Purchase Money Security Interests In The Preference Zone: Questions Answered And Questions Raised By The 1994 Amendments To Bankruptcy Code 547, Timothy R. Zinnecker

Missouri Law Review

In October 1994, Congress approved the Bankruptcy Reform Act of 1994,' which revised various provisions of the United States Bankruptcy Code. The revisions included two amendments to the preference statute, 11 U.S.C. §547. Historically, a creditor generally could preserve from preference attack an otherwise voidable purchase money security interest if the creditor perfected its security interest no later than the tenth day after the debtor first possessed the collateral. After first discussing the basics of a preference attack on an Article Nine security interest, this article summarizes the leading cases that prompted Congress to amend 11 U.S.C. § 547(c)(3)(B), suggests …

Statutory Construction And Judicial Policy-Making Impact Whether Title Vii's Definition Of Employer Imposes Individual Liability Upon An Agent, Cheryl L. Feutz Jan 1997

Statutory Construction And Judicial Policy-Making Impact Whether Title Vii's Definition Of Employer Imposes Individual Liability Upon An Agent, Cheryl L. Feutz

Missouri Law Review

Title VII of the Civil Rights Act of 19642 ("Title VII") prohibits employment discrimination Although no question exists that "employers" are liable for their discriminatory acts as well as for their agents' acts that occur within the scope of employment,4 a conflict exists among the federal circuits regarding whether Title VII's definition of "employer" also imposes individual liability upon the employer's agent. The Seventh Circuit answered this question for its circuit in Williams v. Banning.'

Can You Keep A Secret--You May Discover The Answer Is Yes Under Missouri's Privilege For Trade Secrets, Brian R. Mcginley

Missouri Law Review

This Note examines which factors give rise to classification of information, patterns, formulas and the like as "trade secrets." Missouri's legislature, in its Uniform Trade Secrets Act, has offered a noncomprehensive definition of "trade secret."' While this and other proffered definitions provide some guidance, attempting to define any term of art cannot be done in absolute measures.

Playing Defense, Robert F. Nagel Jan 1997

Playing Defense, Robert F. Nagel

Publications

Noting that the Romer opinion condemns the motives behind Amendment 2 without pausing even briefly to examine the social context in which it was enacted, Professor Nagel describes the decision as a model of the intolerant impulse in action. He traces this impulse to the Justices' unwillingness to examine their own role--and that of the rest of the constitutional law establishment--in creating the underlying conditions that produced Amendment 2.

In order to identify those conditions, Professor Nagel analyzes the primary document used by Colorado for Family Values during its campaign on behalf of the initiative. He argues that this document …

Economic Considerations Of Land-Use And Landcare In The Peel-Harvey Catchment, Roger Attwater Jan 1997

Economic Considerations Of Land-Use And Landcare In The Peel-Harvey Catchment, Roger Attwater

Natural resources published reports

The first section of this paper reviews some spreadsheets of land-use profitability by soil type which were developed in a previous study, "The economic land capability assessment, Waroona to Capel". The second section discusses how externalities can be accounted for by developing a range of complementary approaches which reinforce property rights.

The spreadsheets reviewed were developed as an aid to aggregate land-use planning, and were proposed as a basis for determining transfer payments to reflect the social costs of phosphorus pollution. The spreadsheets were found to lack the flexibility needed to compare alternative management options, and considered inappropriate for dealing …

A Strategy For Monitoring Glaciers, Andrew G. Fountain, Robert M. Krimmel, Dennis C. Trabant Jan 1997

A Strategy For Monitoring Glaciers, Andrew G. Fountain, Robert M. Krimmel, Dennis C. Trabant

Geography Faculty Publications and Presentations

Glaciers are important features in the hydrologic cycle and affect the volume, variability, and water quality of runoff. Assessing and predicting the effect of glaciers on water resources require a monitoring program to provide basic data for this understanding. The monitoring program of the U.S. Geological Survey employs a nested approach whereby an intensively studied glacier is surrounded by less intensively studied glaciers and those monitored solely by remote sensing. Ideally, each glacierized region of the United States would have such a network of glaciers. The intensively studied glacier provides a detailed understanding of the physical processes and their temporal …

Synthesis And Characterization Of Poly(Magnesium Acrylate) And Poly(Zirconyl Acrylate) Towards Formation Of Magnesia Partially Stabilized Zirconia Ceramics, Xinhua Xu Jan 1997

Synthesis And Characterization Of Poly(Magnesium Acrylate) And Poly(Zirconyl Acrylate) Towards Formation Of Magnesia Partially Stabilized Zirconia Ceramics, Xinhua Xu

Electronic Theses and Dissertations 1990 - 1999

Poly(magnesium acrylate) and poly(zirconyl acrylate) have been formed by chelating the magnesium ion and the zirconyl ion onto poly(acrylic acid). The PAA is usually neutralized by addition of sodium hydroxide before the synthesis process. The structures and characterisitics of these polymers are studied by various analytical methods such as thermal analysis, elemental analysis, infrared spectroscopy, and mass spectroscopy. The formation of these polymers is verified and their structures are determined. In addition, a preliminary attempt was carried out to make an advanced structural ceramic from a mixture of poly(magnesium acrylate) and poly(zirconyl acrylate).

Study Of The Relationship Between Work Environment Variables And The Intent Of Child Care Workers In Southeast Florida To Leave Their Workplace, Leighan Roberts Rinker

Electronic Theses and Dissertations 1990 - 1999

The purpose of this study was to identity within the workplace sources of satisfaction and sources of dissatisfaction for child care workers in southeast Florida and to develop a predictive model of child care workers' intentions to leave their jobs based on selected work environment variables. The work environment variables selected as predictor variables were administration, communication, compensation, career advancement opportunity, goals and job tasks, children, co-workers, parents, and facility and supplies. The population surveyed consisted of 227 child care workers from 45 licensed child care centers in Dade, Broward, and Palm Beach counties, Florida. Instruments used in this study …

Study Of The Impact Of Using Electronic Mail To Disseminate Nursing Research On Nurses' Perceptions Of Barriers To Research Utilization, Charles M. Bobo

Electronic Theses and Dissertations 1990 - 1999

Bridging the gap between the extant body of nursing research and clinical staff at the patient bedside remains a current problem, despite almost two decades of studies. This study examined the impact of using electronic mail to disseminate nursing research on nurses' perceptions of barriers to research utilization. The BARRIERS Scale tool was used to measure the nurses' perceptions of barriers to research utilization. Forty subjects, from a one-thousand bed Medical Center, comprised the sample. The design for this study was pre-test and post-test design involving a treatment and control group. The treatment consisted of four summarized research articles disseminated …

Synthesis And Characterization Of Some New 4(3h)-Quinazolinones, Duran Scott Schmidt Jan 1997

Synthesis And Characterization Of Some New 4(3h)-Quinazolinones, Duran Scott Schmidt

Electronic Theses and Dissertations 1990 - 1999

The synthesis and characterization of a series of new 4(3H)-quinazolinones is being reported. The new 4(3H)-quinazolinones have either one or two chlorine atoms in the benzene ring and a thiazol-5-yl or 1,3,4-thiadiazol-5-yl substituent in position 3. The new compounds were synthesized in a two-step procedure described before for a different series of compounds. Substituted chloroanthranilic acids (or 3,5-dichloroanthranilic acid) and acetic anhydride yielded the intermediate 3,1-benzoxazin-4-ones which subsequently afforded the desired products by reaction with a substituted 2-aminothiazole or 2-amino-1,3,4-thiadiazole in the presence of dry pyridine. In addition to elemental analyses and melting points, the new compounds were characterized by …
