Why Mandatory Ioltas Should Be Eliminated, Dan Chern Oct 1997

Why Mandatory Ioltas Should Be Eliminated, Dan Chern

Texas Wesleyan Law Review

The First and Eleventh Circuits have held that clients have no property right in interest earned through the IOLTA program. Contrary to both holdings, the Fifth Circuit found that clients do have a property right in this interest. Indeed, the Fifth Circuit's opinion consists almost entirely of a critique of these two contrary holdings. Curiously, all three circuits rely on the same United States Supreme Court case, Webb's Fabulous Pharmacies, Inc. v. Beckwith. This Comment concludes that the Fifth Circuit correctly applied Webb's in holding that the owner of principal has a property right in the interest earned on that …

Taking Federalism Seriously: Lopez And The Partial-Birth Abortion Ban Act, Glenn Harlan Reynolds Oct 1997

Taking Federalism Seriously: Lopez And The Partial-Birth Abortion Ban Act, Glenn Harlan Reynolds

Scholarly Works

In United States v. Lopez, the United States Supreme Court struck down the federal Gun Free School Zones law as not within congressional power to regulate interstate commerce. This article examines post-Lopez jurisprudence regarding the permissible scope of federal criminal law. Analyzing a wide variety of federal criminal laws challenged in post-Lopez cases (including arson, robbery, gun possession, drugs, violence against women, and abortion clinic disruption), the article shows how courts have followed or evaded Lopez. Studying the proposed federal ban on partial birth abortions, the article suggests that the ban is not a lawful exercise of Congress' interstate commerce …

Two-Dimensional Spectral Analysis Of Mesospheric Airglow Image Data, F. J. Garcia, Michael J. Taylor, M. C. Kelley Oct 1997

Two-Dimensional Spectral Analysis Of Mesospheric Airglow Image Data, F. J. Garcia, Michael J. Taylor, M. C. Kelley

All Physics Faculty Publications

A technique to analyze short-period (<1 hour) gravity wave structure in all-sky images of the airglow emissions is described. The technique involves spatial calibration, star removal, geographic projection, regridding, and flat fielding of the data prior to the determination of the horizontal wave parameters (wavelength, velocity, and period), by use of standard two-dimensional Fourier analysis techniques. The method was developed to exploit the information that is now available with wide-field solid state imaging systems. This technique permits interactive and quantitative investigations of large, complex data sets. Such studies are important for investigating gravity wave characteristics, their interaction with the airglow emissions, and their geographic and seasonal variability. We study one event of this type here and present possible evidence of a nonlinear wave–wave interaction in the upper atmosphere.

Paul Franklin Grady (1900-1984) was one of those leaders whose contributions to accounting will remain the subject of intensive study for future guidance. The purpose of this paper is to examine Paul Grady's significant contributions to accounting and auditing and to take the reader into Grady's mind as he was writing his most influential works. Grady strongly believed that in order for accounting to gain respect in society, it must be based on solid principles. His works showed this conviction.

City Of Sherman V. Henry: Is The Texas Constitutional Right Of Privacy Still A Source Of Protection For Texas Citizens?, Shelly L. Skeen

Texas Wesleyan Law Review

Part I of this Note explores the Texas constitutional right of privacy and the right of privacy guaranteed by the United States Constitution as well as the relationship between the two. Part II reviews the facts in Henry, the Texas Supreme Court's decision, and concurrences of both Justice Owen and Justice Spector. Part III analyzes the court's reasoning in Henry and determines that the decision fails to safeguard the constitutional right of privacy guaranteed by the Texas Constitution. Part IV proposes two potential solutions available to Texas courts to protect police officers and other public employees from unreasonable intrusions into …
