Noting that the Romer opinion condemns the motives behind Amendment 2 without pausing even briefly to examine the social context in which it was enacted, Professor Nagel describes the decision as a model of the intolerant impulse in action. He traces this impulse to the Justices' unwillingness to examine their own role--and that of the rest of the constitutional law establishment--in creating the underlying conditions that produced Amendment 2.

In order to identify those conditions, Professor Nagel analyzes the primary document used by Colorado for Family Values during its campaign on behalf of the initiative. He argues that this document …

Popular education is a form of adult education that encourages learners to examine their lives critically and take action to change social conditions. It is "popular" in the sense of being "of the people." Popular education emerged in Latin America in the 1960s-1970s; Paulo Freire is its best known exponent. However, its roots may be found in the French Revolution, in workers' education of the 1920s-1930s, and in such movements as the Highlander Folk School in Tennessee (Beder 1996; Jeria 1990). Young Children's Talk At Play: Orientation To Self And Orientation To The Joint Exigencies Of Conversation, Paige K. Parker

This study employed a conversation analytic approach to determine how children in naturally constructed play episodes use language as an object of play and how children in their naturally occurring talk display orientation to their own individual activities and others' social actions. The participants were thirty-nine kindergarten and first grade students at South Elementary School in Marshall, Illinois. The study is based upon fifteen hours of conversation collected during recess periods. Relevant segments from the corpus were transcribed according to an adapted version of Jefferson's Transcript Notation System (1984). I used to work for a Big Eight (now Big Six) Accounting firm. In addition to a tremendous amount of pro bono work that we did, the firm required all of its staff accountants, managers, and partners to become involved with one of the many not-for-profit organizations in the Cincinnati area.

The rationale was that each employee had an obligation to the greater community, to give something of himself or herself to others. Vendanta And Modern Science: Some Demarcation Criteria And Commonalities, Varadaraja V. Raman

In the past centuries, Western scholars who studied the complexities of Indian thought had at least two motivations. First, there was a need to understand the alien mind-set which they were eager to ameloriate (convert), for they worked on the conviction that they were bringing truth, light, and salvation to a misguided lot. They felt that it was their evangelical responsibility to redeem lost souls. Some of them, whether overtly or subtly, wanted to give moral ammunition to the colonial governments which were summarily imposing Western values and worldview on the subject peoples.

Undergraduate institutions, on their own and in partnership with law schools, can and should play a more significant role in expanding the pool of law school applicants from non-traditional backgrounds. The Law and Diversity Program at Western Washington University was conceived out of this desire to prepare non-traditional students for the study of law and thereby help bring more diversity to the legal profession. In 1989, in a four-to-four vote without opinion, the United States Supreme Court let stand a senior priority, reserved Indian water right for the Shoshone and Northern Arapaho Tribes of the Wind River Indian Reservation. Shortly thereafter, the Tribes issued a permit requiring a minimum flow of water, known as an 'instream flow/ on the Wind River for fishery, environmental and cultural purposes. In 1992 however, a Wyoming Supreme Court majority ruled the Tribes must divert their water from its stream channel in order to use it and that the State Engineer shall administer the Tribes' water. This article pits Ronald Dworkin against Fyodor Dostoyevsky. The article critiques Ronald Dworkin's answer to the question of fit: how judges reconcile general legal rules with particular situations. Dworkin's heavy focus on legal principles under-emphasizes the importance of facts in judicial decisionmaking. Exploring how judges approach the question of fit from a more literary perspective, the article examines the posture of a judge - a judge's physical and temporal position in relation to the cases she adjudicates, a position which affects the level of generality with which a judge perceives the facts of a case and directly influences a judge's …

Social, Academic, And Behavioral Competence Of Depressed Children: Relationship To Diagnostic Status And Family Interaction Style, Elizabeth Burney Hamilton, Joan R. Asarnow, Martha C. Tompson

This study compared the social adjustment and academic peifonnance of 15 psychiatrically hospitalized children with depression to 14 children with schizophrenia spectrum disorders and 20 nonnal community children, ages 7-14. The relationship between children's interpersonal and academic competence and the quality of direct family interactions was also examined. Analyses revealed an association between children's adaptive functioning and both diagnostic status and family transactional processes, as assessed by two 10-minute conflict-solving tasks. Major findings were as follows: (a) depressed children and children with schizophrenia spectrum disorders received similarly low ratings of social competence in comparison to normal controls; (b) academic peifonnance …

The Supreme Court will bring the highest degree of clarity to the Internet freedom of speech debate if, in ACLU v. Reno, it sets forth the operative metaphor for freedom of speech and applies the metaphor in conjunction with an appropriate analogy for the technology.Part I of this Article discusses judicial decision-making tools with an emphasis on the use of analogy and the importance of applying legal precedents in a manner which is consistent and logical.
