Observation Of Direct Instruction Teaching Behaviors: Determining A Representative Sample Of Time For Supervision, N. E. Marchand-Martella, R. Martella, Benjamin Lignugaris / Kraft

Special Education and Rehabilitation Counseling Faculty Publications

The purpose of this study was to determine the optimal amount of time a supervisor needed to observe a teacher to obtain a representative sample of his teaching behaviors while Direct Instruction was provided. These data were gathered across two Direct Instruction programs—Spelling and Reading Mastery—presented by a teacher with over 10 years of Direct Instruction experience. A Direct Instruction observation instrument and rating form were used to gather and summarize these data across 3-, 6-, 9-, 12-, 15-, 18-, 21-, and 24-min observation sessions. Results indicated that although there were minor variations in the percentages of teacher behaviors and …

Will The Punishment Fit The Victims? The Case For Pre-Trial Disclosure, And The Uncharted Future Of Victim Impact Information In Capital Jury Sentencing, José F. Anderson

All Faculty Scholarship

The United States Supreme Court decision in Payne v. Tennessee, upholding the use of victim impact statements in capital jury sentencing proceedings, marked one of the most dramatic reversals of a precedent in the history of United States constitutional jurisprudence. The decision in Payne expressly overruled Booth v. Maryland decided only four years earlier. The Booth case rejected the use of victim impact statements in capital sentencing cases that involved juries. In Payne, the Supreme Court made it clear that victims were entitled to offer, and juries were permitted to consider, the effect that a "death eligible" homicide had on …

Breaking The Glass Border: Barriers To Global Careers For Women Managers, Catherine R. Smith, Leonie V. Still

Research outputs pre 2011

The identification and placement of managers who can meet the business challenges at both local and international level is critical to the success of a company's overseas operations. North American and British research shows that, while organisations may be prepared to promote women into their domestic managerial hierarchy, few women currently have access to international careers through expatriate management appointments. This report describes an investigation of the selection, placement and management development by Australian organisations of women for international managerial assignments. Interest in this topic arose from the outcomes of the Industry Task Force on Leadership and Management Skills (1995), …

Challenging Futures: The Career And Life Decisions Of Managerial And Professional Women In Their 50s, Leonie V. Still, Wendy Timms

Research outputs pre 2011

The Australian Institute of Management in Western Australia has for many years been very supportive of women in management, and in particular has encouraged the growth and development of our Women in Management Special Interest Group. The Institute has also played its small, but hopefully, significant role in helping to redress the gender imbalance in the management profession with the creation of its Excellence in Management Award for Women, which is now in its sixth year. This Award is significant in that it helps to clearly identify women who have excelled in their management career and it also provides some …

Does Time Make Ancient Good Uncouth?, John W. Reed

The somewhat arch title of my remarks, which I'll explain later, came to me at the end of December, when all forms of the media were filled with references to the fast approaching turn of the calendar when we shall greet a twenty-first century and a third millennium. Whether it comes in with the year 2000, as popularly believed, or, more properly, the year 2001, it will be a time for reflection, for taking stock of ourselves and our world. Predictably, we already are inundated with pronouncements from pundits and politicians, from scientists and seers, from philosophers and fools. I …

MS. PERLMUTTER: We have heard today about copyright in two different regions of the world, in Central and Eastern Europe' and in China. In recent years there has been an increasing convergence in the substance of national laws in different regions of the world. One of the major factors has been the TRIPs Agreement? I will focus on the current efforts toward implementing the TRIPs Agreement, and this will be a procedure-oriented talk.

Ucc Proposals Concerning Consumer Transactions, James J. White Jan 1997

Ucc Proposals Concerning Consumer Transactions, James J. White

Other Publications

Professor Grant Gilmore once suggested that farmers would like a two section law. Section one would state "It shall be against the law to refuse to lend money to a farmer." Section two would state "It shall be against the law to collect a debt from a farmer." In a similar vein one might state the iron rule of consumer law, namely "No right that has ever been granted to a consumer, however ill considered and unjustified, may thereafter be withdrawn." Believing that some of the proposals for consumer protection that have been added in Revised Article 9 are not …

The Interaction Of The Division Order And The Lease Royalty Clause., Laura H. Burney Jan 1997

The Interaction Of The Division Order And The Lease Royalty Clause., Laura H. Burney

St. Mary's Law Journal

Because lease royalty clauses, which establish the obligation of the lessee to pay royalties to the lessor, generally fail to include the details necessary to calculate a lessor’s royalty, lessee or third party purchasers historically have implemented a division order. An additional document in the payment process, the division order protects against a lessee or third party purchaser’s liability for conversion or failure to account properly. Recent court of appeals and Supreme Court of Texas opinions provide an analysis of the interaction of the lease royalty clause and the division order under Texas statutory and case law. The awkward wording …

The Prospects For Challenging U.S. Nuclear Weapons Policy In Light Of The World Court's Advisory Opinion On The Legality Of The Threat Or Use Of Such Weapons Comment., Stephen Gordon Jan 1997

The Prospects For Challenging U.S. Nuclear Weapons Policy In Light Of The World Court's Advisory Opinion On The Legality Of The Threat Or Use Of Such Weapons Comment., Stephen Gordon

St. Mary's Law Journal

In an opinion, the World Court concluded “the threat or use of nuclear weapons would generally be contrary to the rules of international law,” the only exception being “in an extreme circumstance of self-defense, where survival of a State is at stake.” The Court’s opinion could read as prohibiting the most common ways the United States incorporated nuclear weapons into its defense strategy. First, it may prevent the United States from using such weapons again legally. Second, if the opinion does not render using nuclear weapons illegal in all circumstances, it might prohibit the United States from ever being the …

Immigration Reform: Seeking The Right Reasons., Lamar Smith, Edward R. Grant Jan 1997

Immigration Reform: Seeking The Right Reasons., Lamar Smith, Edward R. Grant

St. Mary's Law Journal

The legacy of immigration to the United States permeates the debate over current immigration policy. Because our self-definition as a nation is at stake in this debate, the issue of immigration arouses our deepest sentiments regarding the communities in which we live. We do not need to search far back in our history to find examples of imprudent law-making. Both the 1924 and 1925 immigration laws were motivated in large part by purposes which eventually undermined the principles on which they rested. These acts serve as prime examples of how employing erroneous reasons to enact even well-intentioned laws can be …

Writing In The Margins: Brennan, Marshall, And The Inherent Weaknesses Of Liberal Judicial Decision-Making Essay., Donna F. Coltharp Jan 1997

Writing In The Margins: Brennan, Marshall, And The Inherent Weaknesses Of Liberal Judicial Decision-Making Essay., Donna F. Coltharp

St. Mary's Law Journal

From 1967, when Thurgood Marshall took his seat as Supreme Court Justice, until 1990, when William Brennan, Jr. vacated his seat, the two Justices formed one of the most consistent liberal voting blocs in the history of the Court. Both Justices were judicial activists who labored in the tradition of Legal Realism. Although both Brennan and Marshall recognized the interpretation and application of the law as purposeful exercises, they differed in their approach to the task. Marshall, for instance, appealed to social consensus stating that his views were supported by society. Furthermore, Marshall strongly believed that the Constitution is a …
