The Theory Of The Firm And The Theory Of The International Economic Organization: Toward Comparative Institutional Analysis, Joel P. Trachtman Jan 1997

The Theory Of The Firm And The Theory Of The International Economic Organization: Toward Comparative Institutional Analysis, Joel P. Trachtman

Northwestern Journal of International Law & Business

Debates regarding the competences and governance of interna- tional economic organizations such as the World Trade Organization (WTO), the European Union (EU) and the North American Free Trade Agreement (NAFFA) seem to grow more polarized. Academic lawyers, political scientists and economists seem to add little light to these heated debates. The purpose of this paper is to examine the theory of the firm and related transaction cost-based literatures of new institutional economics (NIE),4 law and economics (L&E) and industrial organizations (IO),' and the application of their analytical techniques to the linked problems of competence and governance of international economic organizations …

European Constitutionalism And Its Discontents, J.H.H. Weiler, Joel P. Trachtman Jan 1997

European Constitutionalism And Its Discontents, J.H.H. Weiler, Joel P. Trachtman

Northwestern Journal of International Law & Business

Traditionally, the European Community has been set apart from all other international organizations, as well as from states, and Euro- pean Community law has been distinguished from both international law and from domestic law. This was so because of the supposed unique internal structure and processes of the European Community. This "splendid isolation" is no longer viable. Increasingly in the .be- havior - and study - of other transnational organizations, polities or regimes, the European transnational experience has come to provide a model, a yardstick and a set of analytical and critical tools, and per- haps erroneously, a desideratum. While …

Science And International Regulatory Convergence, Jeffery Atik Jan 1997

Science And International Regulatory Convergence, Jeffery Atik

Northwestern Journal of International Law & Business

National regulation is frequently premised on scientific assump- tions; much of regulatory design is based on scientific findings. Con- sumer product, food and drug and workplace safety standards all depend on a scientific assessment of the risks faced by the public and of the efficacy of an adopted measure in addressing these risks. Build- ing codes, waste disposal protocols and mandated immunization of school children all proceed from the technical recommendations of the scientific community. In current Western society, a regulatory measure lacking a scien- tific basis will be subject to criticism and perhaps ridicule; it may be struck down …

Access Rights: A Necessary Corollary To Custody Rights Under The Hague Convention On The Civil Aspects Of International Child Abduction, Priscilla Steward Jan 1997

Access Rights: A Necessary Corollary To Custody Rights Under The Hague Convention On The Civil Aspects Of International Child Abduction, Priscilla Steward

Fordham International Law Journal

This Note argues that the aspect of the Hague Abduction Convention addressing access rights is ineffective because it has forced some courts to misconstrue provisions of the Hague Abduction Convention in order to carry out the Convention's intent. This Note further argues that the burden of establishing the absence of a wrongful removal or retention should fall upon the parent who has removed the child. This Note also argues that the Hague Conference should amend the Convention to order a court to enforce previously ordered access rights in the child's new habitual residence. Part I provides an historical background on …

Public Opinion And The 1996 Elections In Russia: Nostalgic And Statist, Yet Pro-Market And Pro-Yeltsin, David S. Mason Jan 1997

Public Opinion And The 1996 Elections In Russia: Nostalgic And Statist, Yet Pro-Market And Pro-Yeltsin, David S. Mason

Scholarship and Professional Work - LAS

Between 1991 and 1996 Russia underwent a precipitous economic and social decline with decreases in production, gross national product, and wages, and increases in inequality, crime, and corruption. Most people experienced a decline in their standard of living, and many fondly recalled the security and stability of the communist era.

Occupation As Spiritual Activity, Brenda S. Howard, Jay R. Howard Jan 1997

Occupation As Spiritual Activity, Brenda S. Howard, Jay R. Howard

Scholarship and Professional Work - LAS

Although spirituality is rarely explicitly mentioned in the occupational therapy literature, it is implied as an interwoven part of the human system. This article explores the meaning of occupation in the context of sociological and Judeo-Christian theological frameworks and the meaning of spirituality in the occupational therapy clinic. A case is made for acknowledging spirituality in clinical reasoning as a centralizing component of the patients' motivation and assignment of meaning to life.

Going Up And Coming Down In Johannine Legitimation, James F. Mcgrath Jan 1997

Going Up And Coming Down In Johannine Legitimation, James F. Mcgrath

Scholarship and Professional Work - LAS

In his study of Johannine christology Wayne Meeks stressed the importance of understanding the ascent·descent schema in any attempt to understand this christology or explain its origin. The work of sociologists Berger and Luckmann on legitimation has the potential to shed light on an ear her stage in this development. Key passages in John show that ascent-descent language is linked to the motifs of the Son of man and wisdom, and suggest that John has developed these two traditional aspects of christology in response to objections and conflict over Jesus' qualifications to be the revealer, and his relationship to God …

Filartiga’S Firm Footing: International Human Rights And Federal Common Law, Ryan Goodman, Derek P. Jinks Jan 1997

Filartiga’S Firm Footing: International Human Rights And Federal Common Law, Ryan Goodman, Derek P. Jinks

Faculty Articles

This Article analyzes the implications of the revisionist project for the Filartiga doctrine. We advance two related arguments: (1) Federal courts and the political branches explicitly endorse the view that, at a minimum, the scope of CIL is a federal matter; and (2) the courts and political branches also explicitly endorse the view that some definable categories of CIL-including fundamental, universally-recognized human rights-are federal common law. Our argument is simple: The consensus view that universally-recognized human rights are federal common law reflects the considered judgment of the three coordinate branches of government.

Interpersonal Christian Prayer And Communication, E. James Baesler Jan 1997

Interpersonal Christian Prayer And Communication, E. James Baesler

Communication & Theatre Arts Faculty Publications

Nationwide statistical polling during the past 40 years have indicated that prayer is a frequent and important activity for a majority of Americans. Yet communication scholars have yet to theoretically consider the relationship between prayer and communication. This investigation compared and contrasted a particular type of prayer, Interpersonal Christ¦·n Prayer (ICP), with a particular type of communication context, Interpersonal Communication (IC). Results suggested that ICP and IC share common ground in their dyadic nature, intentionality, and in specific communication processes, and that they differ in the nature of the relational being one is communicating with, the locus of initial intent …

Organizational Structures For Community Engagement, Sharon Singleton, Deborah Hirsch, Cathy Burack Jan 1997

Organizational Structures For Community Engagement, Sharon Singleton, Deborah Hirsch, Cathy Burack

New England Resource Center for Higher Education Publications

In a time of public scrutiny of higher education, there is good reason - both for the survival of the campus and the survival of the community around it -- for institutions to promote outreach. Yet even within those institutions with formal structures -- mission statements, faculty handbooks, and presidential leadership that support community service -- the practical considerations -- work assignments, evaluation mechanisms and institutional rewards -- present real challenges. Service-enclaves are structures that exist or are developed within institutions that allow faculty and staff to work collectively as they serve their communities. While individual service work is no …

Farm Women And Work : Required But Not Recognised, Fiona M. Haslam-Mckenzie Jan 1997

Farm Women And Work : Required But Not Recognised, Fiona M. Haslam-Mckenzie

Journal of the Department of Agriculture, Western Australia, Series 4

Across Australia, government sponsored Rural Women's Networks have been established to encourage rural women to look beyond their individual context and to identify as part of a much larger group of women, all with common concerns. These networks have encouraged women to view themselves as legitimate participants in a patriarchal society and to realise that the traditional male culture of farming is redundant. Fiona M. Haslam-McKenzie, a lecturer in the Faculty of Business at Edith Cowan University, reviews the recognition given to women on the farm.

Working On The "Mommy-Track": Motherhood And Women Lawyers, Rebecca Korzec Jan 1997

Working On The "Mommy-Track": Motherhood And Women Lawyers, Rebecca Korzec

All Faculty Scholarship

This Article examines the effects of motherhood on the careers of women lawyers and the efficacy of the 'mommy-track' as a means of ameliorating these effects. Part I examines the current position of women in the legal profession. Part II examines the nature of 'motherhood' and the risk/benefit function of 'mommy-tracking.' Part III analyzes the 'mommy-track' from the perspective of feminist jurisprudence. Finally, Part IV examines issues related to workplace transformation. It is the position of this paper that 'mommy-tracking' reinforces undesirable stereotypes. Ironically, this apparent 'solution' actually forestalls the transformations, at home and at work, which could enable women …
