An insertion/deletion (I/D) polymorphism of the angiotensin I converting enzyme gene influences the level of serum angiotensin converting enzyme activity and has been associated with risk of several cardiovascular conditions. The relationship to blood pressure remains uncertain, however. We conducted a population-based survey in Kingston, Jamaica, to examine the association between angiotensin converting enzyme genotype, angiotensin converting enzyme serum activity and blood pressure. Serum angiotensin converting enzyme activity was measured and genotyping performed for the I/D polymorphism in 500 community residents. The overall prevalence of the D allele was 59.3%. Angiotensin converting enzyme genotype was not significantly related to blood …

Takings And Causation, Jan G. Laitos May 1997

Takings And Causation, Jan G. Laitos

William & Mary Bill of Rights Journal

Constitutional protection of private property is grounded in a conflict between two legal principles--the government's power to regulate private property for the common good and the Constitution's limit on this power in the Takings Clause. The Takings Clause's check on government power conforms to John Rawls's philosophy, which rejects the utilitarian beliefs that government may act to achieve* the "good" of maximizing human happiness and that government can force people to trade certain political liberties for an improved distribution of wealth. Under Rawls's theory, the principle of "justice as fairness" limits a government's ability to require some people to bear …

Flexible Zoning: A Detailed Study, John Channing Timmis May 1997

Flexible Zoning: A Detailed Study, John Channing Timmis

Master's Projects

The origin of zoning in America dates back to 1916, when the nation s first comprehensive zoning ordinance was adopted by New York City. This was a time when incompatibie iand uses such as housing and heavy industriai uses were in ciose proximity to one another. A close spatial arrangement between such incompatible uses inevitably led to deleterious effects on the public’s health, welfare and safety. New York City’s zoning ordinance acted as a catalyst in the creation of the 1922 Standard State Zoning Enabling Act. which became a model for local zoning controls throughout the country.

Community Participation In Planning: A New Paradigm, Laureen Aguilar Heinz May 1997

Community Participation In Planning: A New Paradigm, Laureen Aguilar Heinz

Master's Projects

My inspiration for this topic stems from a project I worked on in Central Mountain View, adjacent to downtown. This neighborhood, known as Old Mountain View, is diverse in both ethnicity and age. Based on a neighborhood study I conducted prior to this project, I discovered this neighborhood was undergoing a transformation as a result of the redevelopment of downtown -the neighborhood was gentrifying rapidly. While there were still low-income residents living in high-density housing, most of the single family housing was increasingly occupied by middle class, 2-working adult, families. Over time, the actual cost of housing made it prohibitive …

Brownfields: Revitalizing Contaminated Properties, Monique A. Mayeaux

Master's Projects

The idea of infill development is not new to planners and developers. Given today’s economic climate and growing awareness to prevent sprawl, especially in places such as the San Francisco Bay Area, this concept of infill development has truly come of age. Developing on land within the urban areas where the infrastructure is already in place is considered sustainable growth.

A brownfield is the term coined to describe a plot of land that Is vacant or underutilized due to real or perceived environmental contamination. These lots are typically commercial or Industrial properties, most often located within urban and economically distressed …

Agnew Village, In The City Of Santa Clara: An Urban Outpost In Changing Times, Judith A. Silva

Master's Projects

The purpose of this research paper Is to trace the evolution, changes events, and trends which have occurred within the City of Santa Clara’s Agnews Village neighborhood during the last century. Reviewed are the neighborhood’s housing submarket, population characteristics, services, future policy considerations, as well as proposed and future development in the surrounding areas. Unlike most neighborhoods, which are inextricably connected to the events, policies, and problems of a city, Agnew Village was linked to an institution (and at that, an insane asylum). The Village has experienced considerable change in its own unique way.

During the research of this topic, …

Environmental Audit And Compliance Tool, Katherine Amoukhteh

Master's Projects

Environmental protection has come to the forefront of both government agencies and corporations’ attention. Concern over environmental protection has resulted in an onslaught of legislation and activities from protection groups. As a result of this, an international standard, IS014000 was published in 1996. IS014000 is an international standard created to aide companies in implementing an effective environmental management system.

The goal of this project was to provide a tool for companies to determine their level of compliance with IS014000 along with specific Federal, state, and local environmental regulations. The tool consists of a questionnaire which outlines the requirements of IS014000 …

Human Capital Investment As An Economic Development Strategy: A Detroit Analysis, Truman Hudson Jr. May 1997

Human Capital Investment As An Economic Development Strategy: A Detroit Analysis, Truman Hudson Jr.

Wayne State University Theses

Many urban developers have responded to the challenges of economic development1 by providing tax incentives to businesses for relocating to urban areas (Bartik, 1995). By not being able to provide the skilled labor force that businesses require, developing communities are not postured to fully take advantage of the newly created job opportunities. Thus, wage disparities between the classes increase, leaving many of the underclass citizens without adequate employment for sustaining modest living standards (Turner, 1991).

As part of various economic development strategies2, increased concerns have been given to human-capital based strategies (Psacharo-Poulos, 1985). This paper puts forth …

Gaining Appellate Review By "Manufacturing" A Final Judgment Through Voluntary Dismissal Of Peripheral Claims, Rebecca A. Cochran May 1997

Gaining Appellate Review By "Manufacturing" A Final Judgment Through Voluntary Dismissal Of Peripheral Claims, Rebecca A. Cochran

Mercer Law Review

In recent decades, the paths from federal district courts to the federal circuit courts of appeals have narrowed considerably. Appeals through rule 54(b), section 1292(b), the collateral order doctrine, and other litigants and judges to test the limits of the most prevalent appellate path-appeal from a final judgment. This Article argues that the purposes of the final judgment rule, including judicial economy, are served, not hindered, by voluntary dismissals with prejudice of peripheral claims to render final an earlier ruling that decided the heart of the litigation.

First, this Article profiles the district court cases in which peripheral claims dismissals …
