Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Articles
International refugee law is in crisis. Even as armed conflict and human rights abuse continue to force individuals and groups to flee their home countries, many governments are withdrawing from the legal duty to provide refugees with the protection they require. While governments proclaim a willingness to assist refugees as a matter of political discretion or humanitarian goodwill, they appear committed to a pattern of defensive strategies designed to avoid international legal responsibility toward involuntary migrants. Some see this shift away from a legal paradigm of refugee protection as a source for enhanced operational flexibility in the face of changed …

This part of From Newton's Sleep, published by Princeton University Press in 1995 and in a paperback edition in early 1997, is reprinted by permission of the publisher. From Newton's Sleep is a book on the legal form of thought and its meaning for science and religion. It consists of some two hundred and fifty self-contained pieces arranged in eight sections. In its form, the book is much like and is meant to be much like the material with which lawyers routinely deal. Here, Law Quadrangle Notes excerpts a piece that touches on a subject of lively debate today, among …

Reading Ella Cara Deloria's Waterlily For Cultured Speech, Gerry Philipsen, Eric Aoki, Theresa R. Castor, Lisa M. Coutu, Patricia Covarrubias, Lorelle Jabs, Melissa Kane, Michaela R. Winchatz
Iowa Journal of Communication
The authors discuss the use of a novel, Waterlily, by Ella Cara Deloria, for courses in communication studies. As a representation of the life and culture of Teton Dakotas in the time before substantial contact with European Americans, the novel reveals a distinctive outlook and system of practices with regard to communication. Thus it provides a striking counterpoint to assumptions commonly presented in courses in communication studies. An interpretive framework for examining such a novel, with particular reference to its portrayal of culturally distinctive ways of communicating, is presented and applied to Waterlily. Issues regarding the validity of …
The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz
The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz
Iowa Journal of Communication
This paper reviews modern scholarship on the Older Sophists that began in the early nineteenth-century. At this time, philosophers and philologists took important steps to salvage the Sophists from the obscurity of history. However, these scholars did so in a way that continued to confuse sophistic fragments and contributions. The tendency of these scholars to view the Sophists from the vantage point of disciplinary perspectives has colored subsequent scholarship, as evidenced in the concept of "sophistic rhetoric."
This essay, extending from the work of Edward Schiappa (1991a, 1991b), reviews (and critiques) the modern scholarship which constructs theories of "sophistic rhetoric." …

Serologic And Molecular Detection Of Granulocytic Ethrlichiosis In Rhode Island, Min-Tsung Yeh, Thomas N. Mather, Richard T. Coughlin, Cindy Gingrich-Baker, John W. Sumner, Robert F. Massung
Past Departments Faculty Publications (CELS)
A new indirect fluorescent-antibody (IFA) assay with antigen produced in vitro in the human promyelocytic leukemia cell line HL60 was used to identify the first recognized case of human granulocytic ehrlichiosis in Rhode Island. This IFA assay was used to detect granulocytic ehrlichiae in white-footed mice and in a dog inhabiting the area surrounding the patient’s residence. Host-seeking Ixodes scapularis ticks found in the same habitat also were infected. I. scapularis ticks collected from other locations were fed on dogs and New Zealand White rabbits to assess the competency of these species as hosts of granulocytotropic Ehrlichia. Tick-induced …

Duration Of Immunity To Reinfection With Tick-Transmitted Borrelia Burgdorferi In Naturally Infected Mice, Joseph Piesman, Marc C. Dolan, Christine M. Happ, Benjamin J. Luft, Sean E. Rooney, Thomas N. Mather, William T. Golde
Past Departments Faculty Publications (CELS)
The ability of naturally infected and cured mice to resist reinfection with tick-transmitted Borrelia burgdorferi was tested over a 1-year period. All of the mice were resistant to reinfection when they were challenged at 1.5 months after cure. The majority of animals were resistant to reinfection for up to 10.5 months after cure, but this resistance was lost at 1 year after cure. Both protected and unprotected animals showed a diverse array of antibodies on Western immunoblots. Protection was not associated with the killing of spirochetes in ticks, and naturally infected mice produced no antibodies to outer surface protein A …
Hardware Interfacing In The Broadcast Industry Using Simple Network Management Protocol (Snmp), Walter H. Schuller Jr.
Hardware Interfacing In The Broadcast Industry Using Simple Network Management Protocol (Snmp), Walter H. Schuller Jr.
UNF Graduate Theses and Dissertations
Communication between various broadcast equipment plays a major role in the daily operation of a typical broadcast facility. For example, editing equipment must interface with tape machines, production switchers must interface with font generators and video effect equipment, and satellite ground controllers must interface with satellite dishes and receivers. Communication between these devices may be a simple hardware handshake configuration or a more elaborate software based communications via serial or parallel interfacing. This thesis concerns itself with the software interfacing needed to allow various dissimilar types of equipment to communicate, and therefore, interface with each other. The use of Simple …

Akhnai, Daniel J.H. Greenwood
Hofstra Law Faculty Scholarship
In the Talmudic story of the Oven of Akhnai, Rabbi Eliezer - symbol of unchanging law and original intent - decides a disputed issue of law, supporting his claim with all the arguments in the world and then with miracles including a voice from the Author proclaiming his interpretation correct. Nonetheless, his interpretation is rejected.
The Akhnai story is a complicated commentary on the problems of democracy and justice, with insights into the majoritarian (and counter-majoritarian) difficulties, the status of ancient law, and the meaning of originalist interpretation. I draw out lessons for those who seek to create a single …
An Examination Of The Relationship Between First Grade Teachers' Theoretical Orientations Toward Reading Instruction And Their Classroom Instructional Practices, John Anthony Luciano
An Examination Of The Relationship Between First Grade Teachers' Theoretical Orientations Toward Reading Instruction And Their Classroom Instructional Practices, John Anthony Luciano
UNF Graduate Theses and Dissertations
This study examined the relationship between first grade teachers' theoretical orientations toward reading and their classroom instructional practices. The study, which was conducted in Duval County Florida, used the Theoretical Orientation to Reading Profile (DeFord, 1985) and the Luciano Reading Instruction Practices Survey to gather self-reported data from the 102 study participants.
The sample teachers reported the frequency with which they used 25 specific instructional practices to assist students in learning to read. Ten percent of the sample teachers were observed by the researcher for thirty minutes and their instructional practices were documented on a checklist which corresponded to the …
The Source Of International Legal Personality In The 21st Century, James E. Hickey Jr.
The Source Of International Legal Personality In The 21st Century, James E. Hickey Jr.
Hofstra Law Faculty Scholarship
The source of international legal personality in international relations in the twenty first century goes to the heart of international governance in at least two respects. First, it affects how local, regional and global communities of humans will be governed. Second, it shapes the manner in which that governance, whatever form it takes, will account to populations for its actions or failures to act.
An underlying issue raised by any inquiry into source is whether the assertion of international political identity by a non state entity should establish, without more, international legal personality as a matter of international law? If …
Alternatives To Marital Fault: Legislative And Judicial Experiments In Cultural Change, J. Herbie Difonzo
Alternatives To Marital Fault: Legislative And Judicial Experiments In Cultural Change, J. Herbie Difonzo
Hofstra Law Faculty Scholarship
This article focuses on the legal and cultural history of non-fault divorce alternatives, and examines both formal legal materials and popular periodicals in an effort to comprehend the evolution of the modern American divorce culture. Beginning in the 1920s, the concept of incompatibility resounded through popular psychology as well as jurisprudence. The expansion of the divorce ground of cruelty to include mental anguish was not an attempt to broaden divorce grounds, but rather an attempt to define the range of the existing cruelty principle in terms of the new psychological understanding. Divorces had infiltrated the burgeoning consumer culture, and the …
The Tax Lawyer’S Duty To The System, Linda Galler
The Tax Lawyer’S Duty To The System, Linda Galler
Hofstra Law Faculty Scholarship
Americans are losing faith in lawyers. An American Bar Association poll conducted during the O.J. Simpson criminal trial revealed a substantial erosion in the public's respect for criminal defense lawyers. One article reporting on the ABA poll asked, "Would it be surprising if, in the public mind, quality lawyering is coming to be equated with a Machiavellian disregard for the truth?" Indeed, trial lawyers and their ethics were the subject of caustic political rhetoric during the 1996 presidential campaign. Clearly, lawyers' ethics are under public scrutiny. It is thus particularly good timing for a new edition to Bernard Wolfman, James …

The Roles Of Harsh And Fluctuating Conditions In The Dynamics Of Cological Communities, P Chesson, Nancy J. Huntly
The Roles Of Harsh And Fluctuating Conditions In The Dynamics Of Cological Communities, P Chesson, Nancy J. Huntly
Biology Faculty Publications
Harsh conditions (e.g., mortality and stress) reduce population growth rates directly; secondarily, they may reduce the intensity of interactions between organisms. Near-exclusive focus on the secondary effect of these forms of harshness has led ecologists to believe that they reduce the importance of ecological interactions, such as competition, and favor coexistence of even ecologically very similar species. By examining both the costs and the benefits, we show that harshness alone does not lessen the importance of species interactions or limit their role in community structure. Species coexistence requires niche differences, and harshness does not in itself make coexistence more likely. …
