Family Governance In The Age Of Divorce, Ann Laquer Estin
Family Governance In The Age Of Divorce, Ann Laquer Estin
Utah Law Review
In the age of divorce, the traditional picture of family governance has been substantially altered. The most striking aspects of this change are the result of new norms of family behavior. With large increases in the number of divorced and nonmarital families, many more families now find themselves before the courts disputing financial, child-rearing, and other questions. Within this context, the old rule of deference to private family governance is often not workable. These families are necessarily subject to a greater level of public intervention and regulation. But the forms of this regulation have also changed, reflecting a new and …
Toward A Contractarian Account Of Family Governance, Marsha Garrison
Toward A Contractarian Account Of Family Governance, Marsha Garrison
Utah Law Review
Families have governments; family governments are characterized by a significant level of state involvement; state prescriptions for family governance are embodied in family law, which lays out a kind of "constitution" describing the powers of family authorities and a "Bill of Rights" for family members. An awareness of this underlying governance scheme is useful because it can illuminate linkages between seemingly disparate areas of law; it can also provide a basis for evaluating specific legislative enactments and judicial pronouncements. But given the rapidity with which family law has moved toward an egalitarian, democratic model of family governance, the model embedded …
Susanna And The Elders: A Note On The Regulation Of Families, Carol Weisbrod
Susanna And The Elders: A Note On The Regulation Of Families, Carol Weisbrod
Utah Law Review
The title of Robert Dahl's book, Who Governs, seems to capture the approach of many conversations on family governance. In an approach which parallels our dominant political theory, we focus on the question who, as an individual, governs, and ask how that power to govern can be better shared with others. Often the goal is equality in the family, at least as between adults, and when we consider this, we use a model of democratic political decision making. The focus is on individuals in a nuclear family. The approach is not new. It is the stance that John Stuart Mill …
Lone Star Liberal Musings On 'Eye For Eye" And The Death Penalty, Irene Merker Rosenberg, Lee A. Wright
Lone Star Liberal Musings On 'Eye For Eye" And The Death Penalty, Irene Merker Rosenberg, Lee A. Wright
Utah Law Review
Texas is number one. Since 1976, the year in which the United States Supreme Court upheld the constitutionality of the state's death penalty scheme, Texas has executed 167 persons, as compared to distant secondplace Virginia and third-place Florida, with a mere 61 and 43 persons, respectively, during the same period. Indeed, Texas's enthusiasm for the death penalty was highlighted by the recent case of Karla Faye Tucker, the first woman to be executed in the state since the Civil War-an execution that took place despite pleas of clemency from a wide spectrum of notables, including the Pope, the European Parliament, …
Utah's Comparative Apportionment: What Happened To The Comparison?, Lee A. Wright
Utah's Comparative Apportionment: What Happened To The Comparison?, Lee A. Wright
Utah Law Review
The question of which damages distribution scheme to adopt amounts to a choice between the goals of fully compensating the plaintiff and proportionally assessing damages to the defendant. To remain consistent with Utah's abolition of joint and several liability, this Comment advocates adoption of a damage apportionment approach based on proportional damages to the defendant, namely the modified blanket comparative fault approach. This approach will accomplish four things. First, it will end the confusion and unfairness that currently exist as a result of the decision in Field v. Boyer Co. Second, it will ensure that negligent defendants only pay for …
Success At Last : One Teacher's Growth In Understanding Of Writer's Workshop, Cindy L. Davis
Success At Last : One Teacher's Growth In Understanding Of Writer's Workshop, Cindy L. Davis
Graduate Research Papers
Writer's workshop is an approach to teaching writing that corresponds to the whole language philosophy. Much of the literature published on the topic of whole language, and specifically writer's workshop, describes the ideal classroom environment. However, "whole language in the intermediate classroom is often given less attention in professional books and journals than the primary classroom receives" (Gannon-Smith, 1991). As a reading and language arts teacher of sixth grade students, I have been interested in teaching writing through the use of writer's workshop. There are some general whole language themes which can be used to build a motivating writing environment …
Promotion Of Student Learning By Small, Rural School Districts As They Design And Integrate Technology Plans, Randall A. Bohman
Promotion Of Student Learning By Small, Rural School Districts As They Design And Integrate Technology Plans, Randall A. Bohman
Graduate Research Papers
How will small, rural school districts promote student learning by the design and integration of technology plans? In addition, other elements that affect the successful implementation of technology include time, money, and attitude. Realistic goals should be established based on these elements. Research included in this paper focuses on concepts and applications that could be implemented in a school with limited financial resources.
If technology is to have an impact on student learning, it must be used in ways that reflect a new understanding of learning. Technology not only may assist traditional instruction, but it may also aid in the …

The purpose of this article is to answer these questions and to study, first hand, how elementary teachers in Charles City, Iowa are designing and implementing portfolios.
After reviewing published literature and research, a survey instrument was created to answer questions concerning design, implementation, and other elements of …

The Writing Portfolio : An Authentic Assessment Tool, Sondra L. Nelson
The Writing Portfolio : An Authentic Assessment Tool, Sondra L. Nelson
Graduate Research Papers
Using writing portfolios as an ongoing assessment technique in the second grade classroom was a rewarding experience for my students and me. Our collaboration through conferences provided many connections between instruction and assessment. The students even though they represented a range of abilities were able to assess their own work and grow from their own reflections. Their writing abilities emerged and were captured in their portfolios. Authentic assessments were displayed with pride as each of the students shared their portfolios with their parents.

We are creating a nation of alliterates. The vast majority of our population can read and write, but choose not to. The researcher intended to investigate this problem by creating an individualized reading program for a group of fifth grade students. The reading program was designed according to the students· reading levels and interests. The researcher monitored the amount of time the students spent reading for pleasure. Using Interactive Writing With Reluctant Writers, Candis Frieden
Graduate Research Papers
Interactive writing provides an authentic opportunity for children to learn the conventions of writing while constructing meaningful text. As the teacher and children compose a text together, children are active participants in analyzing sounds and constructing words. While writing, children develop strategies for spelling. Interactive writing gives children confidence to use invented spelling which increases children's independence in writing.

Integration Of Technology Into Science Education, Paul Zahner
Integration Of Technology Into Science Education, Paul Zahner
Graduate Research Papers
In this paper, the importance of integrating technology into science education is discussed. The correlation between technology and science is noted and national science standards are examined. The evolution of today's learners requires a change in science education, and technology can serve as a vehicle for meaningful reform. The starting point for any change in science education lies with the teacher, who must adopt new strategies to meet the needs of all types of learners. Various examples of these teaching plans are discussed within this paper. Other important components of the change process include school administration support, especially financial. These …

This study was designed to assess the impact of one full semester of peer- tutoring on 30 fourth and fifth grade at-risk students in a rural Midwestern community. A paired t - test was performed on the students' Grade Point Average (G.P.A . ) before and after tutoring. Statistical analysis of t he data revealed that students who received peer tutoring experienced a statistically significant gain in academic achievement as measured by G. P .A. Research leading to this study indicated that at - risk students do benefit from same gender peer assistance in homework, reading and math skills when …
