Combining Multi-Attribute Utility And Geographic Information For Boundary Decisions: An Application To Park Planning, Jeffrey Keisler, Ronald Sundell Dec 1997

Combining Multi-Attribute Utility And Geographic Information For Boundary Decisions: An Application To Park Planning, Jeffrey Keisler, Ronald Sundell

Management Science and Information Systems Faculty Publication Series

The quality and value of an area depend primarily on what is found within its designated boundaries. To determine the value of such areas in terms of boundaries, we have developed a methodology for integrating multi-attribute utility functions with spatial analysis so that desirable, or appropriate, boundaries can be determined on the basis of the goals and objectives for the park. The key to successful evaluation is the development of measures for what decision makers value, rather than merely using what is easily measured. In a detailed example for planning of national parks, the fundamental objectives are conservation and societal …

Universal Service In The Schools: One Step Too Far?, Christine M. Mason Dec 1997

Universal Service In The Schools: One Step Too Far?, Christine M. Mason

Federal Communications Law Journal

Universal service is extended to include new recipients, such as schools, as a result of the Telecommunications Act of 1996. The FCC should proceed cautiously, and maintain its commitment to the traditional goal of universal service— Americans with basic telephone services— carrying out this new mandate.

All Wired Up: An Analysis Of The Fcc's Order To Internally Connect Schools, Roxana E. Cook Dec 1997

All Wired Up: An Analysis Of The Fcc's Order To Internally Connect Schools, Roxana E. Cook

Federal Communications Law Journal

The Telecommunications Act of 1996 extends universal service support to schools and libraries. Pursuant to this legislation, the FCC has provided all eligible schools with discounts of between twenty and ninety percent on telecommunications services, Internet access, and internal connections— to a 2.25 billion dollar annual cap. Critics have denounced the subsidy for internal connections as unsupported by the Act's language and outside the FCC's authority. However, based on a plain reading of the statute, on case law, and on legislative history, it is clear that the FCC properly exercised discretion in allocating the potential fund.

Puncturing Ability Of Bat Canine Teeth: The Tip, Patricia W. Freeman, William N. Weins Dec 1997

Puncturing Ability Of Bat Canine Teeth: The Tip, Patricia W. Freeman, William N. Weins

University of Nebraska State Museum: Mammalogy Papers

Casts of upper canine teeth of 15 species of microchiropteran bats were fixed securely into a testing machine and made to puncture the bloom side of an apple. The force necessary to break through the surface of the apple was regressed against both shape of the tip of the canine and the size of the animal. Sharper tips require less force to puncture than blunt ones. Results were also verified using giant two-dimensional models of Plexiglas™ with sharp and blunt tips that were loaded onto a Plexiglas™ beam. Fringes, or stress lines, are more highly concentrated at the point of …

The Equal Protection Clause: A Note On The (Non)Relationship Between Romer V. Evans And Hunter V. Erickson, Jay S. Bybee Dec 1997

The Equal Protection Clause: A Note On The (Non)Relationship Between Romer V. Evans And Hunter V. Erickson, Jay S. Bybee

William & Mary Bill of Rights Journal

In this Article, Professor Bybee uses the debate surrounding Romer v. Evans to reexamine the Supreme Court's decision in Hunter v. Erickson and the principle that a political majority may not restructure the political process to make it more difficult for a political minority to obtain favorable government action. Professor Bybee explains the questionable bases of Hunter and succeeding cases, and then turns to the Romer decision and discusses its incongruity with Hunter. After analyzing the meaning of Romer in light of Hunter and other "equal process" cases, Professor Bybee concludes that although the Court's analysis of Colorado's Amendment 2 …

Justice George Sutherland And Economic Liberty: Constitutional Conservatism And The Problem Of Factions, Samuel R. Olken Dec 1997

Justice George Sutherland And Economic Liberty: Constitutional Conservatism And The Problem Of Factions, Samuel R. Olken

William & Mary Bill of Rights Journal

Most scholars have viewed Justice George Sutherland as a conservative jurist who opposed government regulation because of his adherence to laissez-faire economics and Social Darwinism, or because of his devotion to natural rights. In this Article, Professor Olken analyzes these widely held misperceptions of Justice Sutherland's economic liberty jurisprudence, which was based not on socio-economic theory, but on historical experience and common law. Justice Sutherland, consistent with the judicial conservatism of the Lochner era, wanted to protect individual rights from the whims of political factions and changing democratic majorities. The Lochner era differentiation between government regulations enacted for the public …

Nothing And Everything: Race, Romer, And (Gay/Lesbian/Bisexual) Rights, Robert S. Chang, Jerome Mccristal Culp Jr. Dec 1997

Nothing And Everything: Race, Romer, And (Gay/Lesbian/Bisexual) Rights, Robert S. Chang, Jerome Mccristal Culp Jr.

William & Mary Bill of Rights Journal

In this Article, Professors Chang and Culp propose that the Supreme Court's decision in Romer v. Evans, viewed by some scholars as a progressive case about gay/lesbian/bisexual rights, has little to do with gay/lesbian/bisexual rights as such. They argue that whatever protection Romer provides to gays, lesbians, and bisexuals is provided not because of *their sexuality but, rather, despite it. The authors demonstrate their thesis by examining the racial underpinnings of the Court's opinion, which begins with Justice Harlan's famous dissent in Plessy v. Ferguson and which relies on a specific vision of color-blindness. This submerged racial jurisprudence provides the …

Local Data Assimilation In Specification Of Open Boundary Conditions, Igor Shulman Dec 1997

Local Data Assimilation In Specification Of Open Boundary Conditions, Igor Shulman

Faculty Publications

A data assimilation approach to specify open boundary conditions is proposed. The boundary values are determined from the solution of the special optimization problem: minimization of the difference between the model and reference boundary values under the integral constraints on the open boundary. These constraints represent the energy, momentum, and mass fluxes through the open boundary. Reference values represent the a priori knowledge about the boundary values. They might be derived from observations, results of another model run, or from another approach to the specification of open boundary conditions. Optimized open boundary conditions are presented in detail for the barotropic …

The Effect Of Data Model, System And Task Characteristics On User Query Performance – An Empirical Study, Hock Chan, Keng Siau, Kwok-Kee Wei Dec 1997

The Effect Of Data Model, System And Task Characteristics On User Query Performance – An Empirical Study, Hock Chan, Keng Siau, Kwok-Kee Wei

Research Collection School Of Computing and Information Systems

With the proliferation of end-user computing and empowerment of end users in the organizations, the user-database interface is increasingly being recognized as an important research area. A user-database interface consists of two key components: the data model and the query language. Database management system designers can manipulate these two components to produce an effective database interface to maximize user task performance. However, in order to do this, the designers first need to know the effect of the two components on end users and the interaction effect of the two components. Despite the acknowledgment of user-database interface as a cornerstone in …

The Evolution Of Character Education: From Hellfire And Brimstone To Constructivism, Arati Singh Dec 1997

The Evolution Of Character Education: From Hellfire And Brimstone To Constructivism, Arati Singh

Special Topics, General

Since colonial times, character education has played a kaleidoscopic role in American schools. Seventeenth and eighteenth century Puritan curriculum was synonymous with an exceedingly rigid and religious moral code. Nineteenth century policy makers adopted a Pan-Protestant, and then a generalized Christian philosophy of character education, as they pursued a common school system. As twentieth century American society grew increasingly pluralistic, the religious basis of character education succumbed to a more secular framework. Predictably, this century has seen character education be demoted to just one of many competing items on the national education agenda. Paradoxically, today's violence-filled headlines evince a more …

Workers' Compensation, H. Michael Bagley, Daniel C. Kniffen, John G. Blackmon Jr., Katherine D. Dixon

Mercer Law Review

The 1996-1997 survey period was an active one in the field of workers' compensation. Significant decisions were handed down in a number of areas that will significantly impact important parts of the workers' compensation system.

The first section of this Article reviews what, by comparison to previous years, was a relatively mild legislative session with regard to workers' compensation. The next two sections address important cases that affect the Drug-Free Workplace Act' and the defense of cases involving intoxication as well as important cases involving a claimant's burden of proof to show a change in condition. The remainder of the …

Sinusoidal-Gaussian Beams In Complex Optical Systems, Lee W. Casperson, Dennis G. Hall, Anthony A. Tovar Dec 1997

Sinusoidal-Gaussian Beams In Complex Optical Systems, Lee W. Casperson, Dennis G. Hall, Anthony A. Tovar

Electrical and Computer Engineering Faculty Publications and Presentations

Sinusoidal-Gaussian beam solutions are derived for the propagation of electromagnetic waves in free space and in media having at most quadratic transverse variations of the index of refraction and the gain or loss. The resulting expressions are also valid for propagation through other real and complex lens elements and systems that can be represented in terms of complex beam matrices. The solutions are in the form of sinusoidal functions of complex argument times a conventional Gaussian beam factor. In the limit of large Gaussian beam size, the sine and cosine factors of the beams are dominant and reduce to the …
