Conservatives, Liberals, Romantics: The Persistent Quest For Certainty In Constitutional Interpretation, Frederick Mark Gedicks Jan 1997

Conservatives, Liberals, Romantics: The Persistent Quest For Certainty In Constitutional Interpretation, Frederick Mark Gedicks

Faculty Scholarship

Despite their considerable ideological differences, "conservative originalists" such as Robert Bork and "progressive originalists" such as Michael Perry both divide the process of understanding into cognitive (or "objective") and normative (or "subjective") aspects. The determination of the original meaning of the Constitution is methodologically separated from the question how this predetermined meaning should be applied in a particular case. This places both conservative and progressive originalists squarely in the tradition of Romantic hermeneutics, which sought to overcome the uncertainty and imprecision of textual interpretation by developing a "science of interpretation" which purported to be as epistemologically reliable as the methods …

The Development Of Baseball Umpires' Uniforms, 1846-1996, Elizabeth K. Martin Jan 1997

The Development Of Baseball Umpires' Uniforms, 1846-1996, Elizabeth K. Martin

Open Access Master's Theses

Organized baseball games, from 1846 on, required the services of one or more umpires to enforce the rules of play. The umpire's formality of dress helped to establish his authority by distinguishing him from both the players and the spectators. Throughout the one hundred and fifty year period of this study the umpire remained one of the most formally and conservatively dressed men at the ball park.

For the first quarter-century of modern baseball, umpires were amateurs who wore their customary clothing when asked to officiate. This consisted of a frock coat, top hat, white linen and matched or contrasting-colored …

Waves Of Change: Women, Work, War, And Wedlock In Colonial Newport, Rhode Island, 1750-1775, Jonathan M. Beagle Jan 1997

Waves Of Change: Women, Work, War, And Wedlock In Colonial Newport, Rhode Island, 1750-1775, Jonathan M. Beagle

Open Access Master's Theses

The intent of this thesis is to explore connections between gender relations and the construction of a local discourse by which residents of late colonial Newport, Rhode Island, interpreted the coming American Revolution. Historians in recent years have documented a relationship between gender and the rhetoric of the Revolution and separately have linked the development of commercial economies to a desire for independence in the colonies. However, relatively unexplored are the possible connections between the nature of gender relations within the emergent economies and the appeal for independence.

The emergence of an urban economy in Newport dominated by commerce and …

The U.S. National Marine Sanctuary Program: Effectiveness Of Diver Education In The Florida Keys, Rebekah Resnick Padgett Jan 1997

The U.S. National Marine Sanctuary Program: Effectiveness Of Diver Education In The Florida Keys, Rebekah Resnick Padgett

Open Access Master's Theses

This thesis examines the educational program of the Florida Keys National Marine Sanctuary (FKNMS), and its effectiveness for divers and snorkelers. It was hypothesized that intended educational messages were not reaching divers and snorkelers at the sanctuary. Between late December 1996 and early January 1997, 194 surveys were conducted in person in the Key Largo region. Data was collected regarding the demographics of the divers and snorkelers and their purposes for coming to dive in the Keys. In particular, information was accumulated regarding whether they learned anything about the marine environment of the Florida Keys, what they learned, and how …

L'Industie Du Vin Français Et Ses Concurrents, Lecia Gordner '97

Julius Strandberg And "The Almost White Child", Hans J. Strandberg

The Bridge

Why did more than 50 million people leave Europe for the United States in the second part of the 19th century? To understand the largest migration in history you have to look to the hopelessly poor living conditions which many people in the Old World lived under. To people living in an overpopulated and underpaid. Europe the idea of going to America where nothing was impossible but where "everything" was possible was immensely attractive.

The Bridge

Father, Otto Christensen, was born in 1875 on a farm

that lay on the edge of the North Sea in Jutland, Denmark.

When he was four his mother died and his father remarried.

He spent his childhood tending sheep and cattle and playing

in the sand dunes and heather along the sea. He must have

spent much time dreaming his dreams.

Water Column Stratification And Mixing Events In Narragansett Bay During Winter And Spring, James Emery Andrews Jan 1997

Water Column Stratification And Mixing Events In Narragansett Bay During Winter And Spring, James Emery Andrews

Open Access Master's Theses

We deployed a buoy in the West Passage of Narragansett Bay, approximately one km east of Hope Island, within a bathymetric depression of approximately twice the surrounding water depth. The buoy contained an onboard logging computer and had three YSI-600 instruments, each capable of measuring temperature, salinity, dissolved oxygen, pH and pressure, logging at three different depths in the water column at a 20 minute sampling interval. The first deployment started on 6 January 1997 and lasted 18 days before problems required retrieving the buoy. Additionally, problems with the salinity sensors in this deployment made it impossible to use most …

Efficient, Effective Advocacy In The "Computer Age" Demands The Marriage Of The Work Product Doctrine To Computerized Litigation Databases, Cecilee Price-Huish

Computer Law Review and Technology Journal

The attorney-client relationship is one that often evolves over years of legal representation, which often results in the creation of close working relationships and the development of mutual trust. It is not unusual for an attorney or law firm to represent a client for a number of years, fulfilling many different functions as circumstances require. Within this context, a lawyer's roles may include counselor, mediator and litigator. In the age of the information superhighway, where business is increasingly conducted via computerized systems, it is commonplace for an attorney, during the course of lengthy legal representation, to rely heavily on computerized …

The Fate Of Childhood: Legal Models Of Childhood And Of The Parent-Child Relationship, Janet L. Dolgin Jan 1997

The Fate Of Childhood: Legal Models Of Childhood And Of The Parent-Child Relationship, Janet L. Dolgin

Hofstra Law Faculty Scholarship

This Article examines, in three parts, the transformation of childhood, and the law's complicated, rarely satisfying, often contradictory responses. In Part I, the Article describes a set of fundamental ideological shifts, during the past several decades, in understandings of the family in American society. In Part II, the Article outlines three distinct models through which, since the start of the twentieth century, the law has understood children and the parent-child relationship. The first model (the Traditional Model), though largely replaced by a second (the Transforming Traditional Model), continues to be invoked, primarily to justify the second. Though clearly generated from …

Substance Abuse At Ucc Drafting Sessions, Norman I. Silber

Hofstra Law Faculty Scholarship

A few substance abusers start down the road to addiction with a single reckless experiment. Such was the case of Professor "Doe", a consumer law specialist of my acquaintance. The entanglement of Professor Doe in the UCC drafting process began when he accepted what seemed like the harmless invitation of a friend to attend a single National Conference of Commissioners on Uniform State Laws ("NCCUSL") drafting session in1990. Session after session followed. Soon he found himself in a descending spiral-attending study groups, legislative task forces, and conference programs being held in strange cities to debate a new or revised provision …

Aggressive Enforcement Of Rights Involving Internet Abuses, William L. Lafuze, Valerie K. Friedrich Jan 1997

Aggressive Enforcement Of Rights Involving Internet Abuses, William L. Lafuze, Valerie K. Friedrich

Computer Law Review and Technology Journal

The information age, and particularly the development of the Internet and the World Wide Web, has enabled any individual with a personal computer to rapidly acquire information from, and disseminate information to, a worldwide base. Many unlawful activities, such as copyright infringement, may now be practiced in a new environment and manner. Due to several unique aspects of the Internet environment, traditional judicial remedies, such as monetary damages, are ineffectual. Consequently, violations of personal and property rights on the Internet present new challenges for the enforcement of such rights. More aggressive remedies, such as injunction of wrongful activities and impoundment …

The Prevention Of Non-Consensual Access To "Confidential" Health-Care Information In Cyberspace, Howard L. Steele Jr. Jan 1997

The Prevention Of Non-Consensual Access To "Confidential" Health-Care Information In Cyberspace, Howard L. Steele Jr.

Computer Law Review and Technology Journal

The latter half of the twentieth century has seen the decline of the industrial revolution and the rapid transition into an information explosion that has continued to expand at an exponential rate. Unlike the political upheavals of days gone by, this revolution appears to have the potential to dramatically change our society. For example, the advent of the computer and its application in the healthcare setting has changed the face of medicine. Today is a day of miracle drugs, laser surgeries, and telemedicine - all of which found their genesis in computers. Despite the clear advantages created by the ever-expanding …

Management And Discovery Of Electronically Stored Information, Lawrence R. Youst, Haejung Lisa Koh Jan 1997

Management And Discovery Of Electronically Stored Information, Lawrence R. Youst, Haejung Lisa Koh

Computer Law Review and Technology Journal

New technology continuously abuts the aged and tried legal principles set forth decades ago. With information creation at every user's personal computer, with access to instant communication through e-mail systems and with the wide-spread use of the Intemet, the legal standards for discovery of information must continually evolve. It is no longer sufficient for a party requesting discovery to seek paper alone. It is also no longer sufficient for a party responding to discovery to review paper files alone in an attempt to satisfy the discovery requests. As we continue to progress in this age of information, a hard copy …

Tacit Acceptance And Watchful Eyes: Beijing's Views About The U.S.-Rok Alliance, Fei-Ling Wang Dr.

Books, Monographs & Collaborative Studies

In October 1995, the Army War College's Strategic Studies Institute and the Institute for Far Eastern Studies of Kyungnam University, in partnership with the Defense Nuclear Agency and The Korea Society, hosted in Seoul, Korea, an international workshop on the U.S.-ROK Alliance. For nearly a half century, the security alliance between the ROK and the United States has deterred aggression, helped assure stability in Northeast Asia, and supported the ROK's political and economic emergence as one of the advanced democratic industrial countries of the world.

In this monograph, Professor Wang Fei-ling examines the future of the alliance from China's perspective. …
