I'Ll Take It For What It Is Worth -- The Use Of Hearsay Evidence By Labor Arbitrators: A Primer And Modest Proposal, Marvin F. Hill, Jr., Tammy M. Westhoff,

Journal of Dispute Resolution

This article considers these and other selected problems dealing with hearsay evidence that are likely to be encountered in the arbitral forum. It is our thesis that arbitrators do and should credit some (but not all) forms of hearsay evidence, but that the arbitral process is not served by admitting all evidence and "taking it for what it is worth." Further, we believe when an advocate's case against a grievant consists entirely of hearsay evidence, and there is no reliable substitute for cross examination or "equivalent circumstantial guarantees of trustworthiness," the grievant should prevail. This article examines the complex of cultural effects and possible legal responses in the wake of the Princess of Wales' death. To say that the paparazzi were complicit in her death is to forget that, in spite of their frequently invasive means of obtaining news, these were also the kind of journalists who were complicit in the public celebration of her life. Had the Hutchins Commission this tragedy to include in its deliberations about press responsibility, it likely would have stated its indignation and suggested Diana's death as more evidence that journalists be regulated. The degradation of atrazine [2-chloro-4-(ethylamino)-6-isopropylamino-1,3,5-triazine], deethylatrazine [DEA; 2-amino-4-chloro-6-(isopropylamino)-1,3,5-triazine], and deisopropylatrazine [DIA; 2-amino-4-chloro-6-(ethylamino)-1,3,5-triazine] was assessed under limited oxygen conditions using in situ microcosms. Denitrification was induced in a shallow sand and gravel aquifer to measure the potential for degradation of atrazine, DEA, and DIA under low-O2 conditions. The dissolved oxygen content decreased from 7-8 mg/L to ≤1 mg/L within 4 days and remained ≤ mg/L for the remainder of the 45-day experiment. Atrazine, DEA, and DIA concentrations (normalized to the bromide concentration at each sampling time to account for dilution) did not show a significant decrease with time, indicating that these …

The planting of "Oil malices" have a number of implications in terms of environmental management within Western Australia. Firstly, the incorporation of perennial trees on a large scale into the agricultural landscape can assist in balancing the hydrological cycle and other land degradation problems (Bird et. al. 1992; Western Australian Salinity Action Plan, 1996). Secondly, harvesting the above-ground biomass can produce an economic return because of the oil contained within the leaves. This oil has the potential to replace ozone damaging solvents (Barton and Knight, J997; Wildy, 1996). Finally, "oil mallees" have the potential to offset greenhouse gas emissions, because …

A descriptive correlational study was conducted to describe the factors that Western Australian women with either Stage I or Stage II Breast Cancer, perceived to be important considerations when deciding upon either Modified Radical Mastectomy (MRM) or Breast Conserving Treatment (BCT) for surgical treatment. The Conflict Theory of Decision Making (Janis & Mann, 1977) was used as the theoretical framework to guide this study. Ward, Heidrich and Wolberg's (1989) Factor List, the Multidimensional Health Locus of Control (MHLC) Scale (Wallston, Wallston & De Vellis, 1978) and a demographic questionnaire were used to measure variables. A range of seagrass characteristics were assessed for potential use as indicators of ecosystem health. Shoot density, shoot width, maximum shoot length, above and below ground biomass, percentage canopy cover, leaf area index, leaf extension rate, meadow productivity, epiphyte biomass, epiphyte species richness, percentage of calcium carbonate in epiphytic material and percentage of nitrogen in leaf tissue were all measured in “healthy~ and unhealthy" Posidonia augustifolia meadows in Cockburn and Warnbro Sounds, from June through to August 1998. The search for the chemical or set of chemicals that act as a germination stimulant in Lactuca sativa v. Grand rapids (a variety of lettuce seed) was the underlying basis of this project. Through the development of a solid phase extraction (SPE) system different fractions of smoky water were tested for their effects on germination enhancement. The project targeted streamlining the amount of solvents as well as time used in past research on smoky water. Previously, several steps involving high perfo1mance liquid chromatography (HPLC), thin layer chromatography (TLC) and Gas Chromatography (GC) were employed. This project used SPE cartridges to …

This study examined the transfer of skills developed in solving a simple algebraic formula. Forty-two university Psychology undergraduates, randomly assigned to one of two training groups. were required to practice solving the formula (X2-Y)/2 by substituting numbers for the variables x and y. One group of participants practiced with eight sets of numbers, while the other group practiced with 16 sets of numbers. All participants performed 320 trials during training. In the transfer phase, the response times required to solve the same formula with a set of numbers not previously encountered was analysed to determine if the variation …

This study uses a feminist framework to explore women's experiences of relocating from a city or large regional centre to a small and isolated town. It comes in response to my personal and professional experience of remote relocation and to the dearth of feminist discussion in this area. The site of the study is a town of 2,500 people, situated in Northern Australia over 1200 kilometres from the nearest capital city and 800 kilometres from the nearest regional centre. Person-Job Fit In The Changing Work Environment : Models For Office Workers And Teleworkers, Sharon C. Elsley

This thesis empirically examined the theoretical domain of Person-Job Fit proposed by Edwards (1991). Two models were tested with data collected from a sample of 101 Office Workers and 101 Teleworkers categorised as professional, managerial, clerical, technical and sales. The adequacy of the two models was tested using Partial Least Squares (PLS) analysis. The Person-Job Fit model found that measures of Abilities, Desires, Supplies and Demands were equally predictive of Personal and Organisational Outcomes for both groups. Commensurate measures were employed for Desires and Supplies. The h1ended Person-Job Fit model included the meaning of home (Groves, 1996b), which was hypothesised …

In light of heart-wrenching stories of sexual abuse and public demands for safety, the Kansas v. Hendricks case presented the Supreme Court with compelling facts on which to uphold the Kansas commitment strategy. After all, the statute prevented the release of a man whose history of sex crimes, incarceration, and institutionalization spanned nearly two decades, and who admitted he still had sexual desires for children but could not control his urges. Faced with that evidence, the Court would have been hard-pressed to strike down the Kansas statute by finding that such a predator received inadequate treatment for his disorder, or …

Beginning in the late 1980s, the Texas Supreme Court saw a slew of conservative judges elected to the bench. With this new Court, previous expansions of the law were stopped. Jury verdicts became highly suspect and were frequently overturned for a variety of reasons. Damages too did not go unnoticed. Juries’ assessments were wiped out by increasingly harsher standards. The ripple effect of the Court’s conservative philosophy on the judicial process was substantial. Jury verdicts, few as they may be, are not subject to harsh scrutiny by conscientious appellate judges sworn to follow the Texas Supreme Court’s precedent. And the …

This paper attempts to model the output and pricing behavior of nonprofit hospitals under a prospective payment system and examines the effect of this behavior on the provision of uncompensated hospital care.' A utility maximizing framework is employed to derive and evaluate comparative statics derivatives describing the effects of a reduction in government reimbursement rates on prices charged by hospitals to private patients and on the quantity of uncompensated care.

Employee Expectations And Job Stress: A Study Of Attrition In The Employment Of Telemarketers, Jeff Cooper

The present study investigated the factors associated with the extremely high attrition rate of a large midwestern telemarketing firm. Factors associated with employee expectations, stressful organizational characteristics, and job satisfaction were explored. The research strategy involved multiple questionnaires, dissatisfaction surveys, and a semi-structured interview, that were developed by the researchers based on information obtained from the company. Current and former employees of the company participated in the study. Results indicated the presence of stressful organizational characteristics that were common between current and former employees. Sale conversion rate pressure from supervisors and inadequate training were identified as the most salient factors …
