The Commerce Clause Meets The Delhi Sands Flower-Loving Fly, John Copeland Nagle Oct 1998

The Commerce Clause Meets The Delhi Sands Flower-Loving Fly, John Copeland Nagle

Michigan Law Review

The protagonist in our story has six legs, is one inch long, and dies two weeks after it emerges from the ground. To the untrained eye, the Delhi Sands Flower-Loving Fly looks like, well, a big fly. Entomologists know better. This particular fly can hover like a hummingbird as it uses its long tubular nose to extract nectar from flowers. It can only live in particular fine soils - the Delhi sands - that appear in patches over a forty square mile stretch from Colton to Ontario, California. Today only a few hundred Delhi Sands Flower-Loving Flies survive in less …

Rights Against Rules: The Moral Structure Of American Constitutional Law, Matthew D. Adler Oct 1998

Rights Against Rules: The Moral Structure Of American Constitutional Law, Matthew D. Adler

Michigan Law Review

The Bill of Rights, by means of open-ended terms such as "freedom of speech," "equal protection," or "due process," refers to moral criteria, which take on constitutional status by virtue of being thus referenced. We can disagree about whether the proper methodology for judicial application of these criteria is originalist or nonoriginalist. The originalist looks, not to the true content of the moral criteria named by the Constitution, but to the framers' beliefs about that content; the nonoriginalist tries to determine what the criteria truly require, and ignores or gives less weight to the framers' views. Bracketing this disagreement, however, …

The Way of the Lord Jesus, Vol. 3: Difficult Moral Questions. By Germain Grisez. Franciscan Press (217-228-5670). 927 pages. $35.

Here is a uniquely valuable work, practical and direct, written in plain English by a mature scholar who wears his immense learning lightly. The "difficult moral questions" it treats are two hundred in number, each with an Analysis and a Reply. (And there are two narrative Appendices.)

A Protein Encoded By The Latency-Related Gene Of Bovine Herpesvirus 1 Is Expressed In Trigeminal Ganglionic Neurons Of Latently Infected Cattle And Interacts With Cyclin-Dependent Kinase 2 During Productive Infection, Yunquan Jiang, Ashfaque Hossain, Mariah Teresa Winkler, Todd Holt, Alan R. Doster, Clinton J. Jones

School of Veterinary and Biomedical Sciences: Faculty Publications

Despite productive viral gene expression in the peripheral nervous system during acute infection, the bovine herpesvirus 1 (BHV-1) infection cycle is blocked in sensory ganglionic neurons and consequently latency is established. The only abundant viral transcript expressed during latency is the latency-related (LR) RNA. LR gene products inhibit S-phase entry, and binding of the LR protein (LRP) to cyclin A was hypothesized to block cell cycle progression. This study demonstrates LRP is a nuclear protein which is expressed in neurons of latently infected cattle. Affinity chromatography indicated that LRP interacts with cyclin-dependent kinase 2 (cdk2)-cyclin complexes or cdc2-cyclin complexes in …

Would Adr Have Saved Romeo And Juliet?, Pam Marshall Oct 1998

Would Adr Have Saved Romeo And Juliet?, Pam Marshall

Osgoode Hall Law Journal

Like many disputes, Romeo and Juliet is a story with no winners; the outcome is destined to be lose-lose. Disputes are an inevitable part of human interaction and people need to learn effective and reasonable ways of dealing with their disputes. The question is how can this be done in a way that leaves people intact. The article compares and contrasts two modes for resolving disputes: adjudication and alternative dispute resolution (ADR). The article looks at what happens when disputes arise-how do problems become "disputes" and what do people do about them? The role of lawyers as dispute creators as …

A Study In The Spirituality Of Louise De Marillac: As Reflective Of The French School Of Spirituality, Kathryn Lafleur S.P.

Vincentian Studies

This detailed article gives extensive information on the French school of spirituality, especially its major influences and characteristics. Pierre de Berulle was one of its founders, and great attention is paid to his background, his spiritual doctrine, the principles of his spirituality and the way his successors developed them further, and the language used within the school. The school was known for being “theocentric and Trinitarian, Christocentric, Marian, pastoral, and ecclesial.” Important figures of the French school profiled in this article are Jean-Jacques Olier, Jean Eudes, Francis de Sales, and Vincent de Paul. Finally, Louise de Marillac is placed within …

The Endangered Species Act And Private Property: A Matter Of Timing And Location, J.B. Ruhl Oct 1998

The Endangered Species Act And Private Property: A Matter Of Timing And Location, J.B. Ruhl

Vanderbilt Law School Faculty Publications

For all the controversy surrounding the effect of the Endangered Species Act ("ESA") on private property, precious little information has accompanied the heated calls for strengthening or weakening the law's land use proscriptions. Preservationist groups and property rights groups alike depend on staking out higher moral ground and producing "poster child" stories of imperiled species or property owners. The Fish and Wildlife Service ("FWS"), which implements the ESA for most of the listed endangered and threatened species, has compiled reams of data on its administrative functions' in support of its recent efforts through administrative (in lieu of legislative) reform to …
