What Is Eleventh Amendment Immunity?, Carlos Manuel Vázquez Jan 1997

What Is Eleventh Amendment Immunity?, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

The Supreme Court's Eleventh Amendment decisions give conflicting signals about what the Amendment does. On one view, the Amendment functions as a forum-allocation principle--immunizing states from liability in suits filed in federal court, but leaving open the possibility that states may be compelled to entertain suits against themselves in their own courts. A separate line of cases, however, implies that state courts enjoy an immunity from suit in their own courts and that nothing in the Constitution withdraws such immunity; on this view, the Eleventh Amendment, by protecting the states from suit in the federal courts, effectively immunizes the states …

Commentary, At Issue – House Rules: Is A Supermajority Requirement For Tax Hikes Constitutional? – No, The Framers Had Only A Simple Majority In Mind, Susan Low Bloch Jan 1997

Commentary, At Issue – House Rules: Is A Supermajority Requirement For Tax Hikes Constitutional? – No, The Framers Had Only A Simple Majority In Mind, Susan Low Bloch

Georgetown Law Faculty Publications and Other Works

The supermajority requirement undermines the constitutional principles of Article I and separation of powers. Rule XXI is not merely a rule of internal procedure; it determines when bills get presented to the Senate and the president.

Role Of Personal Values In Professional Decisionmaking, The , Bruce A. Green Jan 1997

Role Of Personal Values In Professional Decisionmaking, The , Bruce A. Green

Faculty Scholarship

The 1908 Canons of Professional Ethics directed a lawyer to "obey his own conscience."' Lawyers receive similar advice today. Writings on legal practice encourage lawyers to make professional decisions based on their moral values and religious beliefs, as expressed in the familiar injunction: to be charted by one's own "moral compass." Underlying this advice is an assumption about the professional norms - namely, that they accommodate, if not contemplate, lawyers' reliance on personal values. This assumption finds some support in the contemporary codes of lawyer conduct, which acknowledge a role for the lawyer's "conscience" or "moral judgment." Yet, it is …

Legal Fictions: Copyright, Fan Fiction, And A New Common Law, Rebecca Tushnet Jan 1997

Legal Fictions: Copyright, Fan Fiction, And A New Common Law, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

A girl owns a number of Barbie dolls. She makes outfits for them and constructs elaborate scenarios in which they play starring roles. She enacts her dramas in her front yard, where passers-by can easily see. Does she violate the law? What if the girl writes down her stories starring Barbie? What happens when she lets her friends read them? What if she e-mails those stories to a Barbie mailing list? What if she posts those stories and a picture of Barbie in her new outfit on her Web page?

Copyright law has long been a concern more for corporations …

What Trina Taught Me: Reflections On Mediation, Inequality, Teaching And Life, Carrie Menkel-Meadow Jan 1997

What Trina Taught Me: Reflections On Mediation, Inequality, Teaching And Life, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

Trina Grillo and I trained together as mediators, met together as law teachers, commiserated together as women and civil rights activists, and laughed and cried together as friends. I shall miss her wise counsel, her sensible judgment, her measured indignation, her gentleness and her razor sharp perceptions about the world, across, through and with her gender, race, class, and human identities. I shall miss her words, her presence, her body, her corporeal essence, but she will always be with me and my students in her spirit and through her contributions to our work. In this Essay I want to reflect …

The Organizational Client: Attorney-Client Privilege And The No-Contract Rule, Sherman L. Cohn Jan 1997

The Organizational Client: Attorney-Client Privilege And The No-Contract Rule, Sherman L. Cohn

Georgetown Law Faculty Publications and Other Works

A basic issue in the law governing lawyers is the identification of an attorney's client. Various duties, obligations, and rights arise from the attorney-client relationship. In the case of the individual who is a client, the answer is relatively easy. But in the case of the organizational client, the issue becomes more complex and the answers still are evolving. Indeed, the answer may differ depending on the legal context in which the question is asked and on the individual values being served.

Dedicatory Essay: Honoring Ian Mccoll Kennedy, Lawrence O. Gostin Jan 1997

Dedicatory Essay: Honoring Ian Mccoll Kennedy, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

Ian Kennedy is perhaps the best known and most important figure in health law and ethics in the United Kingdom, and probably one of the most significant in Europe and North America. How did his life and career evolve to the point where he would wield such influence? This essay examines the leadership, erudition, and passion Ian Kennedy has brought to the field of health law and ethics. It is perhaps not an overstatement to suggest that Professor Kennedy virtually invented the field in the United Kingdom. He did so through his scholarship, public advocacy, and influence in shaping institutions, …

Advocacy Scholarship And Affirmative Action, Charles F. Abernathy Jan 1997

Advocacy Scholarship And Affirmative Action, Charles F. Abernathy

Georgetown Law Faculty Publications and Other Works

The books, The New Color Line by Paul Craig Roberts and Lawrence M. Stratton, and We Won't Go Back by Charles R. Lawrence III and Mari J. Matsuda, debate the problem of reform and overreaching in tough, advocacy-oriented prose. The first argues that racial reform was necessary but has gone too far-has even become morally self-corrupting-by its adoption of quotas and affirmative action. The second argues that racial reform was necessary and that we need more, not less affirmative action, and not only for blacks, but for women, Asian-Americans, Chicanos, poor people, and generally all "subordinated classes." Its title, therefore, …

The Use Of Information Technology In Aquaculture Management, Omar F. El-Gayar

Research & Publications

The recent advances in information technology (IT) have had profound impacts on all walks of life and aquaculture is no exception. The growing importance of aquaculture as an alternative source of protein has further emphasized the need to adapt and develop advanced IT for the better management of aquaculture facilities as well as the regional planning for aquaculture development. It is the objective of this paper to review the use and potential prospects of IT in aquaculture management. The information technologies considered are instrumentation and process control, data management, computerized models, decision support systems, artificial intelligence and expert systems, image …

Crime, Community Penalty And Integration With Legal Formalism In The South Pacific, Mark Findlay Jan 1997

Crime, Community Penalty And Integration With Legal Formalism In The South Pacific, Mark Findlay

Research Collection Yong Pung How School Of Law

The influence of introduced legality on prevailing culture, and vice versa, are common concerns for analysis when considering the existence and development of customary law. Much of the limited writing on law and custom prefers to speculate on the impact of introduced law on already present modes of regulation. While recognising these structuralist contexts of influence, often oversimplified as they are represented, this paper prefers to explore the adaptation of legal formalism in contexts of resilient and resonant custom.Further, the paper examines instances where despite the fact that custom has modified institutional legality, the latter claims predominance over culture or …

Comment On 'Profits Derived From Breach Of Contract Or Restitution', Howard Hunter Jan 1997

Comment On 'Profits Derived From Breach Of Contract Or Restitution', Howard Hunter

Research Collection Yong Pung How School Of Law

There is little with which to disagree in Professor Waddams' paper on the categorisation of damage recoveries in the cases posited, viz, those involving a breach which results in benefit to the breaching party but no loss of any consequence to the nonbreaching party. If the goal of contract remedies is to compensate the plaintiff for loss, then, presumably, there should be no recovery at all in such cases. At most there might be nominal damages to compensate for some transaction costs or perhaps as a ’declaration of rights’. In some of the cases considered by Waddams, breach might be …

A Small-Angle Neutron Scattering Study Of Γ-Crystallins Near Their Isoelectric Point, Paul Petitt, Michael Eugene Edwards, Daniel Forciniti Jan 1997

A Small-Angle Neutron Scattering Study Of Γ-Crystallins Near Their Isoelectric Point, Paul Petitt, Michael Eugene Edwards, Daniel Forciniti

Chemical and Biochemical Engineering Faculty Research & Creative Works

In this paper, a small-angle neutron scattering study of γII-crystallins near their isoelectric point is presented. The experiments were carried out using protein concentrations of 5.7-85.7 mg/ml at temperatures in the range 11-60°C. The experimental data were analyzed using an ellipsoidal model for intraparticle correlations and the mean spherical approximation for interparticle correlations. Our studies revealed that γII-crystallins have a thick hydration layer, which is possibly due to the special arrangement of polar and ionic groups on their surface. The temperature scan shows that, as a result of relatively strong attractive forces, clusters of two, three, or higher oligomers are …

Integrated Queries To Existing Bibliographic And Structured Databases, Ee Peng Lim, Ying Lu Jan 1997

Integrated Queries To Existing Bibliographic And Structured Databases, Ee Peng Lim, Ying Lu

Research Collection School Of Computing and Information Systems

It is widely accepted that future digital library applications have to be built upon different kinds of database servers to draw upon different forms of data, including bibliographic, text, multimedia, and structured data. In this paper, the problem of integrating existing public bibliographic databases and structured databases which reside at different locations in the network is addressed. Although bibliographic data is semistructured, its attribute set is often determined by an international standard known as MARC. To unify bibliographic and structured data, the well-known SQL was extended to model bibliographic related attributes and queries. In particular, a new data type was …

A Hypermedia Database To Manage World-Wide-Web Documents, Schubert Shou Boon Foo, Ee Peng Lim Jan 1997

A Hypermedia Database To Manage World-Wide-Web Documents, Schubert Shou Boon Foo, Ee Peng Lim

Research Collection School Of Computing and Information Systems

The surge of interest in the World-Wide-Web (WWW) with its potential commercial payoff has resulted in an explosion of information as organisations join in to publish and do business on the Internet. A related development, Intranet, which basically uses the same technology to build private corporate WWW-based networks, has emerged to provide cost-effective and efficient groupware and information management solutions for organisations. As a result, the Hyper Text Markup Language (HTML), used for constructing WWW documents, has become a contender for authoring future office documents. With this scenario, this study examines WWW practices and highlights the inadequacy and drawbacks of …
