A Comment On The 1996 United Kingdom Arbitration Act, Thomas E. Carbonneau Jan 1998

A Comment On The 1996 United Kingdom Arbitration Act, Thomas E. Carbonneau

Faculty Scholarship

The 1996 United Kingdom Arbitration Act is a remarkable piece of legislation. It is a highly accessible statutory framework both from a linguistic and organizational standpoint. The 1996 Act represents a substantial improvement over prior English arbitration statutes, including the 1979 Act. The new legislation is comprehensive, thorough, cogent and coherent. In its presentation and content, it easily rivals both longstanding and recentlegislative enactments on arbitration. It is built upon a wealth of knowledge and expertise of arbitration law and practice, and embodies a very contemporary and integrated concept of arbitration. This commentary endeavors to highlight and appraise the most significant …

Development And Saw Device Implementation Of A New Weighted Stepped Chirp Code Signal For Direct Sequence Spread Spectrum Communications Systems, Scott Edward Carter Jan 1998

Development And Saw Device Implementation Of A New Weighted Stepped Chirp Code Signal For Direct Sequence Spread Spectrum Communications Systems, Scott Edward Carter

Retrospective Theses and Dissertations

This work introduces the new weighted stepped chirp code signal for direct sequence spread spectrum (DS/SS) communications systems. This code signal uses the truncated cosine series functions as the chip functions. This code signal is the result of discretizing a continuous wave (CW) chirp which results in enhanced performance versus a pseudonoise (PN) code and equivalent performance and easier implementation than a CW chirp. This code signal will be shown to possess improved compression ratio (CR), peak sidelobe level (PSL), integrated sidelobe level (ISL), and bit error rate (BER) when compared to a PN code of identical code length and …

1998 Highway Cost Allocation Update: Technical Report, Samantha S. Jones, Jerry G. Pigman

Kentucky Transportation Center Research Report

This update of the highway cost allocation study is the eighth in a recent series begun in the early 1980's by the Kentucky Transportation Cabinet and the Kentucky Transportation Center. The primary objectives were to determine the level of revenue contribution and cost responsibility for each class of highway user. The base year of the study is FY 97; the most recent time period for which revenue and cost data were available. Highway user or travel activity for calender year 1996 was the most recent available. A basic premise of the study was that only state maintained highways were of …

Analysis Of Rochester Institute Of Technology's United Way Campaign, Cheryl Lund Jan 1998

Analysis Of Rochester Institute Of Technology's United Way Campaign, Cheryl Lund

Theses

The United Way is an organization that exists for the purpose of helping people in need and bringing about positive social outcomes for the public good. Raising sufficient funds through donations continues to be a challenge in the face of decreasing public assistance, and increased cynicism in the United Way caused by the United Way scandal of 1992. The general downward trend of donations to non-profit organizations is reflected in the donations to the Rochester Institute of Technology's United Way campaign. In the past, employee participation in RIT's United Way campaign was 73%, which has been decreasing throughout the years …

Design Characteristics Unique To The Flexographic Printing Process, Barry Lee Jan 1998

Design Characteristics Unique To The Flexographic Printing Process, Barry Lee

Theses

The flexographic printing process has been used for package printing applications since the late 1800's. Recent improvements in the flexographic technology have enabled flexographic printers to compete in new market areas that have historically been served by roto-gravure or offset lithographic printing. Occurring simultaneously with the flexographic printing improvements has been the infusion of personal computer-based graphic design capabilities. Designers can optimize quality only when they understand the strengths and weaknesses of the printing process that will be used to mass produce their design. Desktop design capabilities and the need for flexographic print quality to match or exceed lithographic and …

Clint Eastwood And Equity: Popular Culture's Theory Of Revenge, William I. Miller Jan 1998

Clint Eastwood And Equity: Popular Culture's Theory Of Revenge, William I. Miller

Book Chapters

Revenge is not a publicly admissible motive for individual action. Church, state, and reason all line up against it. Officially revenge is thus sinful to the theologian, illegal to the prince, and irrational to the economist (it defies the rule of sunk costs). Order and peace depend upon its extirpation; salvation and rational political and economic arrangements on its denial. The official antivengeance discourse has a long history even preceding the Stoics, taken up and elaborated by medieval churchmen and later by the architects of state building.

U.S. Notice 98-11 And The Logic Of Subpart F: A Comparative Perspective, Reuven S. Avi-Yonah Jan 1998

U.S. Notice 98-11 And The Logic Of Subpart F: A Comparative Perspective, Reuven S. Avi-Yonah

Articles

In this report, Reuven S. Avi-Yonah argues that the dichotomy between active and passive income that underlies subpart F and Notice 98-11 is obsolete, and should be replaced with an explicit link to source tax rates, as most of our trading partners do in similar legislation.
