Default Rules In Contract Law As Response To Status Competition In Negotiation, Stephen M. Mcjohn Jan 1997

Default Rules In Contract Law As Response To Status Competition In Negotiation, Stephen M. Mcjohn

Suffolk University Law School Faculty Works

This Article discusses another role for default rules--reducing costs of status competition. Default rules principally serve to reduce transaction costs and strategic behavior costs, but they also accomplish other functions. The hypothetical behavior of parties that measure the costs and benefits of the transaction in absolute terms provide a basis transaction and strategic behavior cost analysis. Parties in actual negotiations, however, often shift to measuring things in relative terms because of concerns about status. The participants enter into contract negotiations to achieve gains from trade. The process of negotiation itself, however, may become a competition. Rather than simply trying to …

Learning From Colleagues: A Case Study In The Relationship Between "Academic" And "Ecological" Clinical Legal Education, Robert J. Condlin Jan 1997

Learning From Colleagues: A Case Study In The Relationship Between "Academic" And "Ecological" Clinical Legal Education, Robert J. Condlin

Clinical Law Review

From the beginning of its resurgence in the 1960s, the clinical movement in American legal education has been driven by a kind of "academic" perspective. Emphasizing the necessary relationship between theory and practice, the central role of ideas in the development of behavioral competence, and the importance of the intellectual dimension of professional socialization, this perspective has shaped not only the intellectual content of most American clinical legal education, but also its programmatic structure. Academic clinical instruction is characterized by a commitment to supervision by full-time law faculty, on cases selected principally for their educational value, based in law offices …

Hrotswitha Of Gandersheim's Dulcitius And Callimachus In A New Translation, Mark L. Damen Jan 1997

Hrotswitha Of Gandersheim's Dulcitius And Callimachus In A New Translation, Mark L. Damen

Quidditas

Even without external corroborating evidence, we may infer from her works that the nun Hrotswitha (Hrotsvit in Saxon) lived in Saxony during the second half of the tenth century. Because she seems to have had considerable freedom of movement and expression for a woman at that time, writing about worldly affairs evidently with some personal knowledge of them, she was most likely a canoness, that is, not fully cloistered. She must have visited the courts of the Saxon kings, probably more than once, since she chronicles their exploits and composes poetry of a type briefly popularized by a scholar in …

Testing The Grades: Evaluating Grading Models In Clinical Legal Education, Stacy L. Brustin, David F. Chavkin Jan 1997

Testing The Grades: Evaluating Grading Models In Clinical Legal Education, Stacy L. Brustin, David F. Chavkin

Clinical Law Review

In 1994, the JOURNAL OF LEGAL EDUCATION published a survey of grading practices at law schools across the United States. That survey revealed a mix of grading approaches for clinical programs. 31 percent of all clinical courses used a fully-graded model; 33 percent graded students on a pass/fail basis; and 16 percent utilized both graded and pass/fail models. The article did not attempt to evaluate qualitatively the effectiveness of the various grading models. At about the same time that this article was published, clinicians teaching in Columbus Community Legal Services (CCLS) of The Catholic University of America were reconsidering the …

Striving To Teach "Justice, Fairness, And Morality", Jane Harris Aiken Jan 1997

Striving To Teach "Justice, Fairness, And Morality", Jane Harris Aiken

Clinical Law Review

By far the most challenging value is the injunction to strive to promote justice, fairness, and morality. Arguably, the first value, the provision of competent representation, can be fostered by effective skills training. The third value, striving to improve the profession, can be fostered through active participation in the Bar. The fourth value, professional self-development, appears to be mainly concerned with effective Continuing Legal Education programs that enhance lawyers' ability to learn through experience. Yet methods of promoting the second value are not only less obvious than they are for the other three values, but also more difficult. The MacCrate …

Law And Phrenology, Pierre Schlag Jan 1997

Law And Phrenology, Pierre Schlag

Publications

As the intellectual credentials of American law become increasingly dubious, the question arises: how has this discipline been intellectually organized to sustain belief among its academic practitioners? This Commentary explores the nineteenth-century pseudo-science of phrenology as a way of gaining insight into the intellectual organization of American law. Although there are, obviously, significant differences, the parallels are at once striking and edifying. Both phrenology and law emerged as disciplinary knowledges through attempts to cast them in the form of sciences. In both cases, the "sciences" were aesthetically organized around a fundamental ontology of reifications and animisms -- "faculties" in the …

Risk In The Balance, Jay D. Wexler Jan 1997

Risk In The Balance, Jay D. Wexler

Faculty Scholarship

In both academic and legislative circles, risk assessment reform is currently a hot topic. In the last decade, scholars have increasingly criticized the risk assessment procedures which administrative agencies employ to protect the public from environmental and health risks. Critics have pointed to several flaws in the current system, calling it inconsistent, undemocratic, overly decentralized, excessively rigid and unjustifiably conservative. To deal with these problems, scholars have proposed a variety of solutions. Peter Huber has urged agencies to assess risk less conservatively in order to save society from "second best" technology. Cass Sunstein and Richard Pildes have proposed injecting public …

Alternatives To Marital Fault: Legislative And Judicial Experiments In Cultural Change, J. Herbie Difonzo Jan 1997

Alternatives To Marital Fault: Legislative And Judicial Experiments In Cultural Change, J. Herbie Difonzo

Hofstra Law Faculty Scholarship

This article focuses on the legal and cultural history of non-fault divorce alternatives, and examines both formal legal materials and popular periodicals in an effort to comprehend the evolution of the modern American divorce culture. Beginning in the 1920s, the concept of incompatibility resounded through popular psychology as well as jurisprudence. The expansion of the divorce ground of cruelty to include mental anguish was not an attempt to broaden divorce grounds, but rather an attempt to define the range of the existing cruelty principle in terms of the new psychological understanding. Divorces had infiltrated the burgeoning consumer culture, and the …

Relations Of Burnout To Elementary School Teachers, Special Education Beliefs, And Referral Expectations, Nichole A. Ledermann Jan 1997

Relations Of Burnout To Elementary School Teachers, Special Education Beliefs, And Referral Expectations, Nichole A. Ledermann

Masters Theses

The Maslach Burnout Inventory (MBI; Maslach, Jackson, & Schwab, 1996), a teacher survey of expectations and preferences concerning case study evaluation referral, and demographic questions were completed by regular education elementary school teachers (n=88) in a midwestern city suburb. Results suggested that symptoms of burnout were not evident among this sample of professionals according to Maslach et al. (1996) criteria. Spearman Rho correlations between the MBI subscales and expectations or preferences to have students referred, tested and placed into special education services were not significant. Significant correlations were replicated among the subscales of the Maslach Burnout Inventory. Results suggested that …

Young Children's Talk At Play: Orientation To Self And Orientation To The Joint Exigencies Of Conversation, Paige K. Parker Jan 1997

Young Children's Talk At Play: Orientation To Self And Orientation To The Joint Exigencies Of Conversation, Paige K. Parker

Masters Theses

This study employed a conversation analytic approach to determine how children in naturally constructed play episodes use language as an object of play and how children in their naturally occurring talk display orientation to their own individual activities and others' social actions. The participants were thirty-nine kindergarten and first grade students at South Elementary School in Marshall, Illinois. The study is based upon fifteen hours of conversation collected during recess periods. Relevant segments from the corpus were transcribed according to an adapted version of Jefferson's Transcript Notation System (1984). The findings suggested that (1) the groups of children used language …

A Resource Document For The Development Of An Alternative Education Program For Disruptive Youth, Deborah Claunch

Masters Theses

This qualitative study developed a model for an alternative education program for disruptive students in grades 6 through 8 in Franklin and Williamson Counties in Southern Illinois. It was facilitated by the issuance of grant funds to the Regional Offices of Education by the Illinois State Board of Education under the Safe Schools Act of 1995.

The desire of the researcher was to develop a program that would lead to changes in behaviors, promote academic achievement, and return students to the regular school environment with fewer incidents of misbehavior. The outcomes of this qualitative study resulted in a comprehensive resource …

Vendanta And Modern Science: Some Demarcation Criteria And Commonalities, Varadaraja V. Raman Jan 1997

Vendanta And Modern Science: Some Demarcation Criteria And Commonalities, Varadaraja V. Raman

Journal of Hindu-Christian Studies

In the past centuries, Western scholars who studied the complexities of Indian thought had at least two motivations. First, there was a need to understand the alien mind-set which they were eager to ameloriate (convert), for they worked on the conviction that they were bringing truth, light, and salvation to a misguided lot. They felt that it was their evangelical responsibility to redeem lost souls. Some of them, whether overtly or subtly, wanted to give moral ammunition to the colonial governments which were summarily imposing Western values and worldview on the subject peoples.

From Vedic Science To Vedanta, Subhash C. Kak Jan 1997

From Vedic Science To Vedanta, Subhash C. Kak

Journal of Hindu-Christian Studies

Vedanta has often been studied without relating it to the Vedic system of knowledge. The reason behind this situation is the fashionable but wrong view that Vedic thought is "pre-scientific" and at best it represents "archaic modes of thought". But recent scholarship has shown that astronomy was one of the bases of the design of Vedic fire altars and an astronomical code has been discovered in the organization of the Rgveda. It is now being accepted that the Vedic people knew considerable astronomy that included the knowledge of planet periods. Knowledge of astronomy and the concomitant sciences provides the backdrop …
