The Charter Dialogue Between Courts And Legislatures (Or Perhaps The Charter Of Rights Isn't Such A Bad Thing After All), Peter W. Hogg, Allison A. Bushell Jan 1997

The Charter Dialogue Between Courts And Legislatures (Or Perhaps The Charter Of Rights Isn't Such A Bad Thing After All), Peter W. Hogg, Allison A. Bushell

Osgoode Hall Law Journal

This article responds to the argument that judicial review of legislation under the Canadian Charter of Rights and Freedoms is illegitimate because it is undemocratic. The authors show that Charter cases nearly always can be, and often are, followed by new legislation that still accomplishes the same objectives as the legislation that was struck down. The effect of the Charter is rarely to block a legislative objective, but rather to influence the design of implementing legislation. Charter cases cause a public debate in which Charter-protected rights have a more prominent role than they would have if there had been no …

What's Law Got To Do With It?: The Protection Of Aboriginal Title In Canada, Patrick Macklem Jan 1997

What's Law Got To Do With It?: The Protection Of Aboriginal Title In Canada, Patrick Macklem

Osgoode Hall Law Journal

This essay presents and contrasts two narratives on the past and future of the law of Aboriginal title. The first narrative, drawn from the Final Report of the Royal Commission on Aboriginal Peoples, grounds the law of Aboriginal title in inter-societal norms that enabled the mutual coexistence of colonists and settlers in North America. It locates Aboriginal territorial dispossession in colonial policies and practices that failed to conform to the spirit of mutual coexistence, and calls on governments to provide Aboriginal people with lands and resources necessary for self-sufficiency. The counter-narrative describes the law of Aboriginal title as a relatively …

Practice And Fit In The Allocation Of The Resource Of Faculty Time: A Study Of Current And Preferred Scholarly Practice Of The Faculties Of Ten Theological Schools Affiliated With The Presbyterian Church (Usa), Roger Allen Nicholson

Theses and Dissertations

Faculties, deans, and trustees of theological schools affiliated with the Presbyterian Church (USA) were surveyed to determine current faculty practice; the practice preferred by faculty, deans. and trustees; the fit between current and preferred practice; and faculty practice and faculty preference difference according to categorical variables such as gender, race, and rank.

Seven variables defined faculty practice: workweek in hours, instruction, scholarship, service, advising, governance, and other. Scholarship was subdivided into three categories adapting Ernest Boyer’s multi-dimensional definition of scholarship: orginitive, applied, and teaching. Fit was defined in two ways: statistical fit and practical fit.

The reported workweek was comparable …

"With The Greatest Respect And Fidelity:" A Cherokee Vision Of The "Trust" Doctrine, David E. Wilkins Jan 1997

"With The Greatest Respect And Fidelity:" A Cherokee Vision Of The "Trust" Doctrine, David E. Wilkins

Jepson School of Leadership Studies articles, book chapters and other publications

The trust relationship is the conceptual/philosophical framework against which all relations between the federal government and indigenous groups are conducted. Yet despite the centrality of this concept, federal policymakers have no consistent or agreed upon definition of what the trust relationship actually entails. And, more importantly, indigenous conceptions of trust have rarely been assessed. This article analyzes and advances one tribe's—the Cherokee—perspective on trust. In focusing on how the Cherokee perceive trust, this section emphasizes that from an indigenous viewpoint the trust relationship embodies a complex and sophisticated understanding that both the tribe and the United States have reciprocal responsibilities …

Analysis And Comparison Of Title I Programs In Rural School Districts In Central Illinois, Rebecca K. Kuhn

Masters Theses

The purpose of this study was to analyze and compare Title I programs in small, rural school districts in Central Illinois. The reauthorization of the Elementary and Secondary Education Act, referred to as the Improving America's Schools Act of 1994, has been a significant factor in redesigning Title I programs. The new trend in Title I programming focuses on accountability for maximum student achievement rather than the traditional issues concerning fiscal record keeping and detailed documentation that money was used to supplement, rather than supplant, existing programs. The coordination of funding sources and programs is encouraged by the reauthorization to …
