The Author Effect After The "Death Of The Author": Copyright In A Postmodern Age, Elton Fukumoto Jul 1997

The Author Effect After The "Death Of The Author": Copyright In A Postmodern Age, Elton Fukumoto

Washington Law Review

Copyright law employs terms and concepts, such as "originality" and "authorship," which the Romantic movement developed. Post-structuralism and Postmodernism, influential intellectual and artistic trends, have attacked the "author" concept by undermining its philosophical foundations. But when Postmodem artists act in accordance with their anti-author beliefs, they expose themselves to liability for copyright infringement. Recent copyright cases illustrate the courts' not entirely satisfactory response to the artistic appropriation of previous works. This Comment suggests that the courts read a pastiche exception, broader than the current exception for parody, into the fair use defense for copyright infringement.

The Relationship Between Specified Dispositional And Cognitive Variables And Aids Related Health Behaviors, Robert Joseph Pellegrino Jul 1997

The Relationship Between Specified Dispositional And Cognitive Variables And Aids Related Health Behaviors, Robert Joseph Pellegrino

Doctoral Dissertations

The research presented here provides evidence for the use of dispositional psychological states within the Ordered Protection Motivation model. Specifically, the use of dispositional variables is supported when the threat is one related to health (such as AIDS). The study examined a sample of undergraduate students from Louisiana Tech University. Regression was used to determine if four dispositional variables (Health Locus of Control, Sexual Locus of Control, Narcissism, and Sociosexual Orientation) added explanatory power to the ordered protection motivation model.

This study is of particular interest to marketers who produce public service announcements. The objective of any public service campaign …

Community Support Program Staff Attitudes Toward Family Involvement With The Adult Who Has A Serious And Persistent Mental Illness, Timothy W. Himango Jul 1997

Community Support Program Staff Attitudes Toward Family Involvement With The Adult Who Has A Serious And Persistent Mental Illness, Timothy W. Himango

Theses and Graduate Projects

Research has shown that staff of mental health programs will blame family members for problems incurred by an adult member with a serious and persistent mental illness and therefore be excluded from invotvement in the adult's community support plan. Fifteen personal interviews of staff from four community support programs (CSP's) in Minnesota's Hennepin County were conducted, using a combination of a standardized open-ended question interview format and a S-point Likerttype scale. The CSP staff viewed family members as both positive and negative in their influence on the adult with a mental illness. Their decision was influenced by client self-determination, confidentiality, …

Bioethics Is The Language Of The Law, Carl E. Schneider Jul 1997

Bioethics Is The Language Of The Law, Carl E. Schneider

Law Quadrangle (formerly Law Quad Notes)

What happens when the language of the law becomes a vulgar tongue? What happens, more particularly, when parties to bioethical discourse are obliged to borrow in their daily controversies, the ideas, and even the language, peculiar to judicial proceedings? How suited are the habits, taste, and the language of the judicial magistrate to the political, and more particularly, the bioethical, questions of our time?

This article is based on one originally published in theHastings Center Report (24, No. 4, 1994): 16-22, "Bioethics in the Language of the Law." It will appear as part of a forthcoming book on the …

Dashing Consumer Hopes: Strict Products Liability And The Demise Of The Consumer Expectations Test, Rebecca Korzec Jul 1997

Dashing Consumer Hopes: Strict Products Liability And The Demise Of The Consumer Expectations Test, Rebecca Korzec

All Faculty Scholarship

The threshold issue in American products liability litigation is whether the product was defective at the time it left the manufacturer's control. Traditionally, courts and scholars define “defect” in three functional categories: manufacturing defects, design defects and marketing defects. American products liability doctrine employs two major tests to determine whether a "defect” exists: the seller-oriented risk-utility test and the buyer-oriented consumer expectations test. The Draft of the Restatement Third of Torts: Products Liability, like some American jurisdictions, rejects the “consumer expectations” test as an independent standard in defective warning and design cases. Ironically, this limitation of the use of the …

Workers' Compensation And The Compensability Of Attenuated Injuries: "One Man's Stress Is Another Man's Pleasure", Jack Pritchard

Mercer Law Review

The compensability of stroke-related deaths in workers' compensation cases is a hotly contested matter, and the compensability of strokes precipitated by so-called job-stress has run a dividing line between Georgia courts. This Article will provide the reader with the history of the law which gave rise to this particular issue and develop the controversy while determining the reasoning behind the opposing opinions. This Article will also provide the reader with some insight into the practical effects of a Georgia Supreme Court decision on this issue one way or another.

In order to aid the reader in a more complete understanding …
