Response: Between Economics And Sociology: The New Path Of Deterrence, Dan M. Kahan Aug 1997

Response: Between Economics And Sociology: The New Path Of Deterrence, Dan M. Kahan

Michigan Law Review

The explosive collision of economics and sociology has long illuminated the landscape of deterrence theory. It is a debate as hopeless as it is spectacular. Economics is practical but thin. Starting from the simple premise that individuals rationally maximize their utility, economics generates a robust schedule of prescriptions - from the appropriate size of criminal penalties,1 to the optimal form of criminal punishments, to the most efficient mix of private and public investments in deterrence. Yet it is the very economy of economics that ultimately subverts it: its account of human motivations is too simplistic to be believable, and it …

Deterrence's Difficulty, Neal Kumar Katyal Aug 1997

Deterrence's Difficulty, Neal Kumar Katyal

Michigan Law Review

We all crave simple elegance. Physicists since Einstein have been searching for a grand unified theory that will tie everything together in a simple model. Law professors have their own grand theories - law and economics's Coase Theorem and constitutional law's Originalism immediately spring to mind. Criminal law is no different, for the analogue is our faith in deterrence - the belief that increasing the penalty on an activity will mean that fewer people will perform it. This theory has much to commend it. After all, economists and shoppers have known for ages that a price increase in a good …

On-Call Time Under The Fair Labor Standards Act, Eric Phillips Aug 1997

On-Call Time Under The Fair Labor Standards Act, Eric Phillips

Michigan Law Review

Economic pressures, changing family structures, and technology have increasingly blurred the line between work time and personal time. The rise of independent contracting, the growing number of families in which both parents work, and the. expanding reach of computer networks, fax machines, pagers, and mobile telephones, to provide a few examples, have blurred the once-familiar distinction between work time and leisure time. This distinction is particularly unclear for on-call employees. An on-call employee is one who may be physically away from the workplace but who remains connected to it by telephone, beeper, computer, or radio, and who must respond to …

In most cases oral traditions are thousands of years old and have maintained their philosophical value. Prior to the establishment of Western education, narratives among indigenous people were used to teach and educate in the most formal sense. Today it serves as a credible and authentic source in Native American education and is weighted with the same importance that it has always had. The re-discovery of …

Effects Of Expert Statement Validity Assessment Testimony On Lay Evaluations Of Children's Statements, Marcus Choi Tye Aug 1997

Effects Of Expert Statement Validity Assessment Testimony On Lay Evaluations Of Children's Statements, Marcus Choi Tye

Theses and Dissertations

Research on memory and suggestibility in children continues to demonstrate circumstances under which children may not give accurate accounts of important events. In investigating and treating child sexual abuse, it is important to determine what has happened. Statement Validity Assessment is a witness credibility assessment technique developed by Udo Undeutsch which focuses on the reality of individual statements. It involves a special open-ended investigative interview, Criteria-Based Content Analysis, which searches for the presence of characteristics which indicate that a statement is based on an experienced event, and a Validity Checklist which examines alternate hypotheses. This technique has been widely used …

Programming Parameters For 5-To-8-Year-Old Children In 4-H, Scott D. Scheer Aug 1997

Programming Parameters For 5-To-8-Year-Old Children In 4-H, Scott D. Scheer

Journal of Extension

Many states today have 4-H programming for 5-to-8-year-olds, often called "Cloverbuds," "Cloverkids," or "4-H Prep." The need to develop clear, research-based information for use with Ohio's "Cloverbud" program led to the development of 10 fundamental parameters based upon preadolescents' needs as well as educational design research. The purpose of these parameters is to help 4-H Extension professionals make decisions regarding programming. They are consistent with the "K-3 Youth in 4-H: Guidelines for Programming" (National 5-8 Curriculum Task Force, 1991) and the National Association for the Education of Young Children's position statement on developmentally appropriate practice in the primary grades, serving …

Something To Move Mountains: The Book Of Mormon In Hugh Nibley's Correspondence, Boyd J. Petersen Jul 1997

Something To Move Mountains: The Book Of Mormon In Hugh Nibley's Correspondence, Boyd J. Petersen

Journal of Book of Mormon Studies

Hugh Nibley’s correspondence reveals a lifelong fascination with the Book of Mormon. This is significant for two reasons: First, Nibley has taken the book seriously longer than we have as a church, and second, the private Hugh Nibley is as devoted to the Book of Mormon as is the public man. Nibley’s interest in the book is threefold: he recognizes the striking similarities it shares with other ancient Near Eastern texts; acknowledges its witness to Joseph Smith’s divine calling; and, most importantly, perceives the relevance and accuracy of the book’s prophetic warnings. In his letters, Nibley also addresses criticism raised …

Rethinking The Nursing Paradigm: The Ethics Of Gatekeeping In American And British Nursing, David C. Grandy Jul 1997

Rethinking The Nursing Paradigm: The Ethics Of Gatekeeping In American And British Nursing, David C. Grandy

Honors Theses

In the British National Health Service (NHS), the general practice physician (GP) serves as gatekeeper to resources.1 In the United States, managed care physicians, who attempt to contain health care expenditures by establishing priorities and strictly regulating treatment accessibility, necessarily employ gatekeeping responsibilities in practice.2 However, both systems of health care generally overlook the potential contribution of nurses in identifying and implementing effective methods of resource allocation. The central focus of this thesis includes two primary assertions. First, I will argue that nurses currently function as gatekeepers both in England and the United States, and that the traditional nursing paradigm …

Staffing Up And Dropping Out: Unintended Consequences Of High Demand For Teachers, Mark Fetler Jul 1997

Staffing Up And Dropping Out: Unintended Consequences Of High Demand For Teachers, Mark Fetler

Education Policy Analysis Archives (EPAA)

Growing public school enrollment and the need to maintain or improve service to students has increased the demand for teachers, perhaps more rapidly than existing sources can accommodate. While some schools recruit well qualified teachers by offering higher salaries or better working conditions, others may satisfy their need for staff by relaxing hiring standards or assigning novice teachers to difficult classrooms. ...

The Impact Of The Duration Of Special Education On The Self-Concepts Of Students With Learning Disablities In General Education Settings, Theresa Horning Jul 1997

The Impact Of The Duration Of Special Education On The Self-Concepts Of Students With Learning Disablities In General Education Settings, Theresa Horning

Theses

This study was performed to determine whether the length of time students with learning disabilities received special education services correlated with their self-concepts. The Piers-Harris Children's Self-Concept Scale was given to 23 elementary school students who were classified as learning disabled according to New York State guidelines. These students ranged in age from eight to thirteen and were in grades three through six. They attended a small, rural, upstate New York school district and were included in general education classrooms for at least five months prior to the study. The results indicated that a correlation did not exist between the …

Assessment Of Aggression In Children: The Use Of Human Figure Drawings, Jennifer Underwood Jul 1997

Assessment Of Aggression In Children: The Use Of Human Figure Drawings, Jennifer Underwood

Theses

The purpose of this study was to assess the validity of six characteristics of drawings cited in the literature as indicators of aggression. The study was designed to compare the drawings of students to their rated behavior on the Aggression sub-scale of the Child Behavior Checklist-Youth Self Report form. It was hypothesized, based upon past research, that students who rated their behavior as aggressive would demonstrate a significant number of the aggressive characteristics in their drawings. One-hundred seventy, eighth grade students participated in this study by completing the checklist and drawing a person. The results obtained did not support the …
