Permissible Accommodation Of Religion And The Alternative Burden, Ei Ichiro Takahata
Permissible Accommodation Of Religion And The Alternative Burden, Ei Ichiro Takahata
LLM Theses and Essays
In this thesis, the author discusses the extent to which the government can afford to give accommodation within the limits of the Establishment Clause. In Chapter II, the author reviews the theory of the permissible accommodation referred to in the Supreme Court of the United States. In Chapter III, the author examines scholarly debates on the accommodation. Then, the author discusses German and Japanese law of the accommodation in Chapter IV. There, those cases suggest the possibility of alternative burdens on religious believers. The alternative burdens are considered the price of the accommodation. The author concludes that the government has …
Legal Aspects Of The Internet, Etienne Pichat
Legal Aspects Of The Internet, Etienne Pichat
LLM Theses and Essays
This thesis will explain the legal aspects of the Internet so that users who wish to protect their rights and avoid liability can log on with a better understanding of the rules of the game. This work will be divided into two chapters. The first chapter will focus on existing legal regulation of the Internet to advise users on which law is relevant, and how to solve problems of conflicts of laws in the cyberworld. It will answer the question of whether cyberspace is, or not, a "no laws land", and what kind of regulation would better fit the cyberworld. …

Bucking Up Buckley Ii: Using Civil Rights Claims To Enforce The Federal Student Records Statute, Lynn M. Daggett
Bucking Up Buckley Ii: Using Civil Rights Claims To Enforce The Federal Student Records Statute, Lynn M. Daggett
Seattle University Law Review
This Article explores enforcement of Buckley and, in particular, the possibilities of using Section 1983 claims for this purpose. It concludes that Section 1983 claims have only limited potential, under narrowly defined circumstances, as a remedy for Buckley violations. Part I of this Article summarizes Buckley's substantive provisions; a comprehensive review is available in a companion article. Part II reviews enforcement of Buckley, other than through Section 1983 claims. Specifically, Part II examines the statute's two enforcement mechanisms as well as the potential of state law tort claims to enforce Buckley and the indirect enforcement mechanism of workplace discipline of …

The Short Happy Life Of Litigation Between Tortfeasors: Contribution, Indemnification And Subrogation After Washington's Tort Reform Acts, Stewart A. Estes
Seattle University Law Review
Section I summarizes the history and development of tort law in Washington, with an emphasis on the impact of the 1981 and 1986 Tort Reform Acts and their imperfect union. Section II outlines the traditional equitable remedies that are potentially available to a tortfeasor seeking reimbursement for having paid more than its share. Section III sets out the thesis and explains why under current law a tortfeasor's suit for reimbursement should be the exception, not the rule. The need, and the basis, for such litigation is dependent upon the existence of joint and several liability-which now occurs only infrequently.

Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Articles
International refugee law is in crisis. Even as armed conflict and human rights abuse continue to force individuals and groups to flee their home countries, many governments are withdrawing from the legal duty to provide refugees with the protection they require. While governments proclaim a willingness to assist refugees as a matter of political discretion or humanitarian goodwill, they appear committed to a pattern of defensive strategies designed to avoid international legal responsibility toward involuntary migrants. Some see this shift away from a legal paradigm of refugee protection as a source for enhanced operational flexibility in the face of changed …

Reading Ella Cara Deloria's Waterlily For Cultured Speech, Gerry Philipsen, Eric Aoki, Theresa R. Castor, Lisa M. Coutu, Patricia Covarrubias, Lorelle Jabs, Melissa Kane, Michaela R. Winchatz
Iowa Journal of Communication
The authors discuss the use of a novel, Waterlily, by Ella Cara Deloria, for courses in communication studies. As a representation of the life and culture of Teton Dakotas in the time before substantial contact with European Americans, the novel reveals a distinctive outlook and system of practices with regard to communication. Thus it provides a striking counterpoint to assumptions commonly presented in courses in communication studies. An interpretive framework for examining such a novel, with particular reference to its portrayal of culturally distinctive ways of communicating, is presented and applied to Waterlily. Issues regarding the validity of …
The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz
The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz
Iowa Journal of Communication
This paper reviews modern scholarship on the Older Sophists that began in the early nineteenth-century. At this time, philosophers and philologists took important steps to salvage the Sophists from the obscurity of history. However, these scholars did so in a way that continued to confuse sophistic fragments and contributions. The tendency of these scholars to view the Sophists from the vantage point of disciplinary perspectives has colored subsequent scholarship, as evidenced in the concept of "sophistic rhetoric."
This essay, extending from the work of Edward Schiappa (1991a, 1991b), reviews (and critiques) the modern scholarship which constructs theories of "sophistic rhetoric." …

In 1979, the United States Supreme Court decided Friedman v. Rogers, a case involving a First Amendment challenge to a Texas statute that prohibited optometrists from practicing under an assumed trade name. Although an important case, Friedman certainly is not one of the major milestones of First Amendment jurisprudence. Prior Supreme Court decisions established that although commercial speech is protected by the First Amendment, government may regulate speech to prevent deception or confusion. Because a majority in Friedman found a possibility of deception, the Court held that Texas could constitutionally prohibit the use of a trade name. Friedman becomes much …
Akhnai, Daniel J.H. Greenwood
Akhnai, Daniel J.H. Greenwood
Hofstra Law Faculty Scholarship
In the Talmudic story of the Oven of Akhnai, Rabbi Eliezer - symbol of unchanging law and original intent - decides a disputed issue of law, supporting his claim with all the arguments in the world and then with miracles including a voice from the Author proclaiming his interpretation correct. Nonetheless, his interpretation is rejected.
The Akhnai story is a complicated commentary on the problems of democracy and justice, with insights into the majoritarian (and counter-majoritarian) difficulties, the status of ancient law, and the meaning of originalist interpretation. I draw out lessons for those who seek to create a single …
Alternatives To Marital Fault: Legislative And Judicial Experiments In Cultural Change, J. Herbie Difonzo
Alternatives To Marital Fault: Legislative And Judicial Experiments In Cultural Change, J. Herbie Difonzo
Hofstra Law Faculty Scholarship
This article focuses on the legal and cultural history of non-fault divorce alternatives, and examines both formal legal materials and popular periodicals in an effort to comprehend the evolution of the modern American divorce culture. Beginning in the 1920s, the concept of incompatibility resounded through popular psychology as well as jurisprudence. The expansion of the divorce ground of cruelty to include mental anguish was not an attempt to broaden divorce grounds, but rather an attempt to define the range of the existing cruelty principle in terms of the new psychological understanding. Divorces had infiltrated the burgeoning consumer culture, and the …
