Free Speech & The Internet: The Inevitable Move Toward Government Regulation, James J. Black Jan 1997

Free Speech & The Internet: The Inevitable Move Toward Government Regulation, James J. Black

Richmond Journal of Law & Technology

The explosive growth in the number of people communicating from computers around the world via the Internet ("Net") has led to the proliferation of another type of speech, namely, scholarly articles on virtually every aspect of the Net and its many influences on life in America. One topic that has received a great deal of attention is the extent to which laws applicable within the geographical territory of the United States may be applied to the freewheeling world of Cyberspace, which knows virtually no geographical limitations. Many commentators in the United States have followed one of two streams of argument: …

Culture Shock In The Basic Communication Course: A Case Study Of Malaysian Students, Eunkyong Lee Yook Jan 1997

Culture Shock In The Basic Communication Course: A Case Study Of Malaysian Students, Eunkyong Lee Yook

Basic Communication Course Annual

Malaysian students compose a large student group coming to the U.S. for higher education. Despite these numbers, however, there has been little attention given to their culture shock in the classroom. The present study investigates the concerns of Malaysian students in the basic communication course. Through interviews with Malaysian students, this study concludes that Malaysian students perceive having three major problems in presenting speeches in basic communication courses.

The first problem is the language barrier. Another is that certain nonverbal behaviors such as gesturing and talking in a loud tone are seen as disrespectful in their culture. Third, they have …

Reflections On Voices, Lynn Mcclelland Jan 1997

Reflections On Voices, Lynn Mcclelland

School of Psychology Theses

Voice hearing (auditory hallucinations) is associated with multiple problems : disturbed behaviour, anxiety, depression, social stigma, and suicide ( Siris 1991 , Barnes et al. 1989, Caldwell & Gottesman 1990). Traditionally voices are seen as a symptom of schizophrenia , psychosis, and mental illness, even though recent estimates of prevalence are 2-4% of the population (Siris 1990, Tien et al. 1993). This view has been challenged by research that has shown that there are many different experiences of voices, positive and negative, and that they are not confined to particular diagnoses or clinical populations (Romme & Escher 1989, Bentall 1990). …

Liturgical Traffic In Culture: Gridlock, Beginning Drivers, Detours, And Dui, Mark P. Bangert Jan 1997

Liturgical Traffic In Culture: Gridlock, Beginning Drivers, Detours, And Dui, Mark P. Bangert

Institute of Liturgical Studies Occasional Papers

(Excerpt)

In the Sunday New York Times from March 16, 1997 a short piece with accompanying picture offered a report on a weekly liturgy at St. Mark's Episcopal Cathedral in Seattle, a liturgy which is very popular with young people. Entitled "The Faithful Are Casual at This Sunday Service," the article concerns a forty-year tradition of doing sung compline in a space which is almost totally dark except for about fifteen male singers, bedecked in cassock and surplice, who stand dimly lighted at portable choir desks. Young people hurry to the 9:30p.m. service to sit in the pews, lie prone …

The Legal Construction Of Race: Mexican-Americans And Whiteness, George A. Martinez Jan 1997

The Legal Construction Of Race: Mexican-Americans And Whiteness, George A. Martinez

Faculty Journal Articles and Book Chapters

In light of the privileged status of whiteness and these important critical race projects, this essay seeks to examine a number of issues concerning Mexican-Americans and whiteness. In particular, this essay seeks to examine how legal actors - courts and others –constructed the race of Mexican-Americans. In this regard, the essay seeks to examine whether the law constructed Mexican-Americans as white and whether they received the benefits traditionally associated with whiteness. The essay also explores the importance of group definition and argues that an examination of whiteness and Mexican-Americans has implications for the affirmative action debate. The article also explores …

Amazight Identity In The Post Colonial Moroccan State: A Case Study In Ethnicity, Morag E. Boyd Jan 1997

Amazight Identity In The Post Colonial Moroccan State: A Case Study In Ethnicity, Morag E. Boyd

Honors Papers

This study will demonstrate that the Amazight are a distinct ethnic group in Morocco, despite the common interpretation in scholarly and everyday discourse that they are merely groups of people speaking one of the Amazight language and not representing a distinct cultural entity. The study will go on to examine the ramifications of this ethnic identity and the heritage of the historical and tribal roots of the Amazight in light of nationalism, state building, ethnicity, and cultural marginalization.

The 'Schizoid' Nature Of Modern Hebrew Linguistics: A Contact Language In Search Of A Genetic Past, Devon L. Strolovitch Jan 1997

The 'Schizoid' Nature Of Modern Hebrew Linguistics: A Contact Language In Search Of A Genetic Past, Devon L. Strolovitch

Honors Papers

This conflict in views is the main issue of this paper. It involves an enduring tension between synchrony and diachrony which has characterized almost all analysis of the Modern Hebrew revival. This tension has made Modern Hebrew, especially the spoken variety of native Israeli Jews, one of the most fascinating objects of study for both linguists and non-linguists, who have explored Modern Hebrew to express both highly conventional and highly unorthodox opinions regarding its character. Some consider it the direct descendent of an ongoing linguistic legacy, transcending certain principles of linguistic behavior (e.g. Tur-Sinai 1960). Others vehemently assert its autonomy …

Translating & Interpreting Foreign Statutes, Andrew N. Adler Jan 1997

Translating & Interpreting Foreign Statutes, Andrew N. Adler

Michigan Journal of International Law

This article aspires to address academics and anyone who must translate or interpret foreign statutes without previous in-depth education in the alien language and law. To make matters more interesting, the author concentrates on the plight of the minority of judges who want to arrive at independently reasoned interpretations of foreign law when given the opportunity. Most judges strive mightily to avoid even having to glance at foreign laws. And, when it becomes absolutely necessary to read a foreign code, most judges and litigators retain the centuries-old habit of relying too slavishly on tendentious expert testimony. Furthermore, while most states …

A Comparison Of Continuous Performance Tasks Using Cognitive Versus Sensory Stimuli, Nancy J. Reeve Jan 1997

A Comparison Of Continuous Performance Tasks Using Cognitive Versus Sensory Stimuli, Nancy J. Reeve

Open Access Master's Theses

A comparison of continuous performance tasks (CPTs) using cognitive versus sensory stimuli was undertaken to compare vigilance performance on analogous verbal and non-verbal tasks in normal, young adults. Eighty-nine introductory psychology students, screened for head injury, neurological deficits, and medication and substance use performed two versions of an auditory, computerized CPT. In the verbal task, stimuli were letters of the alphabet, whereas in the non-verbal task, they were tones of the major diatonic scale. During each 15 min task, 1200 stimuli were presented at an onset -to-onset time of0 .75 sec. A total of 100 targets was presented in semi-random …

Proposals To Address Germany's Status As A "Land Of Immigration", Anne M. Seibel Jan 1997

Proposals To Address Germany's Status As A "Land Of Immigration", Anne M. Seibel

Vanderbilt Journal of Transnational Law

International law permits each individual State to determine who under its laws are citizens of the nation. Germany's decision at the beginning of this century to adhere to the jus sanguinis model of citizenship continues to shape the country's immigration and citizenship laws. This model predicates citizenship on one's parents rather than one's place of birth. Accordingly, "ethnic Germans" who have returned to Germany since the end of the Cold War era are considered to possess a right to German citizenship. In contrast, naturalization procedures are rigorous for foreign residents, including guestworkers and asylum seekers, many of whom are long-time …

Aboriginality And English : Report To The Australian Research Council, Ian G. Malcolm, Marek M. Koscielecki Jan 1997

Aboriginality And English : Report To The Australian Research Council, Ian G. Malcolm, Marek M. Koscielecki

Research outputs pre 2011

The relation of aboriginality to English has important implications for communication between Aborigines and other Australians, and especially for the education of Aboriginal and other Australian children within a context of reconciliation.

The investigation of which this is the final report derives from the assumptions that Aboriginal English has been maintained at least in part because of its function' as a bearer of aboriginality and that, by exploring the nature of the distinctiveness of this dialect and the historical circumstances of its formation and ongoing development we may better understand how to provide appropriately for the communicative and educational needs …

Research outputs pre 2011

The three volumes which make up this study describe in detail how a number of teachers in different school situations in different parts of Australia undertook the assessment of young children's development of English as a second language. Most of the teachers worked in pre-primary to Year 3 classrooms where the majority of the children were aged between five and eight years. The majority worked in a mainstream context in which the number of children speaking English as a second language (ESL) varied from more than half the class to two or three students. About a third of the teachers …

Identifying Barriers To Computer-Supported Instruction., Ragina Melton Copeland Jan 1997

Identifying Barriers To Computer-Supported Instruction., Ragina Melton Copeland

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study was designed to determine if 1996 high school seniors who enrolled at West Virginia University at Parkersburg in the fall of 1996 were receiving equal educational opportunity with a focus on computer access and usage. The data collection consisted of two major parts: surveying the students in the 7-county service area of WVUP and interviewing at least 5 teachers or other professional staff from among each of the 11 schools located in 7 different counties. The findings of the study showed that students did not enjoy equal access to computers and computer instruction and that a combination of …

Goethe's Die Leiden Des Jungen Werthers: An Epistolary Novel, Or A Stage Drama In Disguise?, Ilona Klein Jan 1997

Goethe's Die Leiden Des Jungen Werthers: An Epistolary Novel, Or A Stage Drama In Disguise?, Ilona Klein

Faculty Publications

Photography of the late 1920s generated repercussions in other fields of the arts. It sparked an interdisciplinary interest in critics who balked at viewing the frozen images as merely one moment's reality, and who wanted, instead, to recompose and integrate underlying cultural, literary, or political discourse within the photographic frame. This fertile interdisciplinary backing guaranteed an in-depth interpretative dissection of artistic expression which had not been previously possible. The small photograph, a still visual image, became connected to the larger visual images of stage sets-these, a series of visual, immobile backgrounds which framed the caracters acting within.

La Science, La Science-Fiction Et La Mémoire Dans L'Œuvre De Primo Levi, Ilona Klein

Faculty Publications

(1997) Some Reflections On Inquiry, Community And Philosophy, Laurance J. Splitter Jan 1997

(1997) Some Reflections On Inquiry, Community And Philosophy, Laurance J. Splitter

Collected Papers of Laurance J. Splitter

Not all communities of inquiry are communities of philosophical inquiry. Still, there is something special and intrinsic about philosophy when it comes to the community of inquiry. Think of Matthew Lipman's oft-repeated claim that philosophy is the discipline that teaches children to think in the disciplines. And remember that one of his (and Dewey's) greatest insights was that children could be members of a community of inquiry. I should like to put these ideas together in the following way: irrespective of whether the inquiry engaged in by a community is philosophical, the community itself is philosophical. In short, every community …

The Use Of Facilitated Communication In Child Abuse Prosecutions, James Frederick Watson Jan 1997

The Use Of Facilitated Communication In Child Abuse Prosecutions, James Frederick Watson

University of Richmond Law Review

Before allowing a child who has alleged that he or she has been abused to testify at trial, a judge must be satisfied that the child is competent. In other words, the judge must find that the child has the ability to "observe, record, recollect and recount as well as an understanding of the duty to tell the truth." Determining whether children with certain developmental disorders are competent to testify has recently presented the courts with some difficult issues, as evidenced by a recent case in which the Supreme Court of Kansas upheld a conviction based primarily on the apparent …

Robinson V. Shell Oil Co.: Policy-Not Ambiguity-Drives The Supreme Court's Decision To Broaden Title Vii's Retaliation Coverage, Barry T. Meek

University of Richmond Law Review

Before the Supreme Court's pronouncement in Robinson v. Shell Oil Co., a majority of the circuit courts were blurring seemingly unambiguous language to expand Title VII's coverage to comport with amiable policy goals. Only policy justifications could explain the courts' willingness to cover postemployment retaliation based on language that prohibits an employer from discriminating "against his employees" and that further defines employees as those persons "employed by an employer." Clearly, the plain meaning of such language envisions that persons protected under Title VII have an existing employment relationship with the covered employer at the time of the alleged retaliatory conduct. …
