behind the offset rules is to prevent an injured employee from reaping a windfall from the work accident so that the employee is not compensated more after than before the accident.

Lawyers must abide by their ethical duties and responsibilities before, during, and after representing a client. Failing to do so exposes a lawyer to disciplinary action and legal malpractice. Unfortunately, many lawyers, through calculated risk or carelessness, violate the very rules that protect their profession. The following article is based on a compilation of the actual number of grievances filed in Texas grievance committees. Although these numbers are not the whole story of why grievances were filed against lawyers, they serve as signals to the bar of major pitfalls to avoid. Frequent Flyer Awards As Taxable Income: Time To Pay The Tax Man, Sharon Alice Pouzar

Texas Wesleyan Law Review

This Comment will argue the Service's position should shift to aggressively collect all applicable taxes on frequent flyer benefits. Part I of this Comment provides a brief overview of the frequent flyer phenomena. Part II analyzes whether frequent flyer benefits are taxable income or excluded from income. Part III proposes a method both to value the benefits earned and to establish the timing of the event. The Conclusion calls for aggressive enforcement of the collection of income taxes on qualifying transactions.

Cryptosporidiosis (crypto), a disease affecting both animals and humans, is caused by the organism Cryptosporidium. This is not a bacteria or virus but a group of parasitic protozoans (single-celled organisms that live off other organisms). There are several species of Cryptosporidium, most of which infect only specific species of animals.

Assessing The Accuracy Of A New Diagnostic Test When A Gold Standard Does Not Exist, Todd A. Alonzo, Margaret S. Pepe

UW Biostatistics Working Paper Series

Often the accuracy of a new diagnostic test must be assessed when a perfect gold standard does not exist. Use of an imperfect test biases the accuracy estimates of the new test. This paper reviews existing approaches to this problem including discrepant resolution and latent class analysis. Deficiencies with these approaches are identified. A new approach is proposed that combines the results of several imperfect reference tests to define a better reference standard. We call this the composite reference standard (CRS). Using the CRS, accuracy can be assessed using multistage sampling designs. Maximum likelihood estimates of accuracy and expressions for …
