MERC Publications

In 1995, the Metropolitan Educational Research Consortium (MERC) commissioned a study of alternative high school schedules to determine their effects on teaching strategies, teacher and student satisfaction, and student and school performance. Two previous papers emanating from this study reported the views of teachers and students regarding alternative schedules in twelve high schools utilizing different scheduling alternatives to address. Home Is Where The Brute Lives: Asylum Law And Gender-Based Claims Of Persecution, Anjana Bahl

Cardozo Journal of Equal Rights & Social Justice

The article argues that gender-based persecution should be recognized as a valid ground for asylum under the refugee definition, emphasizing the need to expand the interpretation of "particular social group" to include women facing persecution due to their gender. It highlights the challenges women face in meeting the legal standards for asylum, particularly under U.S. law, and advocates for a more inclusive framework to address gender-based violence and discrimination.

Some Cautions About Structural Overhaul Of The Federal Courts, Carl W. Tobias Jan 1997

Some Cautions About Structural Overhaul Of The Federal Courts, Carl W. Tobias

Law Faculty Publications

Once a Century: Time for a Structural Overhaul of the Federal Courts substantially improves understanding of the federal judicial system. Professor Martha Dragich first clearly describes the phenomena which she attributes to unprecedented increases in the number of appeals since the 1960s. The writer asserts that this "crisis of volume" has compromised "appellate justice" and made federal case law less "coherent." Because Professor Dragich finds that appeals courts' dual responsibilities to correct error in specific cases and to declare the law have also decreased justice and coherence, she proposes the creation of District Court Appellate Panels for correcting error and …

Some Realism About Federal Procedural Reform, Carl W. Tobias Jan 1997

Some Realism About Federal Procedural Reform, Carl W. Tobias

Law Faculty Publications

A New Confederacy? Disunionism in the Federal Courts is a thought-provoking tour de force about many ills that federal court observers believe plague the modem federal district courts. In Disunionism, Professor Paul Carrington paints a perceptive portrait of the troubling conditions that he asserts impede civil litigation in a number of districts, and he trenchantly criticizes district judges for their contributions to these circumstances while admonishing the Judicial Conference to sweep "our national courts clear of all local clutter."

Reassessing Fault Factors In No-Fault Divorce, Peter N. Swisher Jan 1997

Reassessing Fault Factors In No-Fault Divorce, Peter N. Swisher

Law Faculty Publications

The purpose of this article is not to "turn back the clock" through the rehabilitation of fault grounds as the sole means for securing a divorce in America. Rather, this article will explore the ways in which fault-based factors, when applied to serious or egregious marital misconduct that significantly contributes to the marital breakdown, may still be utilized in order to bring about enhanced social, economic, and legal protection to spouses on divorce, while concurrently establishing a greater sense of responsibility and accountability in marital relationships.

Civilizing Religion, Kurt T. Lash Jan 1997

Civilizing Religion, Kurt T. Lash

Law Faculty Publications

Is it appropriate to restrict abortion at any stage in pregnancy on the ground that human life is sacred? Should the public square be open to biblical arguments against homosexuality? Or, to frame the issue in a more scholarly fashion: What role may religious arguments play, if any, either in public debate about what political choices to make or as the private basis of a political choice? In his recent book, Religion in Politics: Constitutional and Moral Perspectives, Michael Perry addresses these questions as a matter of constitutional law and political morality. Perry has been down this road before, most …

Bringing The "Real World" To Advance Legal Research, Timothy L. Coggins

Law Faculty Publications

Nearly all U.S. law schools include an Advanced Legal Research course as an elective course for second and third-year students. The justification for the course is obvious, and proponents of advanced courses have succeeded easily in convincing law school curriculum committees to approve chem. Most Advanced Legal Research courses also use "real-world figures" (guest speakers) ro supplement and enhance the instruction provided by the professors of the courses.3 The experiences and current positions of rhe "real-world" speakers are diverse, including librarians, attorneys, publisher/vendor representatives, and government officials. This article discusses the reasons for using real-world figures in Advanced Legal Research …

Alternative Futures For The Region Of Camp Pendleton California U.S.A. Oak Grove Valley, Richard E. Toth

Environment and Society Faculty Publications

The U.5. Environmental Protection Agency's (EPA Science Advisory Board, in its report Reducing Risk: Priorities and Strategies for Environmental Protection (U.S. EPA, 1990), identified the highest priority environmental risks to the United States, based primarily on geographic extent and irreversibility of effects. Habitat modification and loss of species diversity were ranked at the highest level of ecological risk. Habitat and species diversity are tightly coupled; species diversity at a regional level cannot be maintained without maintaining quality habitat. The Science Advisory Board expressed the view shared by many ecologists that natural habitats and their associated assemblages of plants and animals …

Potential For Glufosinate As A Selective Herbicide For Red Rice Control In Bar-Transformed Rice., Sujatha Sankula Jan 1997

Potential For Glufosinate As A Selective Herbicide For Red Rice Control In Bar-Transformed Rice., Sujatha Sankula

LSU Historical Dissertations and Theses

A three year study was conducted to evaluate the herbicide glufosinate on BAR-transformed rice and on the weed red rice. Preliminary evaluations with 1.1 and 2.2 kg/ha glufosinate on the BAR-transformed Gulfmont and Koshihikari rice varieties showed that both were resistant, but there was more injury to Koshihikari. Glufosinate at 2.2 kg ai/ha injured BAR-transformed Gulfmont rice more when applied to the 1- to 2-leaf stage (23-26%) than when applied to 3- to 4-leaf (13-19%) plants. The damage was least with boot stage applications (3-14%). Phytotoxicity to BAR-transformed Gulfmont rice was greater when 2.2 kg/ha glufosinate was combined with 0.4 …

Lex Scripta Et Lex Non Scripta: Tensions Between Law And Language In Late Fourteenth-Century England And Its Literature., Susanne Sara Thomas Jan 1997

Lex Scripta Et Lex Non Scripta: Tensions Between Law And Language In Late Fourteenth-Century England And Its Literature., Susanne Sara Thomas

LSU Historical Dissertations and Theses

This work explores the connections between Middle English literature and transitions occurring within the English legal system. It focuses on the way Chaucer and the Gawain-poet negotiate the tension between the legal potency of the written word and the spoken word. As the common law contains an ongoing negotiation between written and unwritten forms of law, the dissertation discusses the function and significance of the tension between the lex scripta and the lex non scripta. It argues that the increasing displacement of oral and written language in the legal realm is a source of considerable cultural anxiety, and this anxiety …

An Integrated Model Predicting Smoking Stage Of Change Among A Sample Of Government-Insured And Indigent Medical Patients., Edwin Daniel Boudreaux Jan 1997

An Integrated Model Predicting Smoking Stage Of Change Among A Sample Of Government-Insured And Indigent Medical Patients., Edwin Daniel Boudreaux

LSU Historical Dissertations and Theses

This study found that an integrated model using variables from several psychosocial theories, including the theory of planned behavior, decisional balance theory, and self-efficacy theory, was successful in predicting smoking stage of change. Specifically, ever smokers with higher self-efficacy, higher ratings of the cons of smoking, and lower ratings of the pros were more ready to quit or had already quit. Additionally, those who rated smoking as less tempting and who reported having people in their support system who were supportive of their cessation were in later stages of change. These results point to the importance of assessing cognitions towards …

He is greatest remembered by his contributions to the industry of colored glass and the development of Tiffany Studios. Inspired by the colors in the stained glass windows of the twelfth and thirteenth century and by the lack of …

Theses and Dissertations

The primary objective of this research is to examine the relationship between the relaxation of Virginia's concealed weapon law, which became effective July 1, 1995, and three crime-related variables. Although there have been two major studies conducted in this area on a national basis, this research represents the first time a study has been conducted in Virginia. A secondary objective of this research is to examine relevant data to determine if this change in the law influenced the purchasing behavior of citizens regarding handguns and the issuance rate for concealed weapon permits.

An interrupted time-series design is employed in examining …
