Professional Responsibility: 1998 Survey Of Florida Law, Timothy P. Chinaris, Elizabeth Clark Tarbert

Law Faculty Scholarship

Continuing a trend, 1998 included a number of important developments in the area of professional responsibility law in Florida. Significant appellate court decisions, rule changes, and disciplinary actions potentially affect the practices of more than 58,000 members of The Florida Bar. This article reports and summarizes those developments by placing them in the framework of the various relationships in which lawyers typically operate. Part II looks at decisions affecting what must be viewed as the central relationship in this context: the relationship between lawyer and client. The Origins And Destinations Of Nebraska Migrants, Lisa Darlington, Matt England Oct 1998

The Origins And Destinations Of Nebraska Migrants, Lisa Darlington, Matt England

Business in Nebraska

Migrants to Nebraska tend to come from the Midwest region of the United States. Likewise, migrants from the state tend to move to other states in the region (Figure 1). Six neighboring states combined to exert the greatest influence on both the inflow and outflow of Nebraska migrants. At the same time, states offering natural amenities were magnets for Nebraskans on the move.

Data used in this report come from the Federal and State Cooperative Program for Population Estimates (FSCPE) for 1995. FSCPE used the number of exemptions listed on individual tax returns to estimate the migration flows. In order …

Geotextile Feeding/Traffic Surfaces And Costs, Larry W. Turner Oct 1998

Geotextile Feeding/Traffic Surfaces And Costs, Larry W. Turner

Agricultural Engineering Extension Updates

Mud robs Kentucky beef and dairy producers of performance from their cattle herds in winter and spring conditions. To help avoid the problems associated with mud and reduced performance, concrete pads or lower-cost all-weather surfaces should be used wherever animals congregate--- feeding areas, animal traffic areas and loafing areas. Although concrete is probably the most desirable surface for durability and low maintenance, an all-weather surface can be constructed of geotextile fabric, rock and fine surface cover for less than 1/3 of the cost of concrete. Rock over bare soil in Kentucky requires approximately 12" of depth for stability. In contrast, …

Of Communists And Anti-Abortion Protestors: The Consequences Of Falling Into The Theoretical Abyss, Christina E. Wells

Faculty Publications

Part I of this article briefly reviews the legal and social context of Dennis and Yates. Parts II and III similarly review Madsen and Schenck in order to show potential parallels to the earlier communist decisions. Part IV further examines both Madsen and Schenck, demonstrating that, from a doctrinal standpoint, they are far removed from the earlier communist cases. Finally, Part V explains how the Court in Madsen and Schenck actually contributed to misconceptions or manipulation of its opinions. Specifically, Part V examines the Madsen and Schenck Courts' approaches to three of the more difficult doctrinal issues facing them--prior restraint, …

Proposed Ninth Circuit Split: Response. Malthus And The Court Of Appeals: Another Former Clerk Looks At The Proposed Ninth Circuit Split, Aaron H. Caplan

Washington Law Review

This Article argues that current proposals to split the Ninth Circuit are unnecessary and would be detrimental to judges, law clerks, lawyers, and litigants. Larger circuits offer various benefits, many of them arising from the diversity of cases and judicial personalities on the bench. Splitting the Ninth Circuit would not bring the benefits proponents predict.

Using Pre-Instruction Questionnaires To Improve The Small Group Writing Class, Bryan Bardine Oct 1998

Using Pre-Instruction Questionnaires To Improve The Small Group Writing Class, Bryan Bardine

English Faculty Publications

A pre-instruction questionnaire was used with two small group writing classes at Goodwill Industries of the Miami Valley, Inc. (Ohio). The questionnaire was designed to provide as much information as possible about the students' knowledge and background in writing. The survey had four purposes: determine what kinds of writing students currently did or had done in the past, identify what types of writing interested the students, get each student's view of his/her writing, and determine whether students had thought about what personal goals they wanted to achieve by completing the course. Five categories of questions were included. The first set …
