This paper provides a vision of how accommodating such high growth may affect one rural residential area of the county, La Pine North. It will first draw a profile of La Pine North as it exists currently. Then, two possible futures for that space and its residents will be depicted. These futures represent the minimal and the most radical responses to the present and intensifying problem of nitrate/nitrogen pollution of ground water in the area. There has been a considerable renaissance in retributivism as a theory of the justification of punishment in the second half of this century. Retributivism is often defended as if it were a particularly hardy moral intuition, a basic free-standing moral principle that is underivable from any broader theory or set of principles. In this vein it is often "supported" through the presentation of outrageous and horribly cruel crimes, especially against persons, particularly murder, in order to elicit what may be thought to be the natural and appropriate emotional response, a response of anger, indignation, and desire for retribution. The process of European union has evolved from one based on economics alone to one concerned with keeping peace and the rights of individual citizens. This past year, the Member States of the European Union agreed upon the provisions of a new treaty that recognizes that the continued viability of the Union also depends on its people, not merely on its laws and institutions. The Treaty of Amsterdam focuses on the protection of fundamental human rights within the Union. The Federal Coal Leasing Amendments Act of 1976 requires that Federal coal lands to be considered for leasing must be identified in a comprehensive land use plan. At the time the Great Divide Resource Management Plan (GDRA RMP, 1990) was prepared, approximately 60% of the Federal coal lands in the Carbon Basin Coal Area were leased and exempt from the coal screening/planning process. Subsequently, development of this lease was never pursued and the lease expired. Stable isotope analysis of teeth of marine mammals can provide valuable information on trophic level and source of feeding. However, the isotopic analysis of whole teeth presents only an average dietary estimate for individuals across the period of growth of that tooth. While such analyses can be valuable, particularly in the case of fossil material, in contrast, isotopic analysis of individual annuli of teeth can provide dietary information for each year of tooth growth, in some cases representing the whole of the animal's life. An intrathermocline lens with strong anticyclonic circulation and cold surface temperature anomaly (–1°C) is reported in the Iceland Basin at 59.1N 20W. The lens is 1000 m thick, 120 km wide and centered on the 27.45 σ0 isopycnal at 700 m. Its influence, through distortion of density surfaces, is felt throughout the 2800 m water column. At the surface this leads to a shallower mixed layer within the eddy which will have an impact on the local planktonic ecology. At a depth of 700 m and a radius of 40 km the eddy circulation has an azimuthal velocity of …

Fence-in laws in most states require ranchers to pay for fences to keep their livestock from trespassing onto others' property. Some states, or jurisdictions within states, have a fence-out rule that requires ranchers' neighbors to pay for fences to keep livestock out. Both rules are Pareto optimal. Using a potential Pareto criterion, we show that a preference for fence-out in some areas may end as conditions change, such as increased nonranching land uses. Changed conditions may have legal consequences. Specific fence-out and fence cost-sharing provisions may be potentially Pareto inefficient and may be challenged for being unconstitutional under the due …

Prior to the drafting of Article 2B of the Uniform Commercial Code ("U.C.C."), courts applied Article 2: Sales, by analogy, to transactions that involved licensing of software agreements. The courts used the "predominant feature test" to reach these decisions. This resulted in varying decisions among the states which is contrary to the need for uniformity within the software industry. This comment proposes adopting an internationally recognized standard of due diligence in reporting lost or stolen artworks utilizing the Internet. To insure that the proposed standard of due diligence is acceptable internationally, this Comment proposes the creation of a readily accessible database in which the theft of artworks is tracked utilizing the Internet. First this Comment briefly discusses the history of stolen artworks. Second, this Comment discusses the various legal standards the courts use in analyzing stolen art cases: statute of limitations, due diligence and adverse possession.
