Line Item Veto And The Tax Legislative Process: A Futile Effort At Deficit Reduction, But A Step Toward Tax Integrity, Gordon T. Butler

In this Article, Professor Butler considers the effect of the line item veto on the tax legislative process. The Article begins with a description of the development of the crises in the federal deficit and the efforts made by Congress to limit spending so as to balance the budget. In particular, it describes the Gramm, Rudman, Hollings Act and the Budget Enforcement Act of 1990 which attempted to impose structural restraints on new tax and spending legislation. When these efforts proved insufficient to balance the budget, Congress turned to the line item veto as an additional structural restraint. The Article …

Recent national events have forced the American public to discuss a subject once considered unthinkable-same-sex marriage. In 1996, the Hawaii Supreme Court decided Baehr v. Lewin, potentially paving the way to allow same-sex couples the right to legally marry in the state of Hawaii. In response to this possibility, Congress passed and the President signed the Defense of Marriage Act, which defines marriage in the U.S. Code in such a way as to deny federal recognition to these couples, and also grants the states the right to refuse to recognize same-sex marriages performed in Hawaii. There is a great deal of un-recovered stolen art, and a great deal of confusion within and among jurisdictions as to when the applicable statute of limitations for stolen art begins to run. Holistic legal reform in this area is long overdue. Recent proposals, responding to current practices in the art world, call for the adoption of an art theft registry to help effectuate the return of stolen art and provide efficiency in the marketplace. Horizontal Jurisprudence And Sex Discrimination, Jean Wegman Burns

In this Article, Professor Bums contrasts the vertical jurisprudential style of Title VII with the horizontal approaches found in other, unrelated areas of the law. She argues that Title VII's vertical, top-down development and testing are largely responsible for the law's failure to produce more concrete results or to settle the often acrimonious arguments on the subject of gender equality in the workplace. She advocates supplementing Title VII's onesize- fits-all set of rules with a bottom-up, horizontal approach to rulemaking and rule testing. Physician Assistant As Abortion Provider: Lessons From Vermont, New York, And Montana, Jennifer Templeton Schirmer

Women in the United States are currently facing a shortage of medical practitioners who perform legal abortions, which interferes with women's right to have safe, legal abortions. This Note proposes authorizing physician assistants to perform low risk, first trimester abortions to increase the provider pool. The Note examines the historical reasons that justified proscribing abortions performed by non-physicians and concludes that because of improved medical education the proscription is no longer justified. Many private offices, family planning clinics, and Health Maintenance Organizations depend on physician assistants to provide the bulk of services once provided exclusively by physicians. The international intellectual property system founded on the Paris and Berne Conventions in the late nineteenth century has been dominated by the patent and copyright paradigms, which articulate the legal protection of technological inventions and of literary and artistic works, respectively. Although this patent-copyright dichotomy was never as strictly observed abroad as in the United States, it nonetheless charted a relatively clear theoretical line of demarcation between legal incentives to create and the public interest in free competition. Despite persistent constitutional questions, United States administrative agencies have grown in influence during this century.' Much of this controversy has centered around Congress's ability to control the removal of administrative officials constitutionally. In an effort to retain control of administrative agencies and in recognition of the need to conduct certain adjudicative functions outside the executive's domain, Congress has sought to create some agencies free from presidential influence. In particular, Congress has focused on at- tempting to limit the President's power to remove administrative officials. Social Support (SS) has been shown to have an effect on health and well-being. Patients with the Human Immunodeficiency Virus (HIV) are particularly vulnerable to stigmatization which may effect SS. This study examined the SS networks of 155 gay men with HIV. It was hypothesized that (a) perceived SS differs according to stage of HIV-illness and time since diagnosis, (b) there are select factors that are associated with variations in perceived SS, and (c) level of SS is predictive of future functional capacity and mental health. Perhaps no area of public legislation generates as much controversy, or attracts as much rhetoric, as immigration. Immigration is perceived as the core of who we are as a nation. Legal norms governing the movement and migration of people across the borders of countries determine who is entitled to live in a country and ultimately who will control its resources. As a nation that values and guarantees religious freedom, the United States is often faced with questions regarding the public display of religious symbols. Such questions have arisen in a number of Supreme Court cases, involving both Establishment Clause and Free Exercise Clause issues. Since 1984, the Court has considered the constitutionality of the display of religious symbols such as a creche, a menorah, and a cross in public areas. The Court has also considered the constitutionality of Air Force regulations that prohibited a clinical psychologist from wearing a yarmulke.
