Domestic Violence, Character, And Social Change In The Welfare Reform Debate, Joan S. Meier
Domestic Violence, Character, And Social Change In The Welfare Reform Debate, Joan S. Meier
GW Law Faculty Publications & Other Works
This article addresses the recently discovered connection between domestic violence and welfare “dependency.” Empirical research among welfare populations shows that over 50% of women receiving welfare are or have recently been battered, and that partner abuse is a major reason for the continuing poverty of many women.
The question the author asks and begins to answer is why this connection has not previously been identified or publicized by either the battered women’s movement or the anti-poverty movement, and what the challenge may be to both movements as they attempt to address it in the context of welfare reform. The author …
Mandatory Worker Participation Is Required In A Declining Union Environment To Provide Employees With Meaningful Industrial Democracy, Charles B. Craver
Mandatory Worker Participation Is Required In A Declining Union Environment To Provide Employees With Meaningful Industrial Democracy, Charles B. Craver
GW Law Faculty Publications & Other Works
For many years, American workers directly or indirectly benefited from union representation. The 30-35 percent of employees actually represented by labor organizations in the late 1950s and early 1960s had their wages and benefits negotiated by those unions. Nonunion workers obtained similar benefits from employers seeking to remain nonunion. Over the past 50 years, private sector union membership has declined significantly to under 8 percent today. The individual employee has no bargaining power and must accept whatever he or she is offered. Workers have no say in firm decisions that directly affect their employment security and working conditions. The U.S. …
Negotiation Ethics: How To Be Deceptive Without Being Dishonest/How To Be Assertive Without Being Offensive, Charles B. Craver
Negotiation Ethics: How To Be Deceptive Without Being Dishonest/How To Be Assertive Without Being Offensive, Charles B. Craver
GW Law Faculty Publications & Other Works
This article explores various ethical issues pertaining to negotiation interactions. Model Rule 4.1 proscribes material misrepresentations, but permits puffing and embellishment during bargaining encounters. This is based upon the fact that statements pertaining to one's settlement intentions and subjective values are considered to involve non-material information. It is thus imperative for negotiators to distinguish carefully between such accepted deceptive practices and clearly improper misrepresentations involving material information. The article also discusses the use of assertive tactics that might offend some persons. It points out how negotiators can be assertive without resorting to truly offensive behavior that would be unlikely to …

New Objective Classification System For Nuclear Opacification, Donald D. Duncan, O. B. Shukla, Sheila West, Oliver D. Schein
Electrical and Computer Engineering Faculty Publications and Presentations
We have developed an autonomous objective classification scheme for degree of nuclear opacification. The algorithm was developed by using a series of color 35-mm slides acquired with a Topcon photo slit-lamp microscope and use of standard camera settings. The photographs were digitized, and first, and second-order gray-level statistics were extracted from within circular regions of the nucleus. Classifications of severity were performed by using these features as input to a neural network. Training versus classification performance was tested by using photographs of different eyes, and test/retest classification reproducibility was evaluated by using paired photographs of the same eyes. We demonstrate …
Teachers Of Mathematics Teach Mathematics Differently : A Case Study Of Two Teachers, Jennie Bickmore-Brand
Teachers Of Mathematics Teach Mathematics Differently : A Case Study Of Two Teachers, Jennie Bickmore-Brand
Theses: Doctorates and Masters
This thesis investigates the different approaches adopted by two teachers for teaching mathematical content at the upper primary level of education. Questions have been raised by researchers about the impact teachers' philosophical background may have on their perception of how mathematics should be taught. Similarly questions have been asked about the role of content in mathematics education in relation to the process of education. The two teachers held different beliefs about what they were doing when they were teaching mathematics and why they were teaching that way. Their methodological emphases were different; one could be described as being more learner-centred …
A Patient Management Program: The Evaluation Of A Combined Pre-Admission And Early Discharge Program, Lorna Rogers
A Patient Management Program: The Evaluation Of A Combined Pre-Admission And Early Discharge Program, Lorna Rogers
Theses: Doctorates and Masters
The purpose of this descriptive study was to describe the evaluation of a 'Patient Management Program'. This managed care type of program combined a Pre-Admission Clinic and an Early Discharge Program. It was established as a twelve month pilot program at a major Western Australian public teaching hospital in January 1995. It aimed to provide a more efficient health service by replacing part of elective surgical patients' inpatient care with outpatient services. The first component of the Program was the Pre-Admission Clinic, which allowed patients to undergo pre-operative assessment and testing prior to admission to hospital, thus facilitating same day …

Teaching Integration Through The Cracks: A Pedagogy Of Process, Nancy S. Thurston
Teaching Integration Through The Cracks: A Pedagogy Of Process, Nancy S. Thurston
Faculty Publications - Doctor of Psychology (PsyD) Program
For decades, psychologists have appreciated the value of tracking the process of a psychotherapeutic relationship in order to decode and extract information that is vitally relevant to the cure of the patient. In recent years, this notion of tracking the process has gained interest among Christian psychologists and educators. However, little attention seems to have been given to tracking the process of the integration between psychology and Christian faith that happens in the classroom. The present author contends that the teaching of integration happens “in the cracks” of formal classroom instruction far more often than we typically acknowledge. The author …

Community Sleep Clinics Run By Health Visitors -An Evaluation Of Outcome, Gail Mary-Rose Barlow Simcock
Community Sleep Clinics Run By Health Visitors -An Evaluation Of Outcome, Gail Mary-Rose Barlow Simcock
School of Psychology Theses
Sleep problems in babies and young children are extremely prevalent, yet until recently little attention has been paid to them by health professionals. Sleep problems have often been accepted as part of a developmental process, however research has shown that they are often not transitory, and if not treated effectively in the early years, may have long term consequences for later life. Health visitors are in an ideal position to offer treatment at a primary care level, as they are in regular contact with the families of young children. Existing research has shown that the employment of a behavioural approach …
The U.S. National Marine Sanctuary Program: Effectiveness Of Diver Education In The Florida Keys, Rebekah Resnick Padgett
The U.S. National Marine Sanctuary Program: Effectiveness Of Diver Education In The Florida Keys, Rebekah Resnick Padgett
Open Access Master's Theses
This thesis examines the educational program of the Florida Keys National Marine Sanctuary (FKNMS), and its effectiveness for divers and snorkelers. It was hypothesized that intended educational messages were not reaching divers and snorkelers at the sanctuary. Between late December 1996 and early January 1997, 194 surveys were conducted in person in the Key Largo region. Data was collected regarding the demographics of the divers and snorkelers and their purposes for coming to dive in the Keys. In particular, information was accumulated regarding whether they learned anything about the marine environment of the Florida Keys, what they learned, and how …
Staff Responses To Challenging Behaviour: An Evaluation Of Behaviour Analytic Concepts And Intervention Strategies, Neil Bathurst
Staff Responses To Challenging Behaviour: An Evaluation Of Behaviour Analytic Concepts And Intervention Strategies, Neil Bathurst
School of Psychology Theses
This research project is divided into two studies. Study 1 considers the proposition that where the challenging behaviours of learning disabled people are sensitive to social reinforcement, the responses of unit staff may be counter-habilitative. This was investigated using a questionnaire-based self-report study involving 43 unit staff. The questionnaires covered staff emotional reactions to, attributions for and responses to challenging behaviours. In addition key aspects of the staff sub-culture were considered. Results confirmed the possible counter-habilitative nature of staff responses. These responses appeared to be influenced by both contingency effects related to high levels of stress and counter -habilitative beliefs …
The Public Duty Doctrine And Municipal Liability For Negligent Administration Of Zoning Codes, Shelly K. Speir
The Public Duty Doctrine And Municipal Liability For Negligent Administration Of Zoning Codes, Shelly K. Speir
Seattle University Law Review
This Comment first provides a brief background of the development of the public duty doctrine. Part II discusses the two major types of zoning cases: those involving negligent misstatements and those involving negligent issuance of permits or inspections. The use of the public duty doctrine in both types of cases is then analyzed under relevant Washington case law. Part III argues for the abolition of the public duty doctrine and Part IV concludes.
Bucking Up Buckley Ii: Using Civil Rights Claims To Enforce The Federal Student Records Statute, Lynn M. Daggett
Bucking Up Buckley Ii: Using Civil Rights Claims To Enforce The Federal Student Records Statute, Lynn M. Daggett
Seattle University Law Review
This Article explores enforcement of Buckley and, in particular, the possibilities of using Section 1983 claims for this purpose. It concludes that Section 1983 claims have only limited potential, under narrowly defined circumstances, as a remedy for Buckley violations. Part I of this Article summarizes Buckley's substantive provisions; a comprehensive review is available in a companion article. Part II reviews enforcement of Buckley, other than through Section 1983 claims. Specifically, Part II examines the statute's two enforcement mechanisms as well as the potential of state law tort claims to enforce Buckley and the indirect enforcement mechanism of workplace discipline of …
Congress's Amendment To Section 104 Of The Tax Code Will Not Clarify The Tax Treatment Of Damages And Will Lead To Arbitrary Distinctions, Sharon E. Stedman
Congress's Amendment To Section 104 Of The Tax Code Will Not Clarify The Tax Treatment Of Damages And Will Lead To Arbitrary Distinctions, Sharon E. Stedman
Seattle University Law Review
This Note examines the recent amendment of I.R.C. § 104 and argues that the amendment will not clarify the tax treatment of damages but will instead lead to inequitable results and arbitrary distinctions. Part I explores the policy justifications for the exclusion of damage awards from gross income and provides a brief overview of section 104. Next, in Part II, the article reflects upon the tax treatment of damages prior to the recent amendment. In doing so, Part II focuses on the relevant case law and revenue rulings. Turning toward the tax treatment of damages under the new amendment, Part …
An Interdisciplinary Seminar In Child Abuse And Neglect With A Focus On Child Protection Practice, Suellyn Scarnecchia
An Interdisciplinary Seminar In Child Abuse And Neglect With A Focus On Child Protection Practice, Suellyn Scarnecchia
Articles
Given the myriad of professionals involved in protecting children from abuse and neglect, legal practice in the field of child protection requires an understanding of the various disciplines these professionals represent. Professor Scarnecchia argues that such an understanding is necessary in order for the attorney to serve as a zealous advocate for her client. In hopes of creating this understanding in students at the University of Michigan, an interdisciplinary seminar in child abuse and neglect has been created. Professor Scarnecchia details the substantive content of the seminar, discussing specific issues that arise in protecting children. She explains that by using …

Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Articles
International refugee law is in crisis. Even as armed conflict and human rights abuse continue to force individuals and groups to flee their home countries, many governments are withdrawing from the legal duty to provide refugees with the protection they require. While governments proclaim a willingness to assist refugees as a matter of political discretion or humanitarian goodwill, they appear committed to a pattern of defensive strategies designed to avoid international legal responsibility toward involuntary migrants. Some see this shift away from a legal paradigm of refugee protection as a source for enhanced operational flexibility in the face of changed …
Redefining Family Values: The Family And Medical Leave Act And The 1996 Campaign, Heather Dzuricky
Redefining Family Values: The Family And Medical Leave Act And The 1996 Campaign, Heather Dzuricky
Iowa Journal of Communication
In 1992, the Republican Party made family values a center point of the presidential campaign claiming the primary importance of the issue for American voters. In 1996, President Clinton used the foundation established by Republicans four years prior to bring family values to the forefront of American politics once again. Using the Family and Medical Leave Act as a symbol of successful family values legislation, Democratic rhetoric surrounding family values during the 1996 Democratic National Convention served three primary rhetorical purposes: to broaden the definition of family, to bring national focus on the children of America, and to define the …

Past Departments Faculty Publications (CELS)
A new indirect fluorescent-antibody (IFA) assay with antigen produced in vitro in the human promyelocytic leukemia cell line HL60 was used to identify the first recognized case of human granulocytic ehrlichiosis in Rhode Island. This IFA assay was used to detect granulocytic ehrlichiae in white-footed mice and in a dog inhabiting the area surrounding the patient’s residence. Host-seeking Ixodes scapularis ticks found in the same habitat also were infected. I. scapularis ticks collected from other locations were fed on dogs and New Zealand White rabbits to assess the competency of these species as hosts of granulocytotropic Ehrlichia. Tick-induced …

Duration Of Immunity To Reinfection With Tick-Transmitted Borrelia Burgdorferi In Naturally Infected Mice, Joseph Piesman, Marc C. Dolan, Christine M. Happ, Benjamin J. Luft, Sean E. Rooney, Thomas N. Mather, William T. Golde
Past Departments Faculty Publications (CELS)
The ability of naturally infected and cured mice to resist reinfection with tick-transmitted Borrelia burgdorferi was tested over a 1-year period. All of the mice were resistant to reinfection when they were challenged at 1.5 months after cure. The majority of animals were resistant to reinfection for up to 10.5 months after cure, but this resistance was lost at 1 year after cure. Both protected and unprotected animals showed a diverse array of antibodies on Western immunoblots. Protection was not associated with the killing of spirochetes in ticks, and naturally infected mice produced no antibodies to outer surface protein A …
A Comparison Of The Speed Of Two Defensive Step Patterns By Women Volleyball Players, Sergei Y. Sherstnev
A Comparison Of The Speed Of Two Defensive Step Patterns By Women Volleyball Players, Sergei Y. Sherstnev
Dissertations and Theses @ UNI
The purpose of this study was to compare the speed of two defensive step patterns in volleyball. The shuffle step and long step were evaluated in terms of the speed of the shift of the center of gravity and stability. Subjects were 14 former female collegiate volleyball players. Each subject performed both the shuffle step and the long step in both directions. Statistical analysis revealed no significant difference in speed of the two step patterns, movement time, and height of the center of gravity (p >.05). There was a significant difference in displacement (F = 15.3687, p <.0001). The long step showed significantly greater distance from the line of gravity to the center of the base in the direction of the step than did the shuffle step (F = 24.2806, <.0001). The long step showed significantly greater size of the base of support as compared to the shuffle steps on both sides {F = 55.1042, p <.0001). The long steps demonstrated more mobility in the direction of the step, and the shuffle step showed more stability in the final position.
An Attempt To Identify Health Defensive Externals, Sarah J. Flynn
An Attempt To Identify Health Defensive Externals, Sarah J. Flynn
Dissertations and Theses @ UNI
The present study attempted to apply the concept of defensive externality (Rotter, 1966) to health locus of control and preventive health behavior. The study attempted to identify a subgroup of externals, called "health defensive externals," and determine how they may differ from congruent internals and congruent externals in terms of health beliefs and coping strategies. Health defensive externals were thought to score high on chance health locus of control (CHLC) and yet engage in a high number of preventive health behaviors. Participants were recruited from a local chiropractor's office and a local community health clinic. They completed a modified version …
