Free Speech In Cyberspace: Communications Decency And Beyond, Robert M. O'Neil
Free Speech In Cyberspace: Communications Decency And Beyond, Robert M. O'Neil
Richmond Journal of Law & Technology
It is a great honor to be this year's Emanuel Emroch Lecturer. Though I never had the privilege of knowing Mr. Emroch, I do feel on this occasion as though I were almost an honorary member of the Emroch family. And I am deeply grateful to that family for having continued a tradition which seems to me as fitting and as appropriate a memorial as one could imagine. It is a living memorial in the best sense and it gives those who gather in the name of the person being so honored a chance not only to carry on their …
Obtaining And Enforcing Trade Dress For Computer Graphical User Interfaces - A Practitioner's Guide, John P. Musone
Obtaining And Enforcing Trade Dress For Computer Graphical User Interfaces - A Practitioner's Guide, John P. Musone
Richmond Journal of Law & Technology
A computer program that successfully incorporates an intuitive graphical user interface possesses a tremendous competitive advantage over its competitors. Interface development accordingly has become a critical aspect of software development. Without legal protection, however, this advantage is illusory as competitors are otherwise free to copy unprotected interface features. Interface creators have predominately used copyright law to protect the overall "look and feel" of their interfaces. However, copyright protection for interfaces increasingly appears to be the exception rather than the rule.

Stream Organic Matter Budgets, J.R Webster, Judy L. Meyer
Stream Organic Matter Budgets, J.R Webster, Judy L. Meyer
Long Term Ecological Research Network
This analysis of organic matter dynamics in streams has 3 objectives: 1) to explore the relationships between physical characteristics of streams and their watersheds (climate, geomorphology) and steam organic matter dynamics using data from a broad geographic area; 2) to compare steam organic matter dynamics in a diverse array of steams in order to suggest determinants of observed patterns; and 3) to reveal deficiencies in currently available data on organic matter dynamics in steams. Streams were included in this analysis not to represent the global diversity of stream types but because organic matter data were available. In the introductory chapter …

The Interaction Of The Division Order And The Lease Royalty Clause, Laura H. Burney
The Interaction Of The Division Order And The Lease Royalty Clause, Laura H. Burney
Faculty Articles
Because lease royalty clauses, which establish the obligation of the lessee to pay royalties to the lessor, generally fail to include the details necessary to calculate a lessor’s royalty, lessee or third party purchasers historically have implemented a division order. An additional document in the payment process, the division order protects against a lessee or third party purchaser’s liability for conversion or failure to account properly.
Recent court of appeals and Supreme Court of Texas opinions provide an analysis of the interaction of the lease royalty clause and the division order under Texas statutory and case law. The awkward wording …
An Investigation Of The Relationship Between Popular Music And Analytic Cubist Paintings In Prewar Paris, Lulan Yu
Theses and Dissertations
This thesis addresses the connection between Analytic Cubist paintings and popular music culture in pre-World War I Paris. In particular, it focuses on popular music, performance, song lyrics, music iconography and its connected poster advertising as each relates to the Analytic Cubist paintings of Braque and Picasso. During the last years of the nineteenth century, the world of fine art came into close contact with the realm of popular entertainment, in particular institutions such as the cabaret, cafe'-concert and the music-hall. A revival of this performance which occurred around 1910, not only impacted the everyday world, but also the Cubist …

Until the turning point of the 1993 World Conference on Human Rights in Vienna, few issues received as little political attention at the United Nations as the human rights of women. Now, thanks to the efforts of non-governmental organizations (NGOs), academics, and other advocates, the Conference itself can claim the placement of women on the human rights agenda as one of its clearest victories. The weaknesses of the United Nations and of the international community as a whole {including states and NGOs) have been primarily in two areas: (a) at the conceptual level, their failure, until recently, to declare all …
Magnetic Field Decay In Single Radio Pulsars: A Statistical Study, Soma Mukherjee, Ajit Kembhavi
Magnetic Field Decay In Single Radio Pulsars: A Statistical Study, Soma Mukherjee, Ajit Kembhavi
Physics & Astronomy Faculty Publications
We report on an extensive statistical study of single radio pulsar properties, which we undertook to estimate the decay timescale of pulsar magnetic fields. We synthesized a population of pulsars using assumed theoretical distributions of age, initial magnetic field, period of rotation, position, luminosity, and dispersion measure, taking into account the new distance model for pulsars as well as new velocity estimates. We also took into account the selection effects that characterize pulsar observations. We compared the simulated population with the observed single pulsar population using one- and two-dimensional Kolmogorov-Smirnov tests to obtain a lower bound of ∼160 Myr on …

Solid-Phase Extraction Method For The Quantitative Analysis Of Organochlorine Pesticides In Wildlife Urine, E. E. Petty, J . J . Johnston, S.A. Volz
United States Department of Agriculture Wildlife Services: Staff Publications
A gas chromatographic method for the analysis of nine organochlorine pesticides in wildlife urine is described. Reversedphase solid-phase extraction is utilized to extract the organochlorine pesticides from urine. The pesticides are recovered by elution with hexane-ethyl ether (1:1) and quantified by gas chromatography with electron-capture detection. Method detection limits range from 1.4 to 2.7 μg/L. Mean recoveries for all pesticides are 90.6%.

The Passive Virtues And The World Court: Pro-Dialogic Abstention By The International Court Of Justice, Antonio F. Perez
The Passive Virtues And The World Court: Pro-Dialogic Abstention By The International Court Of Justice, Antonio F. Perez
Scholarly Articles
Only a few years ago the International Court of Justiceseemed to be edging toward judicial activism. This article argues that in its most recent pronouncements the ICJ has instead employed a variety of techniques for abstention. The ICJ's use of this "arsenal of devices" recalls, however, Alexander Bickel's argument for the exercise of judicial restraint by the U.S. Supreme Court in a way that nonetheless allows the judicial organ to stimulate constitutional politics. In the recent contentious cases and advisory opinions concerning the status of East Timor, exploitation of the natural resources of Nauru, and a trilogy of nuclear testing …
