Qualified Immunity: Ignorance Excused, Barbara E. Armacost

Vanderbilt Law Review

Public officials receive qualified immunity from damages liability for constitutional violations if they reasonably could have believed their actions were constitutional under clearly established law. In this regard qualified immunity is quite unusual. In most other legal contexts, failure to know the law is virtually never excused. The only other context where notice or knowledge of illegality plays any role is in criminal law, but even mistakes of penal law are rarely excused.

In this Article, Professor Armacost uses fair notice in criminal law as a paradigm for analyzing the role of notice in constitutional damages actions. She argues that …

The intranuclear assembly of herpesvirus subviral particles remains an incompletely understood process. Previous studies have described the nuclear localization of capsid and tegument proteins as well as intranuclear tegumentation of capsid-like particles. The temporally and spatially regulated replication of viral DNA suggests that assembly may also be regulated by compartmentalization of structural proteins. We have investigated the intranuclear location of several structural and nonstructural proteins of human cytomegalovirus (HCMV). Tegument components including pp65 (ppUL83) and ppUL69 and capsid components including the major capsid protein (pUL86) and the small capsid protein (pUL48/49) were retained within the nuclear matrix (NM), whereas the …

Very little literature regarding troubled families is available for the Vietnamese Christians in the United States to use. This project is written to review the biblical principles, the cross-cultural perspectives, and the practical methods to contributing to the Vietnamese pastors' work for reducing family troubles in this country. It presents a brief background of Vietnam geography and history with the reasons for the Vietnamese presence in the United States. The Relationship Between Nectar Sources And Regal Fritillary (Speyeria Idalia Drury) Butterfly Populations., Jeffrey J. Huebschman

I investigated the relationship between nectar source diversity and regal fritillary (Speyeria idalia Drury) butterfly populations at ten native tallgrass prairie sites in eastern Nebraska. Walking-transect surveys were used to establish regal fritillary population-density indices in 1996 and 1997. Flowering-plant surveys were also conducted, coincident with the butterfly surveys, and were used to develop blossom-density, and abundance indices. Spearman rank correlation was used to examine relationships between regal fritillary density indices and plant survey variables. This analysis of Breaking the Waves falls into two sections: 1) the 'good'; and 2) transgressing goodness. The focus is Bess, her status as woman in a patriarchal culture and her struggle to be 'good'. The reading that I propose explores von Trier's meditation on competing notions of goodness and the cultural assumptions that inform them. In the first section, I explore how Bess negotiates the moral landscape within which she lives as daughter, sister-in-law, member of a religious community, and wife. By the early 20th century, the changes taking place in western industrial capitalist nations prompted an adaptive shift in the socioeconomic delineation of human bodies, and in scientific theories about how they worked and how they could be put to work. Just as the rising social sciences borrowed from medicine to convey images of social malaise, medicine increasingly appropriated an industrial vocabulary to conceptualize bodily health. Depicted variously as a machine, a motor, a factory in itself, the human body absorbed industrial symbolism. My goal in this project is to examine the Kukyekukyeku bamboo orchestra of Mosomagor, the meaning and importance of this orchestra to the socio-economic life of the Mosomagor community and note the socio-economic changes that the people are experiencing. The project I have completed consist of two elements. First of all, I traced a slave route from Salaga to Cape Coast. While following this route, I stopped in town's which were historically slave markets in an effort to interview members of the community about the current effects of the slavery. Secondly, I attempted to walk from Atebubu to Cape Coast in order to have a concrete comprehension for the distance covered by those who were forced to walk the distance before me, in addition to having a better understanding of Ghana.

The purpose of this paper is to investigate the role of Adowa as a vehicle to express ethnic identity in Asante society. First, background information regarding African music is presented, bringing to light the concept of African music as an integrated, 'total art' and highlighting the distinction between traditional and contemporary African music. The Community-Based Management Of Fisheries In Atlantic Canada: A Legislative Proposal, Raymond Maccallum

Dalhousie Law Journal

The crises in Canada's fisheries demonstrate the failure of Canadian fisheries management practices to achieve their public policy objectives. The author proposes that a new fisheries management regime, based on principles of community-based management, should be implemented to better ensure the sustainability of both the fisheries and fishing communities. A draft bill is provided to establish a specific framework around which to discuss those values and interests that should be promoted and protected by legislation, and how legislation can be used to establish and nurture a new community-based management regime.
