State Actions To Mitigate Drought: Lessons Learned, Donald A. Wilhite Jan 1997

State Actions To Mitigate Drought: Lessons Learned, Donald A. Wilhite

National Drought Mitigation Center: Faculty Publications

Drought has been a common feature in the United States during the past decade and has resulted in significant economic, social, and environmental impacts in virtually all parts of the nation. The purpose of this paper is two fold. First, the status of state drought planning is discussed to illustrate the significant increase in the number of states that have prepared response plans—from three states in 1982 to 27 in 1997. In addition, six states are now in various stages of plan development. Second, mitigative actions implemented by states in response to the series of severe drought years since 1986 …

Dbs-Based Education And The Role Of The Teacher, James Emal, Antonio Ruiz, Miriam J. Masullo

University of Nebraska-Lincoln Extension: Historical Materials

This paper describes how a broadcast education infrastructure can be used to access a digital library of K-12 content. Technical references to prior research and development done in support of this concept are provided. The main goal of this paper is to relate those concepts and technical developments to a solution that emphasizes the role of the teacher. The framework for this solution, EduPort/DBS, attempts to bring tools and technical options to bear on a system for education infrastructure.

Sifting Through The Wreckage Of Abc Reportage: Little Victories, Big Defeats & (And) Unbridled Media Arrogance, Clay Calvert

UC Law SF Communications and Entertainment Journal

This Article analyzes two recent high-profile cases involving investigative journalism by ABC News. It points out journalistic victories achieved in both cases that ultimately were overshadowed by other events. The Article also critiques the arrogance on the part of some journalists who flaunt generally applicable legal principles and cloak themselves in the First Amendment and the "right-to-know" justification for their actions. The author argues that journalists must provide both courts and the public with well reasoned explanations for their news gathering tactics if they want to expand the boundaries of First Amendment protection and boost journalistic credibility in the eyes …

Definite Confusion Over Likely Confusion, James W. Soong Jan 1997

Definite Confusion Over Likely Confusion, James W. Soong

UC Law SF Communications and Entertainment Journal

The U.S. circuit courts disagree on whether the likelihood of confusion determination in trademark law is a question of fact, law, or both. While the likelihood of confusion issue divides the circuits, scholarly commentary has been substantially uniform. Many legal commentators have argued that the likelihood of confusion determination should be deemed a question of fact for various reasons. In contrast, this Article proposes that the ultimate likelihood of confusion determination should be a question of law because of legal and policy considerations. This Article borrows the reasoning of recent Supreme Court precedent deciding that patent claim construction is a …

Reflections On A Gossamer Thread In The World Wide Web: Claims For Protection Of The Droit Moral Right Of Integrity In Digitally Distributed Works Of Authorship, Timothy E. Nielander Jan 1997

Reflections On A Gossamer Thread In The World Wide Web: Claims For Protection Of The Droit Moral Right Of Integrity In Digitally Distributed Works Of Authorship, Timothy E. Nielander

UC Law SF Communications and Entertainment Journal

The global distribution of digitized materials through the Internet creates new challenges for traditional copyright law. Protection for moral rights continues to be a subject of international contention because of the global and interactive nature of cyberspace. Moral rights contemplate highly personal control over creative expression even after the artist has obtained the economic benefit provided by copyright laws throughout the globe. This Article argues that policies predicated on the free flow of information and of creative works in international trade may diminish the capacity of artists to claim violations of a right of integrity in digitized reproductions of their …

Investigation Of Color Appearance Using The Psychophysical Method Of Adjustment And Complex Pictoral Images, Mark Fairchild, Karen Braun Jan 1997

Investigation Of Color Appearance Using The Psychophysical Method Of Adjustment And Complex Pictoral Images, Mark Fairchild, Karen Braun

Presentations and other scholarship

A technique was developed and tested for generating CRT image reproductions that matched the color-appearance of print originals. Five observers matched two scenes using a memory matching technique. Observers were able to produce accurate matches when originals and reproductions were viewed at the same white point. Observers matched the reproduction at 6500K to originals viewed at 9300K and at 3000K. These matches were compared to the predictions of various color appearance models using a paired-comparison technique in a second psychophysical experiment. The observermatched images were found to be equal or superior to all predictions of the models tested.

Family Context And Premarital Sexual Activity In Kinshasa, Zaire., Yanyi Kasongo Djamba Jan 1997

Family Context And Premarital Sexual Activity In Kinshasa, Zaire., Yanyi Kasongo Djamba

LSU Historical Dissertations and Theses

Studies on sexual behavior in Africa have shown that the proportion of women with premarital sexual experience is high, but the factors associated with premarital sexual behavior have not been clearly identified. This is partly due to the separation between theory and research. This study attempts to fill this gap by constructing a new conceptual framework in which hypotheses of rational adaptation, social disorganization, and patrilineal bias theories can be empirically tested. Based on a life history approach, the present framework emphasizes the role of three dimensions of family background in shaping individual behavior: financial capital, human capital, and social …

Academic Misconduct: Methods Of Influencing Undergraduates' Perceptions Of The Seriousness And Frequency Of Cheating., Betty Diane Baugh Sistrunk Jan 1997

Academic Misconduct: Methods Of Influencing Undergraduates' Perceptions Of The Seriousness And Frequency Of Cheating., Betty Diane Baugh Sistrunk

LSU Historical Dissertations and Theses

Academic misconduct is a problem that all institutions of higher education experience. Because few incidents are worthy of national attention, the media create the impression that cheating is rare. The truth is that, depending on the source, up to 75% of college students admit having cheated on exams, papers, and other academic activities. One approach to promoting ethical behavior on campus is a framework based on student development theories. William Kibler of Texas A&M University has created a comprehensive program which includes intervention strategies designed to promote an ethos that nurtures academic integrity. Two components in this plan are a …

Reinvigorating Autonomy: Freedom And Responsibility In The Supreme Court's First Amendment Jurisprudence, Christina E. Wells Jan 1997

Reinvigorating Autonomy: Freedom And Responsibility In The Supreme Court's First Amendment Jurisprudence, Christina E. Wells

Faculty Publications

Part I of this Article explores the conception of autonomy that scholars have generally attributed to the Court and discusses problems with that conception. Part II sets forth an alternative, Kantian conception of autonomy and discusses its implications for a system of laws regulating free expression. Part III analyzes the Court's free speech jurisprudence and its autonomy rationale. It specifically examines both the Court's distinction between content-based and content-neutral regulations of speech and its approach to low-value speech, demonstrating that they reflect a Kantian notion of autonomy. Finally, Part IV discusses the implications of Kantian autonomy for hate speech regulation, …

[Review Of] Clara E. Rodriguez, Ed. Latin Looks: Images Of Latinas And Latinos In The U.S. Media, Gabriel Haslip-Viera Jan 1997

[Review Of] Clara E. Rodriguez, Ed. Latin Looks: Images Of Latinas And Latinos In The U.S. Media, Gabriel Haslip-Viera

Ethnic Studies Review

The anthology Latin Looks is an important contribution to the literature on Latinos and their relationship to the mass media in the United States. It builds on the earlier work by Rosa Linda Fregoso, George Hadley-Garcia, Chon Noriega, Luis Reyes, Peter Ruble, Allen Woll, and others. The book focuses primarily on television and film; however, there is no discussion of the films produced in other countries, or the Spanish language films produced in the United States. The images that are developed in music, literature, or magazines are also not discussed, although there is an admission that these are an important …

Law And Order In Cyberspace: Washington Report, Nicholas W. Allard, David A. Kass Jan 1997

Law And Order In Cyberspace: Washington Report, Nicholas W. Allard, David A. Kass

UC Law SF Communications and Entertainment Journal

Electronic commerce in cyberspace faces an uncertain legal environment. In many instances the laws that will shape the future growth and development of electronic commerce have yet to be written. Gaps in the regulatory framework, and rules from other contexts that are made obsolete by cyberspace technology, promote chaotic market conditions and impede innovation. Today, business activity or interaction with people which employs 19th and 20th Century communication technology is governed by an array of civil and criminal laws. It is, however, not at all clear which existing legal rules do or ought to apply to markets in cyberspace. From …

Race As A Hiring/Casting Criterion: If Laurence Olivier Was Rejected For The Role Of Othello In Othello, Would He Have A Valid Title Vii Claim, Heekyung Esther Kim

UC Law SF Communications and Entertainment Journal

This Note analyzes whether an actor or actress has a cause of action against casting directors and/or producers under Title VII of the 1964 Civil Rights Act for employment discrimination based on race. The author discusses what constitutes a violation of the Act and the procedural requirements a plaintiff must comply with in order to establish a prima facie case of discrimination. This Note then addresses how the law does not effectively deal with the issue and how this inapplicability of the law affects employment opportunities for minority actors and actresses. The author proposes that currently, the only appropriate remedy …

The Quality Of First Amendment Speech, Randall P. Bezanson Jan 1997

The Quality Of First Amendment Speech, Randall P. Bezanson

UC Law SF Communications and Entertainment Journal

One of the core axioms of First Amendment jurisprudence is that the quality of speech-its goodness or badness from a literary, artistic, or aesthetic perspective, or its effectiveness in communicating to an audienceshould bear no relationship to its protection under the First Amendment. This Article analyzes the Supreme Court's First Amendment doctrine across a wide range of fields: political speech, obscenity, commercial advertising, misrepresentation, entertainment, literature and the arts, and humor. The author demonstrates that the Court regularly, although implicitly and perhaps unconsciously, employs various qualitative criteria in determining whether and to what extent speech is protected under the First …
