Full Faith And Credit And The Equity Conflict, Polly J. Price Jan 1998

Full Faith And Credit And The Equity Conflict, Polly J. Price

Faculty Articles

As this Article relates, the current problem with interstate enforcement of injunctions and other equitable decrees is illustrated by the Court's confusion in Baker. The Court reached the correct result in the case before it, but the basic problems of "equity conflict" remain unresolved. Both the Court's opinion and the two concurrences were unsatisfactory because the Court failed to address the key underlying issue of whether or to what extent courts may rely on state law to enjoin extraterritorial conduct. Had the Court focused on this issue, I argue, it could have based its decision upon a more appealing rationale. …

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde Jan 1998

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde

Faculty Articles

This Article is an attempt to create a preliminary and tentative analysis of the technology of cloning from a Jewish law perspective. Like all preliminary analyses, it is designed not to advance a rule that represents itself as definitive normative Jewish law, but rather an attempt to outline some of the issues in the hope that others will focus on the problems and analysis found in this Article and will sharpen or correct that analysis. Such is the way that Jewish law seeks truth.

In the case of cloning-as with all advances in reproductive technology- the Jewish tradition is betwixt …

Creation Acts, Paul Brian Mccoy Jan 1998

Creation Acts, Paul Brian Mccoy

Theses, Dissertations and Capstones

Her breath leaves her mouth in a cloud and clings to the mirror, fogging it, hiding her face. Her dark eyes are slowly revealed as the glass clears, then her nose, strong and pronounced, and finally her mouth, the full lips pulling into a frown. She might as well be outside, it's so cold. Glancing toward the window, at the huge flakes of snow making their way to the ground below, she sighs. She pulls her jacket tighter around her and reaches for the phone, pausing briefly before picking it up. With gloved fingers she punches the buttons, then drops …

Aboriginal Title And The Division Of Powers: Rethinking Federal And Provincial Jurisdiction, Kent Mcneil

Articles & Book Chapters

The recent decision of the Supreme Court of Canada in Delgamuukw v. British Columbia calls for re-examination of a number of significant Aboriginal rights issues. The crucial role of oral histories in Aboriginal rights litigation was emphasized by the Court, and guidelines were laid down for trial judges to admit and give proper weight to that evidence. For the first time the Court addressed the vital issue of the content of Aboriginal title and provided direction on how that title can be proved. The Court also dealt with the constitutional protection accorded to Aboriginal title by s. 35(1) of the Constitution …

Maskless, Direct Deposition Of Copper Onto Aluminum Bond Pads For Flip Chip Applications, M. Fang, Thomas J. O'Keefe, M. Stroder, W. Shih, Matthew O'Keefe, R. Strawser, D. Via

Materials Science and Engineering Faculty Research & Creative Works

Flip chip interconnection of integrated circuits (IC) for packaging applications such as direct chip attachment use Pb-Sn solders as the connection between the die and the substrate. Under bump metallization is typically used to transition from the non-solderable Al bond pad on the IC to a solderable surface such as copper using traditional blanket metal deposition, photolithography and etching procedures. In this study, we report for the first time the use of a novel process for selectively depositing adherent copper directly onto aluminum thin films, eliminating the need for adhesion promoting transition layers and additional patterning steps. Utilizing copper bearing …

Variables That Discriminate Between Persisting And Nonpersisting, First-Year Undergraduate Students In An Open-Admissions, Multicampus, Commuter College System, Jeffrey David Hines

Dissertations

Problem. Most new undergraduate students begin college with the highest hope of finishing their educational programs. Unfortunately, a large number of students drop out prior to graduation. This is particularly true of nontraditional students who attend nonresidential commuter colleges. This study investigates the differences between nontraditional commuter students who persist through to completion, and those who do not.

Method. A total of 436 Davenport College students, 65 males and 371 females, was surveyed for this study. They were full or part-time, certificate, diploma, or degree-seeking students at one of five Davenport campuses: South Bend and Merrillville, Indiana; Grand Rapids, …

Negotiation And Reorganization Of Peer Relationships During Adolescence: The Emergence Of Romantic Relationships And Quality Of Peer Relationships, Melanie Jo Zimmer-Gembeck Jan 1998

Negotiation And Reorganization Of Peer Relationships During Adolescence: The Emergence Of Romantic Relationships And Quality Of Peer Relationships, Melanie Jo Zimmer-Gembeck

Dissertations and Theses

Research suggests that, for adolescent females, the initiation of romantic relationships is a normative developmental task and a task associated with potential difficulties, including physical aggression. Most previous research treats progress in this task as a function of individual characteristics. This study assumes that when girls are negotiating romantic relationships, they have existing intimate friendships with other females, and these friendships are important to how this task is negotiated.

Females who recently graduated from high school provided retrospective and current information on the amount of leisure time spent with members of their social networks, qualities of relationships in later adolescence, …

The Definition Of Crimes Against Humanity: Resolving The Incoherence, Beth Van Schaack Jan 1998

The Definition Of Crimes Against Humanity: Resolving The Incoherence, Beth Van Schaack

Faculty Publications

This Article discusses the contours of the prohibition of crimes against humanity with reference to proceedings before the International Criminal Tribunal for the Former Yugoslavia (ICTY) and deliberations at the Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court (ICC). Because the contemporary status of this offense under international law cannot be understood or appreciated without reference to its history, this Article traces the evolution of the concept of crimes against humanity with particular reference to the genesis and re-interpretation of the war nexus requirement. A recurrent theme in this narrative is the search for an element …

The Theology And The Function Of The Prayers In The Book Of Daniel, Paul Birch Petersen Jan 1998

The Theology And The Function Of The Prayers In The Book Of Daniel, Paul Birch Petersen

Dissertations

This dissertation investigates the theology and the function of the prayers in the Book of Daniel.

The introduction reviews the scholarly literature in regard to the prayers of the Old Testament in general and the prayers in the Book of Daniel in particular. Recent studies of prayers in the Old Testament have focused on their theological function in their final literary setting. They have also turned their attention to prayer as part of a process of communication, of a divine-human dialogue, and consequently this study is structured from the aspect of interpersonal relationships.

Chapter 1 deals with Daniel and his …

A Description Of General Self-Efficacy And Specific Self-Efficacy For Health Promoting Practices In A Disabled Population, Elizabeth M. Carrington

Masters Theses

This study examined disabled persons' self-efficacy in relationship to performance of health promoting practices. A descriptive research design in which questionnaires were administered by interview was utilized. The sample consisted of forty-four disabled adult individuals attending a vocational rehabilitation school. The General Self-Efficacy Sub-Scale (Sherer, et al, 1982) and the Self-Rated Abilities for Health Practices Scale (Becker, Stuifbergen, Oh & Hall, 1993) were administered.

Major findings related to the three research questions were: (a) this sample's Self-Rated Abilities Scores was higher than previously recorded for a comparable disabled population, (b) multiple disabilities had little impact on self-efficacy scores, (c) a …

Perceived Benefits And Barriers And Mammography Screening Compliance In Women Age 40 And Older, Amy Hoke Vanzee Jan 1998

Perceived Benefits And Barriers And Mammography Screening Compliance In Women Age 40 And Older, Amy Hoke Vanzee

Masters Theses

The mammography screening guidelines have been vague and differ from recommending organization to organization. Thus it is up to women to make decisions about mammography screening based on their personal health beliefs. This study examined the relationship between perceived benefits and perceived barriers to mammography and compliance with mammography screening guidelines in women age 40 and older. A correlational design was used with a convenience sample of 84 women from two outpatient family practice offices in the suburbs of a mid-western city. The Breast Cancer Screening Behaviors questionnaire created by Victoria Champion in 1995 was used to measure perceived benefits …

The purpose of this descriptive study was to examine which nurse caring behaviors HIV/AIDS patient's perceived as most important. Subjects were recruited from an HIV/AIDS clinic in a large Midwestern city. Twenty-three subjects completed Cronin and Harrison (1988) Caring Behaviors Assessment (CBA) along with a patient demographic questionnaire and an open ended question asking, "Is there anything else a nurse could do to make you feel care for or about? If so what?".

Results of this study suggest that HIV/AIDS patients perceive expressive nurse caring behaviors, such as, listening to the patient, treating the patient with respect, and knowing when …

Masters Theses

The purpose of this study was to evaluate the effectiveness of a cardiac home care program in promoting self-care through supportive-educative nursing. Orem's self-care model served as the conceptual model for this study. Self-care was measured in this study by evaluating the patient's level of cardiac knowledge and functional ability.

This study was conducted at a home care agency in Midwest Michigan. A convenience sample of seven was obtained from patients admitted to a cardiac home care program following coronary artery bypass grafting surgery (CABO).

A descriptive design with a one group paired t-test was used to analyze the differences …

Republican Legal Systems, Mortimer N.S. Sellers Jan 1998

Republican Legal Systems, Mortimer N.S. Sellers

Book Chapters

This paper discusses the basic attributes of republican legal systems. I will suggest that republican principles provide the only sound basis for a just legal order, and conclude that all laws in all jurisdictions deserve public deference only to the extent that they reflect republican structures of government and legislation.
