Inhalation Toxicity Of (1→3)-Β-D-Glucan: Recent Advances, Birgitts Fogelmark, Margarets Sjöstrand, David Williams, Ragnar Rylander
Inhalation Toxicity Of (1→3)-Β-D-Glucan: Recent Advances, Birgitts Fogelmark, Margarets Sjöstrand, David Williams, Ragnar Rylander
ETSU Faculty Works
To investigate the effects of (1→3)-β-D-glucan after inhalation, animals were exposed to different forms of glucan and the number of lung lavage cells was determined 24 h after exposure. None of the different forms assayed caused any increase in cell numbers. In animals exposed to endotoxin, all types of cells were increased after 24 h. A simultaneous exposure to curdlan reduced this increase in a dose-related fashion. The results suggest that (1→3)-β-D-glucan-related acute injury to the lung is induced by mechanisms other than those induced by inflammagenic agents such as endotoxin.

Direct Demonstration Of Retroviral Recombination In A Rhesus Monkey, Dawn P. Wooley, Randall A. Smith, Susan Czajak, Ronald C. Desrosiers
Neuroscience, Cell Biology & Physiology Faculty Publications
Recombination may be an important mechanism for increasing variation in retroviral populations. Retroviral recombination has been demonstrated in tissue culture systems by artificially creating doubly infected cells. Evidence for retroviral recombination in vivo is indirect and is based principally on the identification of apparently mosaic human immunodeficiency virus type 1 genomes from phylogenetic analyses of viral sequences. We infected a rhesus monkey with two different molecularly cloned strains of simian immunodeficiency virus. One strain of virus had a deletion in vpx and vpr, and the other strain had a deletion in nef. Each strain on its own induced low virus …

A New Legislation: Remarks On The Draft Restatement Of Products Liability, Marshall S. Shapo
A New Legislation: Remarks On The Draft Restatement Of Products Liability, Marshall S. Shapo
University of Michigan Journal of Law Reform
This being a law school in a university, I would like to begin my discussion of the present draft not with doctrinal analysis, but rather by attempting to frame the question from a broader set of perspectives. I shall draw on the intricate relations of law with the society it governs and the reflection of those relations in the literature that remains at the heart of great universities.

Design Defects Under The Proposed Section 2(B) Of The Restatement (Third) Of Torts: Products Liability- A Judge's View, William A. Dreier
University of Michigan Journal of Law Reform
The proposed section 2(b) of the Restatement (Third) of Torts: Products Liability has caused a great deal of controversy, and many are concerned that this section represents a radical change in the law. This Article explains that section 2(b) in fact provides a pragmatic, workable tool for judges and attorneys to explain and prove a manufacturer's liability for a defective product. It sheds much of the baggage of the Restatement (Second) of Torts section 402A and its commentaries, yet preserves the essence of the theory behind section 402A. The criticisms of the new language are adequately met in the comments, …

Constructing A Roof Before The Foundation Is Prepared: The Restatement (Third) Of Torts: Products Liability, Section 2(B) Design Defect, Frank J. Vandall
University of Michigan Journal of Law Reform
The Restatement (Third) of Torts: Products Liability section 2(b) is a wish list from manufacturing America. It returns products liability law to something more restrictive than negligence. What is new from the Reporters is that their proposal is written on a clean sheet of paper. Messy and awkward concepts such as precedent, policy, and case accuracy have been brushed aside for the purpose of tort reform. There has been almost no attempt to evaluate strict liability precedent or the policies underlying previous cases and the Restatement (Second) section 402A. Section 2b (the roof) has been drafted with little consideration of …
Warning Defect: Origins, Policies, And Directions, Robert E. Keeton
Warning Defect: Origins, Policies, And Directions, Robert E. Keeton
University of Michigan Journal of Law Reform
On a spectrum from the polar extreme of generality to the opposite pole of specificity, "What should warnings say?" is near the extreme in its degree of generality. A question phrased this way invites a correspondingly generic response. Such a response is not very useful to the trial judge and lawyers who regularly must fashion clear explanations on the law of warning defect for layperson juries. As used here, this question is not intended as a signal inviting just any kind of response that might be acceptable under the mores of casual conversation. It is a more serious request for …
Arriving At Reasonable Alternative Design: The Reporters' Travelogue, James A. Henderson Jr., Aaron D. Twerski
Arriving At Reasonable Alternative Design: The Reporters' Travelogue, James A. Henderson Jr., Aaron D. Twerski
University of Michigan Journal of Law Reform
Substantial commentary and controversy have been generated by the requirement in the new Restatement (Third) of Torts: Products Liability that plaintiffs in most (but not all) cases involving claims of defective product design show that a reasonable alternative design was available and that failure to adopt the alternative rendered the defendant's design not reasonably safe. Henderson and Twerski explain the origins of that requirement in American products liability case law and show that it is not only the majority position but also comports with widely shared views regarding the proper objectives of our liability system. Although consumer expectations cannot serve …
The Constitution, The White House, And The Military Hiv Ban: A New Threshold For Presidential Non-Defense Of Statutes, Chrysanthe Gussis
The Constitution, The White House, And The Military Hiv Ban: A New Threshold For Presidential Non-Defense Of Statutes, Chrysanthe Gussis
University of Michigan Journal of Law Reform
The President's constitutional duty to 'take Care that the Laws be faithfully executed" implies that the President is entrusted with the responsibility to defend those laws against court challenges. On occasion, however, Presidents faced with legislation that they deem unconstitutional have declined to defend that legislation against legal challenges. On February 10, 1996, President Clinton declined to defend a provision included in the National Defense Authorization Act for Fiscal Year 1996 that required discharge from the military of all HIV-positive servicemembers because he believed that the provision violated the Equal Protection Clause of the Fourteenth Amendment. This Note explores whether …

Calculation Of Breed Direct And Maternal Genetic Fractions And Breed Specific Direct And Maternal Heterozygosity For Crossbreeding Data, L. Dale Van Vleck
Calculation Of Breed Direct And Maternal Genetic Fractions And Breed Specific Direct And Maternal Heterozygosity For Crossbreeding Data, L. Dale Van Vleck
Department of Animal Science: Faculty Publications
Teaching, research, and herd breeding applications may require calculation of breed additive contributions for direct and maternal genetic effects and fractions of heterozygosity associated with breed specific direct and maternal heterosis effects. These coefficients can be obtained from the first NB rows of a pseudo numerator relationship matrix where the first NB rows represent fractional contributions by breed to each animal or group representing a specific breed cross. The table begins with an NB x NB identity matrix representing pure breeds. Initial animals or representative crosses must be purebreds or two-breed crosses. Parents of initial purebreds are represented by the …

Self-Love And Social Are The Same: Reflections On Autonomy, Autobiography, And The Responsible Self, Eugene R. August
Self-Love And Social Are The Same: Reflections On Autonomy, Autobiography, And The Responsible Self, Eugene R. August
University of Dayton Review
I begin with this question for a specific, local reason. When the Humanities Base theme of autonomy and responsibility is raised in the classroom, students frequently misperceive the terms as opposites: they see autonomy vs. responsibility. As a result, classroom discussions of this theme often go nowhere because the discussants have defined autonomy as one's right to do as one pleases and responsibility as a restriction imposed by those in power. Attempts to explore issues such as abortion, gun control, same-sex marriage, and physician-assisted suicide quickly become mired in the mono-theme of a debate between individual rights and social repression. …
Perspectives On Autonomy And Responsibility In The Writings Of Thomas Merton, Joseph Vlcek Kozar S.M.
Perspectives On Autonomy And Responsibility In The Writings Of Thomas Merton, Joseph Vlcek Kozar S.M.
University of Dayton Review
The first thing to remember about Thomas Merton is what Merton scholars sometimes refer to as his "inconsistency." As a writer Merton is quite capable of advocating contradictory positions within the same work (sometimes even on the same page). An unsympathetic reader of this feature of Merton's prose might demand more rigorous editing (the very recommendation made by Evelyn Waugh for The Seven Storey Mountain). A more sympathetic reader sees that Merton's writing reflected the inherent ambiguities which description of personal experience entails.
A Review Of 'A Study Of The Spelling Development Of Adult Literacy Learners Compared With That Of Classroom Children', Bryan Bardine
A Review Of 'A Study Of The Spelling Development Of Adult Literacy Learners Compared With That Of Classroom Children', Bryan Bardine
English Faculty Publications
A great deal of research has looked at the spelling development of children, but comparatively little has focused on ways adult literacy students develop as spellers. Neva M. Viise, in her article "A Study of the Spelling Development of Adult Literacy Learners Compared with that of Classroom Children," examines some interesting aspects of adults' and children's spelling development. This study "compared the spelling development of 195 child and 124 adult literacy learners through a comparison of spelling errors" (p. 561). The author asks two important questions in this research. First, will adult literacy students progress through the same stages of …
