Why Mandatory Ioltas Should Be Eliminated, Dan Chern
Texas Wesleyan Law Review
The First and Eleventh Circuits have held that clients have no property right in interest earned through the IOLTA program. Contrary to both holdings, the Fifth Circuit found that clients do have a property right in this interest. Indeed, the Fifth Circuit's opinion consists almost entirely of a critique of these two contrary holdings. Curiously, all three circuits rely on the same United States Supreme Court case, Webb's Fabulous Pharmacies, Inc. v. Beckwith. This Comment concludes that the Fifth Circuit correctly applied Webb's in holding that the owner of principal has a property right in the interest earned on that …

Ioltas Unmasked: Legal Aid Programs' Funding Results In Taking Of Clients' Property, Kevin H. Douglas
Vanderbilt Law Review
States have implemented Interest on Lawyers' Trust Account programs ('IOLTAs")' to generate revenue for legal aid. IOLTAs raise money through the creation of an economy of scale by directing attorneys to place clients' trust funds that could not profitably draw interest in individual checking accounts into an unsegregated interest- bearing bank account ("IOLTA account"). By significantly reducing the expense that results from opening and maintaining separate accounts for individual clients, the IOLTA account profitably draws interest when individual client accounts could not. The interest generated from the IOLTA account is used to fund legal aid programs according to the specifications …

We Know Better Than We Do: A Policy Framework For Child Welfare Reform, Donald N. Duquette, Sandra K. Danzinger, Joan M. Abbey, Kristin S. Seefeldt
University of Michigan Journal of Law Reform
The need for comprehensive reform of child welfare policies and systems has long been evident. This Article reports observations from the WK Kellogg Foundation-sponsored Families for Kids Initiative that seeks to expand services and support to families and reduce the time children spend in temporary care. The authors first provide an overview of the need for reforms such as those proposed by this initiative, suggesting that many child welfare studies, critiques, and proposed reforms have had similar objectives. The authors highlight lessons learned from how these reform goals are being developed, implemented, and practiced in ongoing programs across the nation …
