International Commercial Transactions: 1996, Peter Winship Jan 1997

International Commercial Transactions: 1996, Peter Winship

Faculty Journal Articles and Book Chapters

The year 1996 was a quiet one in the world of international commercial law. The principal accomplishment was the adoption of a Model Law on Electronic Commerce, but progress was also made on several international secured transactions projects. The following survey focuses on these and other projects that touch on subject matter within the scope of the Uniform Commercial Code.' As in the past,2 the survey examines completed projects, pending projects, and proposed projects before the U.N. Commission on International Trade Law (UNCITRAL), the International Institute for the Unification of Private Law (UNIDROIT), and the Organization of American States (OAS).3 …

Comparing United States And New Zealand Legal Education: Are U.S. Law Schools Too Good?, Gregory S. Crespi

Faculty Journal Articles and Book Chapters

This Article offers a comparison of the legal education systems of the United States and New Zealand. While it was originally published in 1997 in the Vanderbilt Journal of Transnational Law, and has been largely overlooked in more recent years, it is germane to the current vigorous debate regarding what changes need to be made in American legal education. I highlight in this Article several significant differences between these two systems by contrasting their admissions policies, clinical programs, availability of "law-and-economics" electives, and staffing of required courses. Based on this analysis, I concluded that although American law schools were clearly …

Genetics, Iq, Determinism, And Torts: The Example Of Discovery In Lead Exposure Litigation, Jennifer Wriggins Jan 1997

Genetics, Iq, Determinism, And Torts: The Example Of Discovery In Lead Exposure Litigation, Jennifer Wriggins

Faculty Publications

This article discusses a disturbing development in tort litigation in which defendants use deterministic, genetics-based ideas about individuals and their families to undercut and deflect attention from personal injury claims. Lead exposure litigation involving cognitive injuries claimed on behalf of children who have ingested lead paint is the context of this development. The most extreme manifestation to date has been the efforts in several states to compel relatives of lead-exposed children (usually mothers) to have IQ and psychological testing, even though they are not parties to the litigation. Rule 35 of the Federal Rules of Civil Procedure and its state …

Public Perceptions Of Buildings Constructed Of Recycled Materials, Laura Michele Strauss

UNLV Retrospective Theses & Dissertations

The study presented herewith investigated public perceptions of buildings constructed of recycled materials. The three groups surveyed in the area of Las Vegas were the general public, Clark County School District construction management employees, and local architectural firms. Eight attributes of recycled building products were addressed in the survey, namely their availability, aesthetics, cost, maintenance, quality, health risks, life expectancy, and safety. Data collected from returned questionnaires were analyzed using the Statistical Package for the Social Sciences software package. Results indicate that: (1) the general public is largely unaware of the use of these products; (2) people in all three …

The Changing Face Of The Kgb, Julie Anderson

UNLV Retrospective Theses & Dissertations

The Changing Face of the KGB examines the contemporary structure and functions of the post-Soviet Russian security and intelligence services. The nature of the relationships of the domestic and foreign intelligence services to other power structures in Russia today are examined, including an evaluation of its espionage networks within Russia, Eastern Europe, and the "near abroad." Special attention is devoted to an analysis of the Russian foreign intelligence service's recruiting methods and the cases of Russian spies Aldrich Ames, Harold Nicholson, and Earl Pitts. Finally, the thesis examines the Russian intelligence services' resumption of training terrorists, particularly those affiliated with …

Reaction As Image: Comic Books And American Life, 1940-1955, William S. Bush Jan 1997

Reaction As Image: Comic Books And American Life, 1940-1955, William S. Bush

UNLV Retrospective Theses & Dissertations

The comic book became a mass medium during a series of defining moments in twentieth-century American history. By telling and retelling narratives of individual achievement during the Great Depression, and tales of patriotism during World War II, comic books gained a popular audience rivaling that of agenda-setting national periodicals such as Life or The Saturday Evening Post. In the first postwar decade, however, publishers experimented with themes of crime, horror, teen romance, and social satire in ways that provoked a wave of public hostility. Crusading psychiatrists, politicians, civic groups, and religious leaders led a campaign against the industry that revealed …

Capability Of Native Yucca Mountain Microorganisms To Corrode 1020 Carbon Steel, Patricia Russo Castro Jan 1997

Capability Of Native Yucca Mountain Microorganisms To Corrode 1020 Carbon Steel, Patricia Russo Castro

UNLV Retrospective Theses & Dissertations

This project addressed the ability of native Yucca Mountain bacterial isolates to corrode metal designated as the outer barrier for nuclear waste containment. Microorganisms implicated in microbially-influenced corrosion recovered from the deep subsurface at Yucca Mountain include iron-oxidizing, sulfate-reducing, and exopolymer-producing bacteria. Test systems composed of a 1020 carbon steel coupon immersed in soft agar or soft agar and ground rock were designed to evaluate the biofilm formation and corrosion capabilities of these microorganisms at elevated temperature. Results indicated that incubation at 50{dollar}\sp\circ{dollar}C decreased the ability of these microorganisms to corrode carbon steel immersed in soft agar. However, corrosion rates …

UNLV Retrospective Theses & Dissertations

This study examines different instructional formats for providing inservice education on classroom technology applications to elementary teachers. An intensive weekend workshop format was compared with a traditionally paced format for inservice education. Results are discussed in terms of measurable changes in teacher growth in the use of the applications and growth in the use of the applications with students. A secondary purpose was to determine if there was a relationship between learning styles and success in these two environments. Teachers' learning styles were identified using the Myers-Briggs Type Indicator. The results of the study indicate that intensive models of inservice …

Generation X: A Social Movement Toward Cynicism, Paula Gottula Miles Jan 1997

Generation X: A Social Movement Toward Cynicism, Paula Gottula Miles

UNLV Retrospective Theses & Dissertations

In the past twenty-five years Americans have shifted from modern values of reason, science, and progress, to postmodern values of cynicism and relativism. Due to the different social climate and the ubiquitous mass media, Generation Xers--those born between 1960 and 1980--are the first to be socialized from infancy to possess postmodern values. Because of this dramatic shift in values, Generation X can be viewed as an intellectual or cultural social movement, in the sense of a social movement being a collective change in values over time. This study examines the differing values of Generation X by comparing their values to …

The Vietnam War: A Comparison Of Interpretations, David Scott Morokoff Jan 1997

The Vietnam War: A Comparison Of Interpretations, David Scott Morokoff

UNLV Retrospective Theses & Dissertations

This thesis is based on a quantitative analysis of Time magazine's coverage of the Vietnam War. It demonstrates that Time held a pro-war bias in 1967, was neutral during 1968, and turned strongly against the war from 1969 through 1974. From mid-1969 on, some articles factually misrepresented what was happening in Vietnam in such a way as to promote the goals of the anti-war movement. If events admitted of both a pro-war and an anti-war interpretation Time published almost exclusively the anti-war view. By 1972, administration supporters had published a large body of verifiable evidence (summarized in chapter 3) demonstrating …

When Playing God: Concerning Artificial Reproduction, Christina Ann Brandom Sessa Jan 1997

When Playing God: Concerning Artificial Reproduction, Christina Ann Brandom Sessa

UNLV Retrospective Theses & Dissertations

This thesis is a discussion about new reproductive technologies and the ethical implications of those technologies. Until now, fetal personhood was the focus of pro-choice and pro-life groups battling about abortion versus women's rights. However, new reproductive technologies such as in vitro fertilization and cryopreservation further complicate the foundation upon which traditional abortion arguments are based. The focus of the argument should be shifted from fetal personhood to a more comprehensive argument for the respect of the sanctity of human life. This shift would force society to address the more crucial issues which have led us to abortion and new …

Simultaneous Measurement Of Monoaromatic Hydrocarbons And Dicarboxylic Acids In Ambient Air, Ngoc Khanh Tran Jan 1997

Simultaneous Measurement Of Monoaromatic Hydrocarbons And Dicarboxylic Acids In Ambient Air, Ngoc Khanh Tran

UNLV Retrospective Theses & Dissertations

Atmospheric aromatic hydrocarbons and dicarboxylic acids were measured simultaneously in this work. A method was developed for aromatic hydrocarbons: collection on Tenax and charcoal, thermal desorption, and gas chromatographic analysis. Another method was verified for diacids: collection on quartz filter, conversion to dibutylesters, and analysis by capillary gas chromatography; Results of aromatic hydrocarbon measurements show a very strong linear relation among all aromatic hydrocarbons, and a significant correlation between aromatic hydrocarbons and CO measured at a nearby location. This result strongly suggests that aromatic hydrocarbons originate from automobiles. After correcting for dilution effects by normalizing hydrocarbon concentrations by CO concentration, …

Redox Polymers For Cyanide Ion Decomposition, Yu Zhang Jan 1997

Redox Polymers For Cyanide Ion Decomposition, Yu Zhang

UNLV Retrospective Theses & Dissertations

Insoluble, macroporous styrene-divinylbenzene copolymers bearing redox N-alkyl-N-chlorosulfonamide functional groups were used for removal of cyanide from aqueous solutions. These resins contain active chlorine and show oxidative properties. The use of these resins for oxidation of cyanide to less or nontoxic compounds was investigated in aqueous media containing different concentrations of cyanide and different pH values. Examples of the use of these resins as a polymer-supported reagent for oxidation of cyanide under static and dynamic conditions were given. Active chlorine readily oxidizes cyanide to cyanate. The decomposition of cyanate was also studied. The two decomposition methods investigated were oxidation with redox …

Public Participation Program Development: An Analysis Of Public Participation In The Water Industry, Marcia Lynne Holmberg Jan 1997

Public Participation Program Development: An Analysis Of Public Participation In The Water Industry, Marcia Lynne Holmberg

UNLV Retrospective Theses & Dissertations

The field of public participation is a distinct, but yet unpolished facet within the public relations industry. While the purpose of and need for public participation are becoming increasingly clear, many remain unaware or unconvinced of its advantages. Likewise, even among those who endorse the necessity of public participation, its methods and strategies continue to be a mystery to most; One industry, in particular, that has recognized and embraced the benefits of conducting public participation is the water utility industry. The purpose of this thesis is to (1) crystallize the understanding of why public participation is a necessary and advantageous …

Political Corruption In Sub-Saharan Africa: A Comparative Assessment Of Kenya, Nigeria, And Zaire/Congo, Kennedy Geoffrey Ondieki

UNLV Retrospective Theses & Dissertations

Legally, politically, academically, and culturally, political corruption eludes clear, precise, and comprehensive definition. It is a universal phenomenon that afflicts every political system. It means different things to different people. It manifests itself in a variety of ways in both developed and developing countries. It is considered morally, economically, politically, and socially devastating. This thesis addresses the dynamics of political corruption in sub-Saharan Africa and explores some central and perplexing questions. How is it that one of the most serious problems in sub-Saharan Africa receives such limited attention despite its magnitude, pervasiveness, and consequences? Is political corruption a cultural characteristic …

The Relationship Between Media Exposure, Personal Experience And Education On The Public's Perceptions Of People With Disabilities: A Correlational Study, Melissa Lynn Reichley Jan 1997

The Relationship Between Media Exposure, Personal Experience And Education On The Public's Perceptions Of People With Disabilities: A Correlational Study, Melissa Lynn Reichley

UNLV Retrospective Theses & Dissertations

The Relationship Between Media Exposure, Personal Experience and Education on the Public's Perceptions of Disabilities seeks to determine whether there is any correlation between people's opinions about people with disabilities (PWDs), and their media consumption, education, and experience or contact with PWDs. The author compares such perceptions between respondents with and without disabilities. While research suggests nondisabled people view people with disabilities to varying degrees of negativity depending on the level and type of disability and accompanying social stigma attached, this researcher questions whether frequency of media exposure is having a positive influence on media consumers' perceptions of PWDs (which …

The Credibility Of News Photography In The Digital Age, Mara Evonne Vernon Jan 1997

The Credibility Of News Photography In The Digital Age, Mara Evonne Vernon

UNLV Retrospective Theses & Dissertations

Photographers have been manipulating photographs since photography's invention, but digital imaging technology presents photographers with unlimited possibilities. Digital imaging technology allows both simple and complex manipulations to be completed easily and quickly, unlike traditional techniques that are both difficult and time consuming. Additionally, detecting digital manipulation is virtually impossible, jeopardizing photography's referent to the original scene captured through the lens of a photographer's camera; A review of the literature demonstrated a need for research in relation to the media consumer because prior research focused on media practitioners and their tolerance or intolerance for digital manipulation practices. This thesis explores the …
