Violence Desistance Among Battering Men: Existing Interventions And The Application Of The Transtheoretical Model Of Change, Deborah A. Levesque Jan 1998

Violence Desistance Among Battering Men: Existing Interventions And The Application Of The Transtheoretical Model Of Change, Deborah A. Levesque

Open Access Dissertations

This research examines the efficacy of existing interventions for battering men and assesses the applicability of the Transtheoretical Model of Change to the problem of violence desistance. In Chapter 1, separate meta-analyses of batterer treatment outcome studies relying on partner reports of recidivism (N=7) and official records (N=11) are conducted to assess treatment efficacy. A third analysis examines the overall rate of recidivism across studies that follow treatment completers (N=38). Results show that the effect of treatment is small at best and moderated largely by program, study, and publication variables. The overall rate of …

Adolescent Students With Behavior Disorders: Teacher's Current Referral Practices, Nancy Ruth Smith Jan 1998

Adolescent Students With Behavior Disorders: Teacher's Current Referral Practices, Nancy Ruth Smith

Open Access Dissertations

This study combined qualitative and quantitative methods to investigate teachers' practices when referring adolescent males and females to special education under the behavior disorder classification. Sixteen teachers were interviewed for the qualitative study. It was found that: teachers refer more males than females to special education for having a behavior disorder; females are more likely to be referred to guidance counselor as a means of addressing emotional/behavioral concerns within the school setting; within the classroom males tend to demonstrate more externalizing behaviors and females more internalizing behaviors; and teachers tend to demonstrate more leniency with females in the discipline process. …

Chilling Child Abuse Reporting: Rethinking The Capta Amendments, Caroline T. Trost Jan 1998

Chilling Child Abuse Reporting: Rethinking The Capta Amendments, Caroline T. Trost

Vanderbilt Law Review

On a December night in 1993, Gregory Bryant-Bruce, age six months, was rushed to Vanderbilt University Medical Center Emergency Room for treatment of severe anemia, shock, and abnormally low hematocrit.' A CT scan revealed brain hemorrhaging, and a physical examination showed retinal hemorrhages of varying ages. Retinal bleeding in a young child is almost always caused by traumatic injury, and is considered to be a classic sign of "Shaken Impact Syndrome" ("SIS"), a life-threatening and relatively common form of child abuse. Thus, on the basis of Gregory's symptoms and the in- adequacy of his parents' explanation of his injuries, Gregory's …

Primum Non Nocere: The Expanding "Honest Services" Mail Fraud Statute And The Physician-Patient Fiduciary Relationship, Gregory D. Jones Jan 1998

Primum Non Nocere: The Expanding "Honest Services" Mail Fraud Statute And The Physician-Patient Fiduciary Relationship, Gregory D. Jones

Vanderbilt Law Review

In one case, a physician refers a patient to a certain hospital in return for an undisclosed referral fee from the hospital. In another, a physician decides not to refer a patient to a specialist for further examination. The physician, however, does not disclose to the patient that part of the cost of sending the patient to the specialist would come out of the physician's potential earnings. In the previous examples, has the physician breached her fiduciary duty to the patient by not disclosing her own financial interest in the patient's treatment? If so, the physician could be guilty of …

The Hemp Controversy: Can Industrial Hemp Save Kentucky?, Susan David Demaine

Articles by Maurer Faculty

In the wake of litigation over the responsibility of tobacco companies for harm caused by cigarettes and in the face of increased public hostility toward smoking, Kentucky's tobacco farmers are apprehensive about the future. While not all growers depend entirely on tobacco for their income, the potential shrinking of the tobacco market will have serious ramifications throughout the state. Some farmers are turning to organic vegetable farming, or to com and soybeans as alternative crops, but the potential of industrial hemp as an option remains uncertain. Touted by many as the answer to the tobacco farmer's quandary, industrial hemp remains …

Constructing Identities And Defining The Nation: Germany Since 1949., Frank Anthony Allevato Jan 1998

Constructing Identities And Defining The Nation: Germany Since 1949., Frank Anthony Allevato

Graduate Theses, Dissertations, and Problem Reports (ETD)

Not long after Germans began the historic task of dismantling the Berlin Wall in 1989, their country was again reunited after forty-five years of division. For the second time in less than a century, a majority of Europe’s Germans were brought together under the banner of a single political sovereignty. As the enlarged Federal Republic psychologically reorients and physically reconstructs itself, the event is likely to have continued European and worldwide implications. Understanding the new Germany’s internal development and its evolving self-perceptions is to conceive of the country’s role now and in the years ahead; central to understanding Germany today …

The Effects Of Toothbrush Design On Bacterial Retention And Viability: A Preliminary Study., Heidi Lynn Dahmer Jan 1998

The Effects Of Toothbrush Design On Bacterial Retention And Viability: A Preliminary Study., Heidi Lynn Dahmer

Graduate Theses, Dissertations, and Problem Reports (ETD)

It is known that toothbrushes can harbor microorganisms. Researchers suggest replacing toothbrushes immediately following illness to reduce the possibility of microorganisms causing disease.1 The continuous use of a microbial-contaminated toothbrush may be potentially harmful to its user, especially if the user is medically compromised or immunosuppressed. Gingival irritation created during improper toothbrushing technique may result in portals of entry for bacteria to be introduced into the systemic circulation. This tissue damage is characterized by a break in the mucosal integrity permitting microbial invasion.1 Toothbrush bristle composition (i.e., texture, size, treatment, and placement) can also affect the amount of oral tissue …

A Study Of Impact Using 80-Derometer Rubber., Steven Harold Howard Jan 1998

A Study Of Impact Using 80-Derometer Rubber., Steven Harold Howard

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this work was to model and test an intermediate material that would absorb impact loads induced during deployment of a deployable rollover protective structure (ROPS) designed for use on a farm tractor. The design criteria required that the intermediate material, under compressive loads, maintain the integrity of all moving parts while introducing a minimum impact time of 0.005 seconds. A "ring" shaped part made of 80-Derometer rubber (a product of the Goodyear Corporation) was incorporated into the impact region of the ROPS deployment mechanism. Theoretical calculations were made based on energy balance equations and 2-D Working Model …

Identification And Characterization Of Sympathetic Neurons That Innervate Mesenteric Artery Or Vein In The Guinea-Pig., Zhongling Zheng Jan 1998

Identification And Characterization Of Sympathetic Neurons That Innervate Mesenteric Artery Or Vein In The Guinea-Pig., Zhongling Zheng

Graduate Theses, Dissertations, and Problem Reports (ETD)

Guniea-pig inferior mesenteric ganglion (IMG) neurons that innervate artery or vein were separate neurons and there was no double labeling (Fluorogold and rhodamine beads) in the labeled neurons. The arterial neurons located in the central part of the IMG whereas venous neurons located peripherally. The cross-sectional area of total somata of arterial neurons was smaller than those of venous neurons which were smaller than unlabeled neurons. NPY-IR was found in 18% of arterial neurons, but not in venous neurons. All of the labeled vascular neurons fired tonically using whole cell patch-clamp recordings. All three types of neurons received a capsaicin-sensitive …

Maintaining Incentives For Bioprospecting: The Occasional Need For A Right To Lie, Robert H. Heidt

Articles by Maurer Faculty

Building on a model by Anthony Kronman, the author argues that biotechnological researchers searching for valuable cells should occasionally be allowed to deceive research subjects whose cells prove valuable. The wish to preserve proper incentives for these searches justifies this exception to the law's usual abhorrence of deception. The subject's ability to "hold up" the researcher once the subject learns of his cells' value combined with the law's likely refusal to force an unwilling subject to continue his cooperation with the researcher poses risks for biotechnologists that other producers of information do not face and that the right to deceive …

Short Changing Short-Term Risk: A Study Of Superfund Remedy Selection, John S. Applegate, Steven M. Wesloh Jan 1998

Short Changing Short-Term Risk: A Study Of Superfund Remedy Selection, John S. Applegate, Steven M. Wesloh

Articles by Maurer Faculty

Unlike most environmental statutes, CERCLA requires a lengthy period of labor-intensive activity to achieve its clean-up goals. This aspect of the Superfund program does not receive sufficient attention in policy and legal analyses of CERCLA, nor during site-specific remedy selection decision-making. The risks of the remediation period-to workers, to site neighbors, and to the natural environment-are substantial, as this Article illustrates. However, the confusing and sometimes dismissive treatment of remediation risk in the EPA 's detailed guidance for Superfund decision-makers invites the neglect of the short-term effectiveness criterion in the remedy selection process. A study of remedy selection documents in …
