Does Lack Of An Insurable Interest Preclude An Insurance Agent From Taking An Absolute Assignment Of His Client's Life Policy?, Johnny C. Parker

To understand any concept it helps to know the purposes it serves and the objectives it seeks to achieve. The maxim that one "must have an insurable interest in the life or property insured" has haunted insurance law for centuries. This doctrine conditions both the validity and enforceability of insurance contracts upon the existence of an insurable interest in the person who purchases the policy. The considerations which underlie the insurable interest requirement are generally expressed in terms of public policy: (1) against allowing wagering contracts; (2) against fostering temptation to destroy the insured property or life in an effort …

Since our nation's infancy, the Chesapeake Bay ("Bay") has been one of Virginia's natural treasures. The Bay is America's largest and historically most productive estuary, valued today as an economic resource, a wilderness sanctuary, and an aesthetic asset. Every year, commercial fishermen harvest blue crabs, oysters, and a multitude of fish species in mass quantities to satiate our desire for seafood. Nature aficionados can observe ospreys, laughing gulls, and other shorebirds taking their share of the Bay's bounty. From the -shoreline, quiet vacation homes overlook the waters across coves and inlets. Despite these idyllic images, the Bay has been facing …

Ideally, this symposium marking the three-decade anniversary of the Age Discrimination in Employment Act (ADEA) would present an opportunity to assess how well the ADEA has achieved its plausible goals. However, I recognize that any definitive assessment of the success of a statute like the ADEA, which requires the modification of the behavior of social actors, must depend on the kind of sophisticated empirical study for which I have neither the time, resources or capability. I also recognize that defending my identification of the goals of the ADEA might itself require an entire essay.

The General Assembly did not take any action regarding the Family Court issue in 1997. In 1996, funding for the family court was delayed until June 1, 1998, subject to state funds being "sufficient to provide adequate resources ... for the court to carry out the purposes of [Virginia Code section 20-96] and to fulfill its mission to serve children and families of the Commonwealth."

Annual Survey Of Virginia Law: Wills, Trusts, And Estates, J. Rodney Johnson

The General Assembly enacted legislation dealing with wills, trusts, and estates that added, amended, or repealed a number of sections of the Code of Virginia in the 1996 and 1997 sessions. In addition, there were eleven Supreme Court of Virginia opinions in the two-year period ending April 18, 1997, that involved issues of interest to the general practitioner as well as the specialist in wills, trusts, and estates. This article reports on all of these legislative and judicial developments.

The Medicaid program is a jointly financed federal and state assistance program established under Title XIX of the Social Security Act of 1965. The purpose of the program is to provide "federal financial assistance to States that choose to reimburse certain costs of medical treatment for needy persons." The Medicaid program's federal statutory and regulatory framework was described by Justice Powell of the United States Supreme Court as "among the most intricate ever drafted by Congress." Justice Powell added that the Act's "Byzantine construction... makes [it] 'almost unintelligible to the uninitiated." To add to these already significant difficulties, each state …

Organized Labor As Shareholder Activist: Building Coalitions To Promote Worker Capitalism, Marleen A. O'Connor

In the past, the traditional question posed by unions was: "which side are you on?"--presenting a clear choice between labor and capital. As membership and bargaining power fall, however, unions are asserting their rights as shareholders to influence corporate decision making outside the conventional labor law framework. Because the National Labor Relations Act does not adequately protect workers' rights, unions have devised innovative methods as shareholders to exercise unprecedented power over managers. In only a few years, labor-shareholders have become highly visible players in the institutional shareholder movement. The purpose of this study was to assess the affect of experimenter chosen 50 beat per minute music composed especially for stress and anxiety reduction on a select group of college students, and to examine its usefulness in promoting relaxation. The rationale for the study was based on research done in the area of using music to promote relaxation, and on the composer's claims that this music has been effective on a variety of populations for such purposes. The purpose of this study was to determine if there was a significant difference at the alpha level .05 in the means of the Anger-ln. Anger-Out, and Anger Control scales scores of the State-Trait Anger Expression Inventory reported by extraverted and introverted participants. Thirty-nine undergraduate students enrolled in a community living course from a small, private, midwestern college served as participants in the present study. There were 16 males and 23 females who volunteered to participate in the present stud_ (mean age- 18.21 ). The purpose of this project is to evaluate the cost-effectiveness of activities in extended-care facilities. The life expectancy of older adults and housing options is presented in the introduction to this project. A literature review highlights the need for activities to maintain and restore the health of older adults in extended-care facilities. The literature shows that activities help to meet the physical, emotional, and spiritual needs of older adults. Meeting these needs leads to life satisfaction for the residents in extended-care facilities. The use of alternative methods for resolving family conflict has increased significantly in the past few years, but many attor­neys are still wary. In an effort to discover some of the sources of this hesitation as well as identify support for "alternative" processes, the American Academy of Matrimonial Lawyers sur­veyed its members concerning the use of dispute resolution methods. As advances in medical technology have kept people alive longer, the right to refuse life-sustaining treatment has taken on an even more crucial and urgent significance to dying patients and their families. While modern medicine may have learned to save lives, the lives it has saved are often severely diminished and filled with pain and suffering. Although the right to refuse life saving medical treatment is firmly embedded in our nation's laws, what to do when this right is ignored has not been firmly settled. Sexuality, Rape, And Mental Retardation, Deborah W. Denno

In this article, Professor Denno addresses the question of when sexual relations with a mentally retarded individual should be considered nonconsensual and therefore criminal. The article first explores the early treatment of mental retardation. It next demonstrates how old stereotypes influence the moralism inherent in modern conceptions of consent in rape determinations. Illustrating the point with reference to the Glen Ridge rape case, the article shows how courts applying contemporary rape statutes typically hold mentally retarded individuals to a higher standard of consent than nonretarded individuals. As a result, courts are hurting the very people they are supposed to protect …

Temperament In Late Talkers, Rhea Paul, Loretta Kellogg

This study examines the temperamental characteristics of children who were identified at age two as being slow in expressive language development, and those of peers with normal language history. When the children were in first grade (approximately age six), parents and clinicians rated subjects' temperamental characteristics, using a standardized temperament assessment instrument. Subjects with a history of slow expressive language development were rated significantly lower on Approach/Withdrawal--indicating shyness, aloofness, or reduced outgoingness--than peers with normal language history. Approach/Withdrawal scores were significantly correlated with average sentence length in spontaneous speech, and this measure also predicted Approach/Withdrawal scores in regression analyses. The …
