New York State's Brownfields Programs: More And Less Than Meets The Eye, Michael B. Gerrard

New York, as the nation's second most populous state, and one of its oldest and most urban, has an abundance of brownfields-slightly contaminated properties that were formerly used for industrial purposes, but that are now unused or underused, and ripe for redevelopment if they can be cleaned up. Thus, it may be surprising that New York is one of the few states without a comprehensive statute or regulation for the voluntary cleanup of brownfields.

There is, however, more here than meets the eye. New York has three important programs and several smaller ones that provide procedures, money, or incentives for …

Religious Law And Civil Law: Using Secular Law To Assure Observance Of Practices With Religious Significance, Kent Greenawalt

Civil law in the United States rarely helps to enforce religious standards or demands that people perform actions whose significance relates to religious obligations. Yet, some American states do have such involvement with certain observances of Orthodox and Conservative Judaism. Many states enforce kosher requirements, to which Orthodox and some Conservative Jews adhere. The laws, which penalize fraud in the labeling of products as kosher, serve the secular interest in preventing deception of consumers. However, the laws also force the state to decide when religious regulations have been violated.

Orthodox and Conservative Jewish divorces raise a second kind of involvement. …

This thesis is concerned with designing a Higher Layer Protocol (HLP) for small distributed microcontroller systems using a well-established network protocol: the Controller Area Network (CAN) protocol which, currently, is widely used in the automation industries. Steps were taken to investigate three popular HLPs based on the CAN protocol: namely. Smart Distributed System (SDS), DeviceNet. and CAN Kingdom. Following the comparison of the three HLPs, the CAN Kingdom protocol was chosen for the task of designing the HLP in this project in order to satisfy the restrictions associated with small systems. Retention Of Administrators In Nursing Homes: What Can Management Do?, Douglas A. Singh, Robert C. Schwab

Annual turnover among nursing home administrators may be 40% or higher. To investigate the factors that could lead to greater administrator retention, responses to a survey (53% response rate) were analyzed using factor analysis and multiple regression models. Results show that higher retention is observed when administrators are allowed to function independently, are involved in decision making, are treated fairly, and are given reasonable goals to achieve. Organizations must hire administrators whose values match theirs. Multifacility chain organizations and for-profit facilities appear to have a greater need to embrace organizational principles that lead to greater job satisfaction.

The purpose of this study was to gain insight on the effects of cultural genocide through the lens of selected Cree elders in Alberta, Canada. The study enlisted the elders' perspective on the legacy of cultural genocide, and its residue. This process enabled the elders to offer views about Cree identity, and suggest a leadership perspective for continued cultural renewal. The study applied a Lockean theory to the attack on Natural Law to explain the genocide. Limitations of policy makers and health care providers understanding about living conditions in later adulthood continually constrains mature adults from doing more for themselves, and society. These circumstances move society to devalue mature adults. Less valued mature adults tend to become even more dependent, that is, increasingly less willing to care for themselves, and less able to contribute to the social good. The study seeks to understand and develop insights into the San Diego-Tijuana transborder economic collaborative partnership, by examining the Binational Planning and Coordination Committee (BPCC). This entity was established in 1993 via a Letter of Agreement between the City of San Diego and the municipality of Tijuana. Pursuant to the Letter of Agreement the BPCC is examined against the backdrop of the global economy, the emergence of region-states, U.S.-Mexico relations and transborder relations in the San Diego-Tijuana region. In response to economic, legislative and social forces, public health and human service systems are becoming more integrative, requiring direct service practitioners to acquire new competencies to successfully perform in these new settings. In a review of the literature, competencies pertaining to team effectiveness, interprofessional collaboration and cross-functional knowledge and skills all appear to be relevant considerations. Moreover, an examination of competencies must consider individual, team and organizational dimensions in a context of health and welfare reform. Popular literature and much of the research reported in recognized journals imply that all members of an organization subscribe to the same ideas about leadership. However, a few authorities believe the research findings may result from test instruments based on a single view of leadership. Accurately identifying members' views of leadership is important because these views help shape behavior and expectations within the group. Differing views of leadership may also be a root cause of conflict among organizational members. The purpose of this study was to identify organisational effectiveness criteria relevant to the Federation of WA Police and Citizens Youth Clubs; analyse variations between important constituent groups; and compare the criteria developed with the Objects of the Federation and relevant models for assessing organisational effectiveness within the Western Australian public sector. A four round Delphi technique was applied to club staff, management committee members, coaches and other volunteers (including current and ex-club members) to identify organisational effectiveness criteria. This study investigates the use and occurrence of talk during the implementation of the key approaches of Shared Book Reading and Class Dictated Story in three Primary Two classrooms in Singapore. These approaches are based on a constructive perspective of literacy where children make meaning from texts read with the teacher through joint exploration and connection with their respective background knowledge and experiences. Central to this joint exploration and meaning-making is the teacher-pupil talk. This study focuses on the probation service and the changes that are impacting on this part of the criminal justice system. It develops a theoretically distinctive approach, drawing on the literature of gender and organisations, in order to investigate issues relating to the organisational structures and processes experienced by male and female probation officers in three disparate probation areas in England. The level of local election turnout has important political and democratic implications. It is politically important because the electoral process ensures that local councillors are held directly accountable to the people. The level of voter turnout and how these votes are apportioned will determine the electoral outcome. Voter turnout also plays a significant role in our evaluation of local democracy. This research investigated the types of reasoning used by coal mine employees when exposed to potentially dangerous situations. Information was gathered through interviews of coal miners who related actual experiences in the coal mines. The information in the interviews and in the review of the literature was used to develop and implement an experiential program that promoted an individual's responsibility for their safety and the safety of co-workers. The experiential program addressed safe work behaviors from the perspectives of emotional and cognitive memories and the functions of the human brain.
