Term Limits And Electoral Competitiveness: California's State Legislative Races, John Lott, Kermit Daniel May 1997

Term Limits And Electoral Competitiveness: California's State Legislative Races, John Lott, Kermit Daniel

Coase-Sandor Institute for Law & Economics Research Paper Series

California’s legislative term limits have dramatically reduced campaign expenditures. Real expenditures during the three general elections after the term limits initiative passed in 1990 were lower than in even 1976. This drop has occurred at the same time that races have become closer contests and more candidates are running for office. By any measure, term limits have coincided with large changes in the level of political competition, even before term limits have forcibly removed a single politician from office. The changes are so large that more incumbents are being defeated, races are closer, more candidates are running, and fewer single …

The Chosen People In Our Wilderness, Susan P. Koniak May 1997

The Chosen People In Our Wilderness, Susan P. Koniak

Faculty Scholarship

Strangers there are among us, practicing with weapons for something they believe might come - something some of them believe should come. Militia men, patriots, self-proclaimed true Americans. Chosen people. What are we, members of the power elite, the academy, the legal intelligentsia - the other chosen people - to make of them? Sideshow freaks may titillate even a scholar, but they rarely, if ever, inform. Is there more here?

Along with the authors of Gathering Storm and Rural Radicals, I believe there is. Neither of these books sets out to convince lawyers or law professors in particular that …

Undergraduate Honors Capstone Projects

I was introduced into the world of Fetal Alcohol Syndrome winter quarter, 1996. My goals for that year included researching this topic in order to understand what it was physically, behaviorally, and on a cognitive level. My assignment involved writing a research paper around those characteristics, along with the development of their speech and language, presenting my findings to my classmates, and competing at the USU Scholar's Day competition in May of 1996. I received 2nd place at this competition. During the summer of that year, I researched FAS more to receive the needed resources to compile an annotated bibliography …

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Cattle are an important reservoir of Shiga toxin-producing enterohemorrhagic Escherichia coli (EHEC) O157:H7 strains, foodborne pathogens that cause hemorrhagic colitis and hemolytic uremic syndrome in humans. EHEC O157:H7 strains are not pathogenic in calves >3 weeks old. Our objective was to determine if EHEC O157:H7 strains are pathogenic in neonatal calves. Calves(A/E) lesions in both the large and small intestines by 18 h postinoculation. The severity of diarrhea and inflammation, and also the frequency and extent of A/E lesions, increased by 3 days postinoculation. We conclude that EHEC O157:H7 strains are pathogenic in neonatal calves. The neonatal calf model is …

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

A qualitative study of a workplace was conducted through the use of interviews and observation of ten participants working in hardware and software engineering. The study arose from a lack of information on computer usage in workplace settings and a lack of identified functional needs for skills-based training.

There were three primary guiding questions and areas of findings in this study:

l. Does the job task model define the areas of computer literacy for the individual worker?

The job task model proved to be an effective method for analyzing tasks, tools, and the environment for usage of computer technologies in …

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Little is known of the elderly's ability to use a food frequency questionnaire to describe their dietary intake. This study examines the elderly's ability to reliably describe their diets and how age, education, cognitive status, and gender may affect their ability to complete and return a food frequency questionnaire. The reproducibility of the questionnaire was tested by a repeated administration among 85 participants 65 years of age and older from the Preston, Idaho, area. Correlation coefficients between nutrient scores from the first and second administration ranged from 0.48-0.79 (total population), 0.44-0.88 (males), and 0.39-0.86 (females). Median values for the correlation …

Toward A Fair And Practical Definition Of "Willfully" In The Medicare/Medicaid Anti-Kickback Statute, Tamsen D. Love

Vanderbilt Law Review

Health care fraud takes on a variety of forms-from billing insurance companies for services not provided, to falsifying injuries for tort plaintiffs, to practicing medicine without a license.' All these types of fraud contribute to the astronomical cost of health care in the United States. As federal policymakers have focused on ways to contain these costs, health care fraud has become an increasing object of scrutiny. At the same time, the health care industry is experiencing significant institutional change, particularly with the emergence of health maintenance organizations ("HMOs") and other managed care systems. The Medicare/Medicaid anti-kickback statute, which prohibits payments …

Tillage Effects On Soil Erosion Potential And Soil Quality Of A Former Conservation Reserve Program Site, John E. Gilley, J. W. Doran

Department of Agricultural and Biological Systems Engineering: Faculty Publications

This study was conducted to determine the effects of tillage on soil erosion potential and soil quality characteristics of a former Conservation Research Program (CRP) site. Following tillage, the study area in northern Mississippi was maintained in a fallow condition for nine months. Soil loss from simulated rainfall events was minimal on recently tilled plots and an adjoining, undisturbed CRP area. In contrast, soil loss from the former CRP site which had been tilled nine months previously was similar to values obtained before the CRP program when the area had been cropped for several years. Tillage and over-winter fallowing caused …

The Regulation Of Adult Uses, Karina Rizk May 1997

The Regulation Of Adult Uses, Karina Rizk

Master's Projects

This report presents the history of adult use regulation and the contemporary problems associated with defending the regulation of adult-oriented uses. Adult-oriented uses have been linked with increased crime rates, lower property values, and the degradation of a community's quality of life. These pernicious effects have prompted communities to take action through land use controls. Many jurisdictions struggle with the regulation of adult-oriented businesses, not only because of the land use and related social issues, but because the regulation touches on Issues of free speech and First Amendment rights.

This report presents the ordinance that was prepared for the City …
