The Jew Taboo: Jewish Difference And The Affirmative Action Debate, Deborah Malamud Jan 1998

The Jew Taboo: Jewish Difference And The Affirmative Action Debate, Deborah Malamud

Faculty Articles

One of the most important questions for a serious debate on affirmative action is why certain minority groups need affirmative action while others have succeeded without it. The question is rarely asked, however, because the comparison that most frequently comes to mind-i.e., blacks and Jews-is seen by many as taboo. Daniel A. Farber and Suzanna Sherry have breached that taboo in recent writings. Professor Malamud's Article draws on work in the Jewish Studies field to respond to Farber and Sherry. It begins by critiquing their claim that Jewish values account for Jewish success. It then explores and embraces alternative explanations-some …

Sex Discrimination And Insurance For Contraception, Sylvia A. Law Jan 1998

Sex Discrimination And Insurance For Contraception, Sylvia A. Law

Faculty Articles

Unintended pregnancy is a serious problem in the United States. Most private insurance plans do not pay for contraception even though they pay for other prescription drugs and devices. This Article argues that this pattern constitutes sex discrimination and is prohibited by Title VII of the Civil Rights Act of 1964, as amended by the Pregnancy Discrimination Act. It discusses the reasons this issue has been neglected and suggests ways federal and state officials might remedy this common form of gender discrimination.

What follows is an impressionistic overview of our program's first twenty five years, derived in part from our archives and in part from our collective recollections, and written by the current program director. As with any celebratory institutional history, it makes no claim to objectivity. Our aim is to look back at the main lines of our growth and development, and in so doing to acknowledge many of the individuals who have contributed to the building of the program over time.

We gratefully acknowledge the work of our first archivist, UMass Women's Studies / Sociology graduate dian fitzpatrick who, in …

Characterization Of Petroleum Fog Oil And Vegetable Oil Smokes, Andrew Oliver Larouche Jan 1998

Characterization Of Petroleum Fog Oil And Vegetable Oil Smokes, Andrew Oliver Larouche

Masters Theses

"Deception and concealment to gain tactical advantage in the battlefield has been an integral part of warfare. Smoke has been a common tool used for signaling, concealment of troop movement and weapon deployment. U.S. Armed Forces have made use of smokes in an organized manner since the 1st world war. Since then various materials such as white phosphorus, zinc chloride, diesel fuel and petroleum oil aerosols have been used to obscure military targets. For the past thirty years fog oil (FO) a medium distillate has been extensively used by the U.S. Armed Forces for generation of obscurant smokes (OS). During …

Labor Market Responses To Rising Health Insurance Costs: Evidence On Hours Worked, David M. Cutler, Brigitte C. Madrian Jan 1998

Labor Market Responses To Rising Health Insurance Costs: Evidence On Hours Worked, David M. Cutler, Brigitte C. Madrian

Faculty Publications

Increases in the cost of providing health insurance must have some effect on labor markets, either in lower wages, changes in the composition of employment, or both. Despite a presumption that most of this effect will be in the fonn of lower wages, we document in this paper a significant effect on work hours as well. Using data from the CPS and the SIPP, we show that rising health insurance costs over the 1980s increased the hours worked of those with health insurance by up to 3 percent. We argue that this occurs because health insurance is a fixed cost, …

Placing The Waitangi Tribunal: Attitudes Towards The Claims Settlement Process In New Zealand, Kirsten Matoy Carlson Jan 1998

Placing The Waitangi Tribunal: Attitudes Towards The Claims Settlement Process In New Zealand, Kirsten Matoy Carlson

Law Faculty Research Publications

This article reports the findings of a 1998 survey of the general New Zealand public's attitudes towards race relations and the Treaty of Waitangi. The survey sought to determine whether demographic variables such as age, gender, race, and educational level impact attitudes towards the Treaty of Waitangi and the Treaty Claims Settlement Process. The survey findings indicate some polarisation among New Zealanders according to ethnicity on certain issues, and a general lack of knowledge and/or informed opinions about sovereignty, Treaty, and Tribunal issues.

The Identification, Characterization, And Functionality Of A Multidrug Transporter Protein In The Liver Of The Killifish, Fundulus Heteroclitus, Walter J. Ellenberg Jan 1998

The Identification, Characterization, And Functionality Of A Multidrug Transporter Protein In The Liver Of The Killifish, Fundulus Heteroclitus, Walter J. Ellenberg

MUSC Theses and Dissertations

The killifish or mummichog, Fundulus heteroclitus, is an excellent indicator of environmental quality and ecosystems health. It is the most dominant endemic fish species found in the headwater of small estuarine tidal creeks in the southeastern U.S. and one of the most frequently studied animals for toxicological analysis. In the environment, these organisms are exposed to xenobiotic hydrophobic molecules from anthropogenic ( e.g., pesticides and combustion products) and natural ( e.g., decaying plants) sources. Development of physiological adaptations to both natural and anthropogenic stress is important to fish such as the mummichog which must deal with the rigors of an …

Application Of Hierarchical Monte Carlo Simulation To The Estimation Of Human Exposure To Mercury Via Consumption Of King Mackerel (Scomberomorus Cavalla), W. Leonard Balthis Jan 1998

Application Of Hierarchical Monte Carlo Simulation To The Estimation Of Human Exposure To Mercury Via Consumption Of King Mackerel (Scomberomorus Cavalla), W. Leonard Balthis

MUSC Theses and Dissertations

Data from mercury poisoning episodes in Japan and Iraq have been used to derive threshold levels for health effects in humans, and the U. S. Environmental Protection Agency (EPA) has established a reference dose (RfD) for methylmercury of 0.30 µg/kg/day. It is desirable, therefore, to predict exposures for various populations, and examine these exposures in relation to the established RfD. Given data on mercury concentrations in fish, and rates of fish consumption among human populations, it is possible to calculate exposure in one of several ways. One of the simplest ways involves the use of average values to compute a …

The Goals Of Environmental Enforcement And The Range Of Enforcement Methods In Israel And In The United States, Marcia R. Gelpe Jan 1998

The Goals Of Environmental Enforcement And The Range Of Enforcement Methods In Israel And In The United States, Marcia R. Gelpe

Faculty Scholarship

The article examines enforcement of the environmental laws of Israel and of the United States. It concentrates on provisions for enforcement of the laws by government authorities--that is, either by administrative authorities or by the courts at the request of an administrative authority. Environmental laws in many jurisdictions may also be enforced by private actions. These private enforcement actions are not addressed specifically in this article, although much of what is said is also applicable to such actions.

Regeneration - The Road Not Taken, Raymond E. Sicard Jan 1998

Regeneration - The Road Not Taken, Raymond E. Sicard

Journal of the Minnesota Academy of Science

Regeneration and repair are mutually-exclusive, adaptive responses to injury. The events associated with each process are well characterized. However, cellular and molecular mechanisms for their regulation are only now beginning to be defined. Moreover, full appreciation for factors that predispose to these contrasting pathways is not yet available. This article presents a perspective on regeneration and repair that suggests specific relationships between these modes of responding to injury. Injury provokes a coordinated pattern of response to tissue damage. At the wound site, local events determine whether tissue restoration or replacement occurs. Interplay among parenchymal and stromal cells at the site …
