Desert, Utility, And Minimum Contacts: Toward A Mixed Theory Of Personal Jurisdiction, Kevin C. Mcmunigal
Desert, Utility, And Minimum Contacts: Toward A Mixed Theory Of Personal Jurisdiction, Kevin C. Mcmunigal
Faculty Publications
In this Essay, I suggest several steps to improve the Supreme Court's approach to minimum contacts analysis. Though they necessitate some modification of current doctrine, these steps require neither radical alteration of the test's current factors nor abandonment of any of its purposes. I propose a new way of looking at the Court's minimum contacts analysis that better explains and integrates the factors, temporal perspectives, and purposes that presently figure in the analysis. My approach draws on criminal law, analogizing a state's imposition of the burdens of jurisdiction to its imposition of a criminal sanction. It sees the minimum contacts …

Johnny Carson School of Theatre and Film: Faculty Publications and Creative Activity
Adolf Hitler and his National Socialist German Workers' Party were obsessed with keeping the German theatre tradition vital and maintaining Berlin as a "cultural metropolis" after Hitler's appointment as Reich Chancellor on 30 January 1933. Upholding a dynamic and energetic cultural life for the nation was a task for which National Socialism, as a political movement embodying the "will of the people," felt itself eminently well qualified. The Nazis, therefore, began almost as soon as they took over the reins of government in Germany to support theatre as an art form and theatres as institutions to an extent unprecedented in …

Re-Defining Tradition: Handweavers To The World, Seema Chandna
Re-Defining Tradition: Handweavers To The World, Seema Chandna
Textile Society of America: Symposium Proceedings
It is my ongoing attraction for, and love of, Indian textiles that brought me back to my country of birth after spending several years, studying and working, in New York. This paper deals with my research, experience and observations, over the last year, working closely with the hand-weaving industry in India.
At my design studio, in Bangalore, I have a multi-treadle handloom and have employed a local hand-weaver. We create the designs and make sample swatches at the studio. For production of yardage, based on our swatches, we work with various weaving centers, located in different Southern Indian villages. Depending …

Textile Society of America: Symposium Proceedings
Since the early 1970s I have been interested in the construction of imagery in textiles and how the imagery that is an essential part of the structure can be altered through painting, dyeing, and finishing processes. My early pieces used a simple distortion of the vertical horizontal threads to create undulating parallel lines that defined what I called the "fabric landscape", a piece of fabric laid over a relief surface. In 1974-5 I applied photographs directly to the surface of my woven structures, sensitizing the cotton cords with photosensitive chemicals and processing the whole weaving as one would a photograph. …

A tallit is a rectangular piece of fabric with fringes (tzizit) at the four corners. Until fairly recently, it was worn as a prayer shawl exclusively by observant Jewish males over the age of thirteen. In Ashkenazic lands, primarily Germany and Poland, a limited range of materials was used to make a tallit. It was made of wool or silk, and was white or off-white with a black stripe. The center of one long side of the tallit was often distinguished by some form of decoration. This decorated area would be worn at the neck, functioning …

What precisely is one asserting when one claims to be Latina/o? A political identity, an experiential identity, or both? Is the Latina/o identity racial, or ethnic, or cultural? Is it even ideologically or ontologically manageable? My father happens to be an African Cubano. My mother is Jamaican. I was born and raised in England. Am I a Latino? Or am I finally "just Black"? But you may be asking, why be binary? Identity is never an either/or proposition. Perhaps I am a "Black Latino." If so, doesn't the "Black" preceding "Latino" signify some lesser claim to Latino identity (I've never …
General Principles And International Uniform Commercial Law Conventions: A Study Of The 1980 Vienna Sales Convention And The 1988 Unidroit Conventions On International Factoring And Leasing, Franco Ferrari
Faculty Articles
Among the most important conventions on uniform commercial law in force are the 1980 United Nations Convention on Contracts for the International Sale of Goods and the two 1988 Ottawa Conventions: International Factoring and International Financial Leasing. The CISG assumes importance due to its great success. This is evidenced by the number of contracting States and by the attention it has drawn from scholars and judges alike. The Ottawa Conventions are also of notable importance, as they constitute the most recent uniform commercial law conventions to come into force. This article examines the relationship between the general principles and these …
Assimilationist Bias In Equal Protection: The Visibility Presumption And The Case Of "Don't Ask, Don't Tell", Kenji Yoshino
Assimilationist Bias In Equal Protection: The Visibility Presumption And The Case Of "Don't Ask, Don't Tell", Kenji Yoshino
Faculty Articles
Under current equal protection doctrine, the courts are more likely to accord heightened scrutiny to a classification if its defining trait is immutable or visible. This means that groups that can assimilate into mainstream society by changing or altering their defining trait are less likely to benefit from judicial solicitude. By withholding protection from these groups, the judiciary is subtly encouraging them to assimilate when faced with burdensome legislation. This Article critiques that assimilationist bias by demonstrating that the immutability and visibility factors cannot be justified on either substantive or processual theories of judicial review. Because the immutability factor has …
