Regulating Cyberspace: Metaphor, Rhetoric, Reality, And The Framing Of Legal Options, Clay Calvert

UC Law SF Communications and Entertainment Journal

This Article argues that the "information superhighway" metaphor is a strategically chosen rhetorical device used to frame debate about Internet and telecommunications regulation, to implicitly suggest the particular legal choices are more viable-and valid-than others, and to guide the future of law in cyberspace. In particular, the metaphor embraces a commerce-based, marketplace model of regulation that emphasizes speed and quantity of information as a product or good rather than the content or quality of communication and its ability to sustain extant communities and cultures. This article explores how African-American music artists, as a group, were routinely deprived of legal protection for creative works under the copyright regime. The issue of copyright deprivation and Black artists is highly significant, given the enormous cultural contribution of Black music to American society, the importance of the music to Black culture, and the tremendous economic benefits at stake. As new issues develop in copyright law, it will be important to people of color, and to an egalitarian society as a whole, that the new copyright regime not duplicate the inequalities of the old. The mass media abound with tales of fundamental change in the world of classical music. A New York Times article on the crisis in the classical compact disc (CD) industry reports that, after a transient rise in sales during the 1980s, classical CDs' market share dropped to an all-time low of 2.9 percent. There are also frequent reports of funding woes that have reduced and, in some instances, put an end to entire orchestras. Often students disassociate courses which are in their core university requirements- such as writing- from the courses they take for their major. The purpose of this study is to examine contemporary cultural meanings of female childlessness and come to understand these meanings in relation to historical meanings of childlessness. The contemporary shifts in the meaning of childlessness reflect America's struggle with women's changing social roles, particularly since the mid-1960s. As more women are stepping outside of the domestic sphere and forging new nondomestic pathways, the meaning of childlessness is undergoing changes and reflects our culture's ambiguity about women's new roles.

In this Article, Professor Coombs argues that the debate about same-sex marriage has wrongfully ignored transgendered people and their relationships. She provides an overview of arguments made by opponents of same-sex marriage, such as tradition, procreation, child-rearing, and family values. She then examines cases involving transsexual marriages and uses this analysis to deconstruct the same-sex marriage debate. Professor Coombs argues that an honest consideration of transgendered people and their relationships forces a re-evaluation of arguments against same-sex marriage and disrupts the gendered patriarchy on which traditional marriage rests. Collins' Fighting Words builds on her previous work, Black Feminist Thought, as she explores standpoint theory and "the outsider within" position and their usefulness for Black feminist thought. She structures her analysis by critiquing its effectiveness as critical social theory. For Collins, "Critical social theory constitutes theorizing about the social in defense of economic and social justice." Because African American women and other oppressed groups seek economic and social justice, she posits that their social theories may generate new perspectives on injustice.

This study explores intercultural romantic couples and their interactive construction of relational culture. Qualitative methods of inquiry appeared most useful for identifying the processes involved in the social construction of intimates' shared reality and, so, both Conversation Analysis and Joint Interviews were utilized. Five romantic couples whose partners were socilaized within different cultural communities participated in the study. Findings of this study suggest that intercultural romantic couples import cultural resources from their individual cultures into their joint relational culture. These cultural resources included foods, traditions, language, and values. Findings of ths study also suggest that two types of communicative episodes, …

Chapter I briefly discusses the development the AIDS Quilt, demonstrates the importance of the AIDS Quilt as a form of communication, provides an overview of the major academic works on the AIDS Quilt, and describes the methodology to be employed in this study. Chapter II discusses the history of quilting as a form of social culture and the history of the quilt as a form of activism. Methanol Promotes Atmospheric Methane Oxidation By Methanotrophic Cultures And Soils?, J. Benstead, G. M. King, H. G. Williams

Two methanotrophic bacteria, Methylobacter albus BG8 and Methylosinus trichosporium OB3b, oxidized atmospheric methane during batch growth on methanol. Methane consumption was rapidly and substantially diminished (95% over 9 days) when washed cell suspensions were incubated without methanol in the presence of atmospheric methane (1.7 ppm). Methanotrophic activity was stimulated after methanol (10 mM) but not methane (1,000 ppm) addition. M. albus BG8 grown in continuous culture for 80 days with methanol retained the ability to oxidize atmospheric methane and oxidized methane in a chemostat air supply. Methane oxidation during growth on methanol was not affected by methane deprivation. Differences in …

The most important inorganic nitrogen transformations (nitrification, denitrification and N fixation) and DIN fluxes in darkened and inundated sediments were studied during the dry season in the Ao Nam Bor mangrove forest at the island of Phuket, Thailand. Dark fluxes of NH4+ were low (not significantly different from zero) and tended to be directed into the sediment in the area vegetated by the tree Rhizophora apiculata (204 μmol m-2 d-1) and out of the sediment in an adjacent unvegetated area (80 μmol m-2 d-1), NO3- appeared to be taken up by the sediment in both areas, although at rates not …

There is a common perception that elements of mainstream society are disrespectful of Aboriginal culture. This article argues that developments in the law offer promise for the protection of Aboriginal "intellectual products," manifestations of Aboriginal culture reflecting their world-view. What Aboriginal peoples would like to see protected, however, are not so much words, pictures, or acts but rather the values, beliefs, and principles that give these meaning. Such, the author argues, are best protected by mechanisms internal to Aboriginal communities. Furthermore, the lack of such mechanisms would not justify the intrusion of Canadian law, but rather raises a call within …

A large number of studies have attempted to identify factors that are correlated with exporting success. However, much controversy exists about the key determinants of export performance and their relative importance. A major reason for this lack of consensus is the absence of a unified measure for capturing export performance. In this study, an attempt is made to develop a generalized export performance measure, the EXPERF scale, that can be applied to multiple countries. Results from a survey of top executives of U.S. and Japanese exporters support a three-dimensional scale for measuring export performance. The three dimensions of the export …
