Democracy, Majoritarianism, And Racial Equality: A Response To Professor Karlan, Christopher L. Eisgruber Mar 1997

Democracy, Majoritarianism, And Racial Equality: A Response To Professor Karlan, Christopher L. Eisgruber

Vanderbilt Law Review

Only with great trepidation do I undertake to comment upon Professor Karlan's fine Article.1 Much of what I know about voting rights law I have learned from her work, and her contribution to this Symposium is characteristically erudite, detailed, and cogent. I will therefore limit myself to offering four modest observations about her argument. My central point is simple: While Professor Karlan successfully identifies several empirical questions that critics of majority- black voting districts must answer, those same questions also raise problems for defenders of majority-black districts (including Professor Karlan herself).

Professor Karlan's argument is directed against what I shall …

Formal Neutrality In The Warren And Rehnquist Courts: Illusions Of Similarity, Rebecca L. Brown Mar 1997

Formal Neutrality In The Warren And Rehnquist Courts: Illusions Of Similarity, Rebecca L. Brown

Vanderbilt Law Review

I read recently that if one compares the genetic structure of humans to that of dogs, one finds that ninety-six percent of the DNA in the two species is identical. That is a lot of common ground. Yet it may not be enough to draw meaningful conclusions about the sameness of the two creatures. Without suggesting that either of the two Courts discussed in her Article is a "dog," I do think it is fair to say that Professor Sherry has perhaps underestimated the relative importance of the divergent four percent.

Professor Sherry argues that in the defining areas of …

Research Paper Youth Service, Douglas H. Stubbe Mar 1997

Research Paper Youth Service, Douglas H. Stubbe

Special Topics, General

An assumption that most people would probably agree on is that service to community, on a voluntary basis, builds character, self esteem, pride toward one's self and his/her community, develops personal growth and respect or compassion for others. I don't think many people look beyond that. Does the service need to be voluntary? Is service a responsibility that goes with being a part of a community? Why is service a positive aspect of community life? What are the characteristics of service that make it a fulfilling experience? Should youth be required to serve their community? If so, are there other …

Introduction: The Democratic Judge, Michael J. Gerhardt Mar 1997

Introduction: The Democratic Judge, Michael J. Gerhardt

Vanderbilt Law Review

It is a special privilege for me to return to this great law school to honor one of its greatest graduates. Each time I return to Nashville, it feels like a homecoming. Each time I return, I also feel that as I am getting older, Judge Merritt is getting younger. The last time I was here, he got married; and the time before that, we squared off for the umpteenth time on a tennis court. He also Writes more opinions, gives more speeches, and has taken more of a leadership role in protecting the interests of the federal judiciary than …

Rewarding Faculty Professional Service, Kerryann O’Meara Mar 1997

Rewarding Faculty Professional Service, Kerryann O’Meara

New England Resource Center for Higher Education Publications

Scholars of higher education have long recognized that existing reward systems and structures in academic communities do not weight faculty professional service as they do teaching and research. In the past five years, however, many colleges and universities have found innovative ways to define, document, and evaluate faculty professional service in traditional promotion and tenure systems. Other institutions have created or expanded alternate faculty reward systems, including faculty profiles in service, merit pay, and post-tenure reviews emphasizing service. Based on data from a nation-wide sample, this paper discusses innovations in rewarding faculty professional service and offers conclusions and recommendations.

Asian American Experiences: A View From The Other Side, Pill Jay Cho Mar 1997

Asian American Experiences: A View From The Other Side, Pill Jay Cho

The Journal of Sociology & Social Welfare

President Truman is said to have complained about his assistants for giving him advice "on the other hand" as well as the first one. He joked about his wish to find an advisor who has only one arm. As one of the two guest editors for the present special issue on Asian American Experience, I have been surprised by the fact that all manuscripts submitted discuss what I call "negative" side of the Asian American experiences.

Welfare Reform: The Positioning Of Academic Work, Carolyn I. Steele, Cynthia Wallat Mar 1997

Welfare Reform: The Positioning Of Academic Work, Carolyn I. Steele, Cynthia Wallat

The Qualitative Report

Current welfare reform legislation raises a number of questions about how the field of human services will broaden its analytical and educational functions in a context of uncertainty about what welfare will look like in the years to come. How can information and insights about the distribution of welfare dollars and the process of leaving welfare by a heterogeneous population of clients become the basis of contrastive analysis? We describe information sources which can provide a framework for positioning academic work to use longitudinal quantitative tracking sources to lay out qualitative inquiry suggestions for collecting process data that will emerge …

Categorizing, Coding, And Manipulating Qualitative Data Using The Wordperfect® Word Processor, John H. Carney, Joseph F. Joiner, Helen Tragou Mar 1997

Categorizing, Coding, And Manipulating Qualitative Data Using The Wordperfect® Word Processor, John H. Carney, Joseph F. Joiner, Helen Tragou

The Qualitative Report

In this paper, we present a method of categorizing, coding, and sorting/manipulating qualitative (descriptive) data using the capabilities of a commonly-used word processor: WordPerfect®. We explain the process and its development in simple terms for the person who may be familiar with qualitative research and data, but not with computer and/or word processor manipulation of that data. Although we developed the process to suit our methods, it can easily be adapted/evolved to fit different research situations where a method of rapidly handling large amounts of descriptive data is desirable.

The Proposal In Qualitative Research, Anthony W. Heath Mar 1997

The Proposal In Qualitative Research, Anthony W. Heath

The Qualitative Report

The purpose of "qualitative" or "naturalistic" research varies according to the research paradigm, methods, and assumptions. Generally speaking, qualitative researchers attempt to describe and interpret some human phenomenon, often in the words of selected individuals (the informants). These researchers try to be clear about their biases, presuppositions, and interpretations so that others (the stakeholders) can decide what they think about it all. Unlike conventional, positivist research, there is no single accepted outline for a qualitative research proposal or report (Morse, 1991). The generic outline that follows is suggested as a point of departure for qualitative research proposals, and it applies …

Surviving Ethnography: Coping With Isolation, Violence, And Anger, Jennifer Harris Mar 1997

Surviving Ethnography: Coping With Isolation, Violence, And Anger, Jennifer Harris

The Qualitative Report

This article concentrates upon the intensities of emotion experienced by a novice ethnographer. The argument is that acknowledging the emotional impact of events in the field enables the ethnographer to analyse reflexively the differences between the values of the self and those of the other. Seeing beyond the emotions generated at times of crisis can permit and facilitate an analysis of the everyday social relations between participants. Dealing with the personal impact of these emotions is an entirely different matter; very few others (supervisors, academics, peers) although well-intentioned, will appreciate the depths of these emotions and the problems that they …
