Aggressive Enforcement Of Rights Involving Internet Abuses, William L. Lafuze, Valerie K. Friedrich Jan 1997

Aggressive Enforcement Of Rights Involving Internet Abuses, William L. Lafuze, Valerie K. Friedrich

Computer Law Review and Technology Journal

The information age, and particularly the development of the Internet and the World Wide Web, has enabled any individual with a personal computer to rapidly acquire information from, and disseminate information to, a worldwide base. Many unlawful activities, such as copyright infringement, may now be practiced in a new environment and manner. Due to several unique aspects of the Internet environment, traditional judicial remedies, such as monetary damages, are ineffectual. Consequently, violations of personal and property rights on the Internet present new challenges for the enforcement of such rights. More aggressive remedies, such as injunction of wrongful activities and impoundment …

Courting Cyberspace, Al Harrison

Computer Law Review and Technology Journal

The practice of law requires the creation and management of massive amounts of paperwork. Software that combines the use of templates and macros can assemble documents for the user, rather than the attorney having to type out volumes of documents from scratch. Firms can manage newly-created documents either by using expensive document management software or by taking advantage of their computers' hierarchical file systems. This article discusses various means for assembling and managing legal documents.

Using Technology In The Management And Trial Of Complex Cases, Fred Misko Jr., Charles E. Ames Jan 1997

Using Technology In The Management And Trial Of Complex Cases, Fred Misko Jr., Charles E. Ames

Computer Law Review and Technology Journal

As modem society became more technologically advanced, complex tort and mass disaster litigation was sure to follow suit. Over the last twenty years, cases involving post-industrial products such as breast implants, heart valves, pesticides, Agent Orange, Bendectin, lead, and asbestos, as well as single-event mass disasters such as Bhopal and PanAm Flight 103, brought increasingly large numbers of individuals claiming serious injuries before the courts. The legal community has recently begun to focus on the impact that this complex litigation has on the practice of law and the administrative capabilities of the judicial system. Gone are the days when a …

Efficient, Effective Advocacy In The "Computer Age" Demands The Marriage Of The Work Product Doctrine To Computerized Litigation Databases, Cecilee Price-Huish

Computer Law Review and Technology Journal

The attorney-client relationship is one that often evolves over years of legal representation, which often results in the creation of close working relationships and the development of mutual trust. It is not unusual for an attorney or law firm to represent a client for a number of years, fulfilling many different functions as circumstances require. Within this context, a lawyer's roles may include counselor, mediator and litigator. In the age of the information superhighway, where business is increasingly conducted via computerized systems, it is commonplace for an attorney, during the course of lengthy legal representation, to rely heavily on computerized …

Management And Discovery Of Electronically Stored Information, Lawrence R. Youst, Haejung Lisa Koh Jan 1997

Management And Discovery Of Electronically Stored Information, Lawrence R. Youst, Haejung Lisa Koh

Computer Law Review and Technology Journal

New technology continuously abuts the aged and tried legal principles set forth decades ago. With information creation at every user's personal computer, with access to instant communication through e-mail systems and with the wide-spread use of the Intemet, the legal standards for discovery of information must continually evolve. It is no longer sufficient for a party requesting discovery to seek paper alone. It is also no longer sufficient for a party responding to discovery to review paper files alone in an attempt to satisfy the discovery requests. As we continue to progress in this age of information, a hard copy …

What Is Eleventh Amendment Immunity?, Carlos Manuel Vázquez Jan 1997

What Is Eleventh Amendment Immunity?, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

The Supreme Court's Eleventh Amendment decisions give conflicting signals about what the Amendment does. On one view, the Amendment functions as a forum-allocation principle--immunizing states from liability in suits filed in federal court, but leaving open the possibility that states may be compelled to entertain suits against themselves in their own courts. A separate line of cases, however, implies that state courts enjoy an immunity from suit in their own courts and that nothing in the Constitution withdraws such immunity; on this view, the Eleventh Amendment, by protecting the states from suit in the federal courts, effectively immunizes the states …

Physical Media Independence: System Support For Dynamically Available Network Interfaces, Jon Inouye, Jim Binkley, Jonathan Walpole Jan 1997

Physical Media Independence: System Support For Dynamically Available Network Interfaces, Jon Inouye, Jim Binkley, Jonathan Walpole

Computer Science Faculty Publications and Presentations

Advances in hardware technology has fueled the proliferation of dynamically configurable network interface cards. This empowers mobile laptop users to select the most appropriate interface for their current environment. Unfortunately, the majority of system software remains "customized" for a particular network configuration, and assumes many network characteristics remain invariant over the runtime of the software. Physical Media Independence (PMI) is the concept of making assumptions about a particular device explicit, detecting events which invalidate these assumptions, and recovering once events are detected. This paper presents a model supporting PMI. Based on device availablilty, the model identifies implicit device-related assumptions made …

Commentary, At Issue – House Rules: Is A Supermajority Requirement For Tax Hikes Constitutional? – No, The Framers Had Only A Simple Majority In Mind, Susan Low Bloch

Georgetown Law Faculty Publications and Other Works

The supermajority requirement undermines the constitutional principles of Article I and separation of powers. Rule XXI is not merely a rule of internal procedure; it determines when bills get presented to the Senate and the president.

Role Of Personal Values In Professional Decisionmaking, The , Bruce A. Green Jan 1997

Role Of Personal Values In Professional Decisionmaking, The , Bruce A. Green

Faculty Scholarship

The 1908 Canons of Professional Ethics directed a lawyer to "obey his own conscience."' Lawyers receive similar advice today. Writings on legal practice encourage lawyers to make professional decisions based on their moral values and religious beliefs, as expressed in the familiar injunction: to be charted by one's own "moral compass." Underlying this advice is an assumption about the professional norms - namely, that they accommodate, if not contemplate, lawyers' reliance on personal values. This assumption finds some support in the contemporary codes of lawyer conduct, which acknowledge a role for the lawyer's "conscience" or "moral judgment." Yet, it is …

Legal Fictions: Copyright, Fan Fiction, And A New Common Law, Rebecca Tushnet Jan 1997

Legal Fictions: Copyright, Fan Fiction, And A New Common Law, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

A girl owns a number of Barbie dolls. She makes outfits for them and constructs elaborate scenarios in which they play starring roles. She enacts her dramas in her front yard, where passers-by can easily see. Does she violate the law? What if the girl writes down her stories starring Barbie? What happens when she lets her friends read them? What if she e-mails those stories to a Barbie mailing list? What if she posts those stories and a picture of Barbie in her new outfit on her Web page?

Copyright law has long been a concern more for corporations …
