Democratic Excess In The Use Of Zoning Referenda, Karin M. Mika, Aaron J. Reber, )

This article argues that while mandatory referenda may be legal, it is an unnecessary step that thwarts zoning legislation. The article further argues that the Supreme Court's conclusion in Eastlake v. Forest City Enterprises, Inc. is not a realistic vision of the zoning process. Rather the previous standards of Euclid v. Ambler Realty Co. and Moore v. East Cleveland are sufficient to ensure an efficient process of municipal management.

With two assisted suicide cases scheduled for argument before the Supreme Court this term, Justice Antonin Scalia already has publicly staked out his position on the issue. While sentiments he expressed in 1990 in Cruzan v. Director, Missouri Department of Health, 497 U.S. 261, are well-known, Scalia told an audience at Catholic University late last year that it is "absolutely plain there is no [constitutional] right to die." This article discusses the standards of the American with Disabilities Act with respect to accommodating mental illness in the workplace. It argues that the ADA definitions are not precise enough in apprising employers of what their obligations are regarding mentally ill persons in the workplace. It additionally suggests revising the statue and regulations to achieve this goal.

On the national level, there are proposals to make the Internet the primary, and even the exclusive, means of disseminating certain government information. Concurrently, corporations and other private organizations may adopt a similar approach for their reports and other documents. Intertwined with these official and quasi-official documents are innumerable others created by individuals around the world. With so many documents, there is potential for dissemination of false, biased, and even fraudulent information. This is the source of the authentication problem.

Prosecuting Pregnant Women: Should Washington Take The Next Step?, Amanda E. Vedrich

Seattle University Law Review

The first section of this Comment will analyze the case against Deborah Zimmerman and the court's reasons for refusing to dismiss the charges against her. The second section will examine current Washington law and why similar charges could not be brought in this state. The third section will look at the policy rationales for changing Washington law to allow charges to be filed against women for attempting to intentionally endanger the life of a viable fetus. This Comment argues that Washington law should be so amended in order to achieve these policy goals.

Tell Me A Story: Using Short Fiction In Teaching Law And Bioethics, Dena S. Davis

For some years now, I have been experimenting with the use of short stories. Despite rich resources for stories, there remains a void best filled by fiction. When discussing fiction, we can probe, criticize, and express ourselves freely without the constraints we feel when discussing real people. Good fiction lays bare the innermost thoughts and experiences of its characters, perhaps even their dreams and nightmares, in a way that would be intrusive, uncomfortable, or impossible, even in autobiography. When the entire class reads a short story, it provides a pool of shared experience, a fixed point for discussion. Just as …

Because I reject the notion that physical characteristics constitute cultural membership, I argue that, even if the claim were persuasive that deafness is a culture rather than a disability, there is no reason to fault hearing parents who choose cochlear implants for their deaf children.

In this paper, I examine three difficult issues raised by the Human Genome Project, and lay out an approach that takes seriously the interests of the child, present or future, while preserving the traditional commitment of professional geneticists to patient autonomy. The approach I take is based on Joel Feinberg's concept of "the child's right to an open future." In Part II, I describe the Human Genome Project, as well as the advances in assisted reproduction which give people ways to make use of the information engendered by the HGP. INTRODUCTION: In theory if not in fact, the purpose of a trial in the American legal tradition is to discern the truth related to a particular dispute. Although scholars have debated how well the adversary system actually promotes fair and accurate outcomes, this truth-seeking paradigm remains generally well-accepted. To ascertain the truth, information must be presented to the triers of fact for their consideration. The law of evidence thus provides the rules for introducing and considering such information in the adversary system.
