European Constitutionalism And Its Discontents, J.H.H. Weiler, Joel P. Trachtman Jan 1997

European Constitutionalism And Its Discontents, J.H.H. Weiler, Joel P. Trachtman

Northwestern Journal of International Law & Business

Traditionally, the European Community has been set apart from all other international organizations, as well as from states, and Euro- pean Community law has been distinguished from both international law and from domestic law. This was so because of the supposed unique internal structure and processes of the European Community. This "splendid isolation" is no longer viable. Increasingly in the .be- havior - and study - of other transnational organizations, polities or regimes, the European transnational experience has come to provide a model, a yardstick and a set of analytical and critical tools, and per- haps erroneously, a desideratum. While …

Science And International Regulatory Convergence, Jeffery Atik Jan 1997

Science And International Regulatory Convergence, Jeffery Atik

Northwestern Journal of International Law & Business

National regulation is frequently premised on scientific assump- tions; much of regulatory design is based on scientific findings. Con- sumer product, food and drug and workplace safety standards all depend on a scientific assessment of the risks faced by the public and of the efficacy of an adopted measure in addressing these risks. Build- ing codes, waste disposal protocols and mandated immunization of school children all proceed from the technical recommendations of the scientific community. In current Western society, a regulatory measure lacking a scien- tific basis will be subject to criticism and perhaps ridicule; it may be struck down …

Dispute Resolution As A Catalyst For Economic Integration And An Agent For Deepening Integration: Nafta And Mercosur?, Cherie O'Neal Taylor Jan 1997

Dispute Resolution As A Catalyst For Economic Integration And An Agent For Deepening Integration: Nafta And Mercosur?, Cherie O'Neal Taylor

Northwestern Journal of International Law & Business

An economic integration arrangement between nations cannot exist without the creation of the necessary institutions. Any free trade, customs union or common market agreement1 must have, at a minimum, political institutions and a dispute settlement mechanism. The political institutions are necessary to allow the countries to reach decisions about how to implement the treaty obligations and objec- tives and to oversee that implementation. The dispute settlement mechanism is needed to resolve disputes that may arise over the meaning and application of the agreement's legal obligations and objectives. A dispute settlement mechanism is crucial to the viability of an economic integration …

Assessing Apec's Role In Economic Integration In The Asia-Pacific Region, Merit E. Janow Jan 1997

Assessing Apec's Role In Economic Integration In The Asia-Pacific Region, Merit E. Janow

Northwestern Journal of International Law & Business

This article examines the Asia-Pacific Economic Cooperation (APEC) forum as a new institution to promote economic integration in the Asia-Pacific region. APEC does not lend itself to straightfor- ward definition. Formed only recently in 1989, APEC is currently comprised of 18 member "economies"1 and is organized around a set of intergovernmental meetings. Its very nomenclature, APEC, lacks a descriptive noun.2

Martial Lawlessness: The Legal Aftermath Of Kwangju, James M. West Jan 1997

Martial Lawlessness: The Legal Aftermath Of Kwangju, James M. West

Washington International Law Journal

On August 26, 1996, two former presidents of the Republic of Korea, Chun Doo-Hwan and Roh Tae-Woo, were convicted of insurrection, treason, and corruption. The charges arose out of their December 1979 coup and the ruthlessly violent suppression of a democratic protest in the city of Kwangju in May 1980. This article recounts the origins and analyzes the progress of this dramatic criminal trial, which has attracted worldwide attention. The current South Korean head of state, President Kim Young-Sam, has depicted the conviction of his predecessors as a historic juncture opening a new era of constitutionalism for Korea. Despite the …

Board And Director In Public Sector Enterprise, N Vittal Jan 1997

Board And Director In Public Sector Enterprise, N Vittal

IIMB Management Review

Is the board of directors the heart and soul of a company as it should be, ideally, or merely an 'old boy's club' which rubber stamps decisions taken by the CEO? Can it be a meaningful instrument of corporate governance? Various aspects such as the creation and running of an effective board, the difference between directing and managing, the interface between the board and the CEO, including the public sector perspective on the issue have been discussed by academicians and senior corporate executives.

Highlighting The Hidden: Visual Representation In Gutiérrez Aragón's Demonios En El Jardín, Linda M. Willem Jan 1997

Highlighting The Hidden: Visual Representation In Gutiérrez Aragón's Demonios En El Jardín, Linda M. Willem

Scholarship and Professional Work - LAS

According to Spanish film maker Manuel Gutiérrez Aragón, there is an intimate relationship between the family and the state, with the traits of the family mirroring those of the state in which it exists: "la primera célula del Estado es la familia, y si el Estado, por definición, es opresivo, la familia es igualmente opresiva" (García Fernández 331). "Yo utilizo la familia en mis películas porque es muy real, muy testimonial. La familia repite fielmente la estructura social 0 estatal" (Payán and López 27). In Demonios en el jardín (1982) Gutiérrez Aragón uses the metaphor of the family not only …

Public Opinion And The 1996 Elections In Russia: Nostalgic And Statist, Yet Pro-Market And Pro-Yeltsin, David S. Mason

Scholarship and Professional Work - LAS

Between 1991 and 1996 Russia underwent a precipitous economic and social decline with decreases in production, gross national product, and wages, and increases in inequality, crime, and corruption. Most people experienced a decline in their standard of living, and many fondly recalled the security and stability of the communist era.

Floristic Investigation Of Crooked Creek Community Of Juan Solomon Park, Indianapolis Indiana, Raelene M. Crandall, Rebecca W. Dolan

Scholarship and Professional Work - LAS

The protection of plant resources in urban areas is a growing conservation concern. Inventory activities that document species presence and stewardship plans that protect and enhance these areas are needed. The results of a botanical inventory of the Crooked Creek Community Juan Solomon Park in Indianapolis, Indiana, are reported in this paper. The 46-acre park contains three distinct habitats, supporting a wide variety of plants. One hundred seventy-nine vascular plant species from 64 families were identified, including 53 (29.6%) non-native species that are naturalizing within the park. Despite its high percentage of alien species and urban setting, the park is …

Galactic Black Hole Binaries: High-Energy Radiation, J E. Grove, J E. Grindlay, B A. Harmon, X M. Hua, D Kazanas, Mark L. Mcconnell Jan 1997

Galactic Black Hole Binaries: High-Energy Radiation, J E. Grove, J E. Grindlay, B A. Harmon, X M. Hua, D Kazanas, Mark L. Mcconnell

Space Science Center

Observations of galactic black hole candidates made by the instruments aboard the Compton GRO in the hard X-ray and γ-ray bands have significantly enhanced our knowledge of the phenomenology of the emission from these objects. Understanding these observations presents a formidable challenge to theoretical models of the accretion flow onto the compact object and of the physical mechanisms that generate high-energy radiation. Here we summarize the current state of observations and theoretical interpretation of the emission from black holecandidates above 20 keV. The all-sky monitoring capability of BATSE allows, for the first time, nearly continuous studies of the high-energy emission …

War.Com: Why The Battles Over Domain Names Will Never Cease, Deborah Howitt Jan 1997

War.Com: Why The Battles Over Domain Names Will Never Cease, Deborah Howitt

UC Law SF Communications and Entertainment Journal

In this Note, the author discusses the history of disputes over Internet domain names and presents potential solutions to the problem. The author reviews the International Ad Hoc Coalition's proposal for additional top-level domains, and concludes that new domains will not provide an adequate solution to disputes over domain names.

The author provides an overview of trademark law, including the Federal Trademark Dilution Act of 1995, which created a federal cause of action for trademark dilution. Although the addition of this cause of action has made it easier for trademark owners to prevent the use by others of "famous" marks …

Alternative Dispute Resolution And Emerging Online Technologies: Challenges And Opportunities, George H. Friedman Jan 1997

Alternative Dispute Resolution And Emerging Online Technologies: Challenges And Opportunities, George H. Friedman

UC Law SF Communications and Entertainment Journal

By all measures, 1995 was a watershed year for the so-called "Information Superhighway." In increasing numbers, individuals, governments, and businesses-including attorneys, their clients, and the courts-are enjoying the expanded use of the burgeoning information and services available on computer networks such as the Internet. As courts and lawyers moved online, it was only natural that the Information Superhighway would ultimately build an "on-ramp" for the alternative dispute resolution (ADR) movement. This indeed occurred late in 1995 with the creation of innovative online ADR projects, several World Wide Web sites related to ADR, and a rapid increase in the use of …
