Reemergence Of The Charter Application Debate: Issues For The Supreme Court In Eldridge And Vriend, Richard Fader
Dalhousie Journal of Legal Studies
With the Supreme Court poised to hear the Eldridge and Vriend cases, and the lack of academic and individual consensus on the effectiveness of the government actor test, it appears that we are entering round two of the Charter application debate. The author contends that the threshold approach should be scrapped in favour o f a rights-based analysis, which defines the Charter's scope within the context of the right or freedom in question. Passage of the Personal Responsibility and Work Opportunity Act (PRWOA) of 1996 presents an opportunity to reinvent human services in America. For more than a decade, the welfare bureaucracy and public assistance programs of state welfare have been in crisis. The clients who depend on welfare detest it, finding and keeping qualified professionals to work in the public social services has become an administrative headache, and taxpayers perceive welfare as a fiscal black hole that perpetuates immorality. The recent decision to "devolve" welfare in a block grant to states underscores the urgency to rethink public assistance to poor families. There …

Creating Complex Monsters: Joint Operating Agreements And The Logical Invalidity Of Treasury Regulation 1.502-1(B), Darryll K. Jones

This article questions the validity of Regulations section 1.502-1(b) and its resulting insistence upon virtual mergers. It argues that the regulation is invalid as having no basis in section 502, the statute under which it was codified. This article argues, instead, that the regulation is a logically incorrect amalgamation of two distinct judicial tax doctrines by which tax exemption may be or could have been gained vicariously: (1) the integral part doctrine which allows one organization to achieve tax exemption on the basis of another organization's charitable activities, and (2) the now-discarded destination of income doctrine under which tax exemption …

Issues And Conflicts In The Management Of The Public Domain Of The Saddle Mountains In Eastern Washington: A Case Study, James Jack Sharpe

This thesis examines the prehistoric, historic, and contemporary patterns of land use and their effects in the Saddle Mountains of eastern Washington. Federal laws and Indian treaties require that federal lands be managed to preserve natural and cultural resources while meeting the demands of private interests for economic development and of the general public for recreational access. Land management conflicts created by these diverse interests are reviewed in the context of the history of the study area, the legal framework that directs its management, and the management process as it actually works. It concludes with recommendations to resolve land use …

Simulating The Distribution Of Axon Size In Nerves, Robert B. Szlavik, Hubert De Bruin

The electrical excitation threshold of a nerve axon is dependent upon the physical properties of the axon membrane as well as the axon diameter. Histological studies have confirmed that peripheral afferent muscle nerves have a characteristic distribution of axon diameters. We approximate a probability density function for this distribution that consists of the summation of several Gaussian functions. A transformation technique is then applied for the random generation of the nerve axon diameters from uniformly distributed random numbers. For the example presented, the resultant distribution of peripheral afferent muscle nerve axon diameters conforms approximately to the characteristic distribution that has …

This Essay traces the history of Britain's relations with the European Community, now the European Union. It concludes that the Single Currency is key to all future activities of the European Union, as well as to Tony Blair's ability to escape from the 'mishandling of Europe' curse which has bedeviled so many British premierships.
