Rights Against Rules: The Moral Structure Of American Constitutional Law, Matthew D. Adler Oct 1998

Rights Against Rules: The Moral Structure Of American Constitutional Law, Matthew D. Adler

Michigan Law Review

The Bill of Rights, by means of open-ended terms such as "freedom of speech," "equal protection," or "due process," refers to moral criteria, which take on constitutional status by virtue of being thus referenced. We can disagree about whether the proper methodology for judicial application of these criteria is originalist or nonoriginalist. The originalist looks, not to the true content of the moral criteria named by the Constitution, but to the framers' beliefs about that content; the nonoriginalist tries to determine what the criteria truly require, and ignores or gives less weight to the framers' views. Bracketing this disagreement, however, …

A Black Party? Timmons, Black Backlash And The Endangered Two-Party Paradigm, Terry Smith Oct 1998

A Black Party? Timmons, Black Backlash And The Endangered Two-Party Paradigm, Terry Smith

Duke Law Journal

In a pair of 1997 electoral decisions, the Supreme Court decided that Minnesota could prohibit fusion candidacies in the interest of maintaining a strong two-party system, but that Georgia could not create two new majority-minority congressional districts because the redistricting process had been impermissibly infected by race. In this Article, Professor Smith argues that these two decisions unavoidably conflict. While the fusion case reaffirmed the states' interest in maintaining a strong two-party system, the racial gerrymandering case severely undercut the states' ability to achieve this interest in jurisdictions where the major parties are racially stratified. He demonstrates that blacks operating …

Here is a uniquely valuable work, practical and direct, written in plain English by a mature scholar who wears his immense learning lightly. The "difficult moral questions" it treats are two hundred in number, each with an Analysis and a Reply. (And there are two narrative Appendices.)

Cohomology Of Polynomials Under An Irrational Rotation, Lawrence W. Baggett, Herbert A. Medina, Kathy D. Merrill

Mathematics, Statistics and Data Science Faculty Works

A new description of cohomology of functions under an irrational rotation is given in terms of symmetry properties of the functions on subintervals of [0, 1]. This description yields a method for passing information about the cohomology classes for a given irrational to the cohomology classes for an equivalent irrational.

Depression In Mexican American Adolescence And Its Relations To Ethnic Identity And Self Esteem, Deborah Cohen Woloski

Theses and Dissertations - UTB/UTPA

This study investigated incidence of depressive symptomatology, clinical depression, and suicidal ideation in a high school sample of 1751 Mexican-American adolescents. Results indicate that Mexican-American adolescents are at increased risk for depressive symptomatology and suicidal ideation. Investigating The Effects Of Subtle Ratee Characteristics In Team Performance Appraisal: The Influence Of Personality And Cohesiveness, Jonathan Quinn Schroeder Oct 1998

Investigating The Effects Of Subtle Ratee Characteristics In Team Performance Appraisal: The Influence Of Personality And Cohesiveness, Jonathan Quinn Schroeder

Psychology Theses & Dissertations

This study extends the research into systematic bias in performance appraisal to include subtle (i.e., not overtly demographic) ratee characteristics. Specifically examined were the biasing effects of personality and group cohesiveness on performance ratings. It was hypothesized that raters' personality inferences regarding ratees' levels of agreeableness and conscientiousness would correlate with bias in performance ratings. Interpersonal group cohesiveness was also hypothesized to affect rating accuracy. Research participants (n = 90) rated the performance of two videotaped leaderless group discussions. Personality inferences correlated strongly with leniency in performance ratings. In addition, significant differences in accuracy were found between the more and …

The Rhetoric Of Neutrality And The Philosophers’ Brief: A Critique Of The Amicus Brief Of Six Moral Philosophers In Washington V. Glucksberg And Vacco V. Quill, Richard Church

Law and Contemporary Problems

Church discusses the amicus brief to the US Supreme Court in the companion assisted suicide cases of "Washington v. Glucksberg" and "Vacco v. Quill," in which six philosophers offer their views. The philosophers' charge--that prohibiting physician-assisted suicide can only be based on impermissible sectarian religious or ethical premises--can be raised against their "neutral" liberal argument itself.

Would Adr Have Saved Romeo And Juliet?, Pam Marshall

Osgoode Hall Law Journal

Like many disputes, Romeo and Juliet is a story with no winners; the outcome is destined to be lose-lose. Disputes are an inevitable part of human interaction and people need to learn effective and reasonable ways of dealing with their disputes. The question is how can this be done in a way that leaves people intact. The article compares and contrasts two modes for resolving disputes: adjudication and alternative dispute resolution (ADR). The article looks at what happens when disputes arise-how do problems become "disputes" and what do people do about them? The role of lawyers as dispute creators as …
