Gender And University Athletic Status As Factors In Rape Myth Acceptance, Johanna L. Moore

Two hundred eighty-seven students representing each of the four undergraduate levels and the graduate level participated in this study. Participants completed questions about personal characteristics and the long form of the Rape Myth Acceptance Scale developed by Diana Payne (1993). A 2 x 2 analysis of variance was used to assess the effects of gender and athletic status (intercollegiate athlete vs. nonathlete) on the overall RMA score and seven subscale scores. Results showed that men had higher rape myth acceptance than women on all subscale scores and total RMA scale. Athletes as a group had higher RMA than nonathletes on …

The issue of grading the academic performance of students with disabilities has become a challenge as the restructuring of special education has placed these students in general education settings. A survey was conducted within the Illinois counties of Clark, Coles, Cumberland, Douglas, Edgar, Moultrie, and Shelby in hopes of determining current policy, desired grading formats and practical grading adaptations for students with disabilities. Importance Of Nonverbal Communication In The Employment Interview, Michelle E. Milano

The employment interview includes elements that focus on nonverbal communication. Females and males view these nonverbal cues differently. A total of 22 male and 16 female employment interviewers completed quantitative and qualitative surveys concerning nonverbal cues. The data were analyzed using factor analysis, t-tests, and thematic analysis. Five factors, including self-presentation, coverbal cues, appearance, touch, and interviewee sex, emerged from the factor analysis. At 0.05, the t-tests show that females do perceive more nonverbal cues than do males. The qualitative results provide further insight into the quantitative results. These findings show the importance of nonverbal cues during an employment interview.

Previous research to determine which factors predict one's satisfaction with retirement documents varying results. 200 retired Eastern Illinois University professors were surveyed to determine the effects of two factors, locus of control and timing of retirement, considered important on retirement satisfaction. A comparison was made between internal and external locus of control subjects who were placed into three conditions: those who retire early (before age 61), those who retire within the normal or average range (ages 62-66), and those who retire late (later than age 67). Historical Romances: An Analysis Of Co-Constructed Narratives From Engaged Couples, Katie Himes

By studying the manner in which romantic partners tell accounts of their relationship events, researchers can gain insight into the process of relational development. This study examines how five engaged couples socially construct their own shared reality. Using critical incidents, couples first individually described three critical incidents common to engaged couples, including: their first meeting, worst fight, and decision to become a mutually exclusive couple. Next, couples collaborated to produce a shared narrative of significant events in the relationship. Through content analysis, the use of conflict avoidance is examined as a means of creating the collective reality. This research provides …

The purpose of this study was to explore how time spent between parents and children in various activities may be related to self-esteem in children. Despite increased recognition of wetland functions and values, wetland loss and degradation continues in the United States. Digital wetlands and uplands coverages were analyzed to compare the cumulative impacts of humans and beaver (Castor canadensis) on wetland types in the Chickahominy River watershed (Virginia, USA) from 1953 to 1994. A vector-based approach was used for data manipulation, and a raster-based approach was chosen to analyze geographic change over time. Study findings indicated that anthropogenic activities were responsible for both wetland loss and gain in the watershed, and beavers substantially influenced shifting between wetland types. This article explores the disjuncture of positive law and the duty of confidentiality as formulated by Model Rule 1.6. Its central purpose is to question the decision to exclude positive law from the framework of analysis created by the Rule.

Part II summarizes the duty of confidentiality owed to clients by attorneys. Part III examines Model Rule 1.6. This paper focuses on the political and moral debate surrounding two pieces of federal legislation which sought to criminalize a particular late term abortion technique scientifically known as "intact dilation and extraction," and popularly known as "partial birth abortion." The Congressional "Partial Birth Abortion" Bans of 1996 and 1997 inflamed the already emotionally charged contest over abortion rights. The intense lobbying and advocacy efforts put pro-choice activists in the uncomfortable position of having to defend one of the most extreme positions on the abortion-rights spectrum. During the past fifteen years, the alternative dispute resolution movement has greatly altered the legal landscape. Courts, legislatures and administrative agencies have enacted more than 2000 laws dealing with mediation and other dispute resolution processes. The National Conference of Commissioners on Uniform State Laws (NCCUSL) and the American Bar Association Section of Dispute Resolution have recently formed a unique partnership to assess whether a model or uniform mediation statute might remedy some of the problems caused by the current patchwork of often confusing and conflicting mediation laws. The media's use of intrusive newsgathering techniques poses an increasing threat to individual privacy. Courts currently resolve the overwhelming majority of conflicts in favor of the media. This is not because the First Amendment bars the imposition of tort liability on the media for its newsgathering practices. It does not. Rather, tort law has failed to seize the opportunity to create meaninful privacy protection. After surveying the economic, philosophical, and practical obstacles to reform, this Article proposes to rejuvenate the tort of intrusion to tip the balance between privacy and the press back in privacy's direction. Does The Emperor Have No Clothes? Enforcement Of International Laws Protecting The Marine Environment, David S, Ardia

This article examines existing structures and mechanisms for the enforcement of international environmental laws, particularly international laws that must confront violations on the high seas in order to protect marine organisms. Although the tenor of the present analysis is general, many of the most influential international marine agreements to date are highlighted, including the Third United Nations Conference on the Law of the Sea, the Convention on Future Multilateral Co-Operation in the Northwest Atlantic Fisheries, and the United Nations Agreement on the Conservation and Management of Straddling Fish Stock and Highly Migratory Fish Stock.

Cooperation, Conflict, Or Coercion: Using Empirical Evidence To Assess Labor-Management Cooperation, Ellen J. Dannin

Michigan Journal of International Law

Since the 1980s there has been strong interest in labor-management cooperation. That interest was reflected even in government attention, for example, through projects by the U.S. Department of Labor's Bureau of Labor-Management Cooperation. Under the leadership of Undersecretary Stephen Schlossberg, the Bureau's "Laws Project" examined the impact of labor law on labor-management cooperation. The Dunlop Commission issued a report strongly in favor of labor-management cooperation, and National Labor Relations Board (NLRB) Chair William B. Gould has spoken favorably of it. More recently, the government issued a report on state and local initiatives in this area.

Conditional Federal Spending And The States "Free Exercise" Of The Tenth Amendment, Kristian D. Whitten

This article will examine Congress' power under the Spending Clause, and will seek to determine whether, by using its spending power, Congress can constitutionally impose a "free exercise" condition on States and local governments. Part II discusses federalism and the Court's "free exercise" clause jurisprudence. Part III addresses the substance of the proposed RLPA. Parts IV and V examine the Court's shifting posture towards the Spending Clause and federalism respectively. Part VI contrasts the broad provisions of the RLPA, with the more narrow conditions found in the Equal Access Act. Finally, Part VII concludes that enactment of the proposed RLPA …
