Bridging The Analogy Gap: The Internet, The Printing Press And Freedom Of Speech, Jonathan Wallace, Michael Green

Seattle University Law Review

The Supreme Court will bring the highest degree of clarity to the Internet freedom of speech debate if, in ACLU v. Reno, it sets forth the operative metaphor for freedom of speech and applies the metaphor in conjunction with an appropriate analogy for the technology.Part I of this Article discusses judicial decision-making tools with an emphasis on the use of analogy and the importance of applying legal precedents in a manner which is consistent and logical. Part I also discusses the use of metaphor in judicial decisionmaking and illustrates how operative metaphors for free speech have served to provide …

Influence Of Environmental Stress On Biomass Partitioning In Transgenic Tobacco Plants Expressing The Movement Protein Of Tobacco Mosaic Virus, S. Balachandran, Richard J. Hull, R. A. Martins, Y. Vaadia, W. J. Lucas Jan 1997

Influence Of Environmental Stress On Biomass Partitioning In Transgenic Tobacco Plants Expressing The Movement Protein Of Tobacco Mosaic Virus, S. Balachandran, Richard J. Hull, R. A. Martins, Y. Vaadia, W. J. Lucas

Plant Sciences and Entomology Faculty Publications

The influence of various environmental factors on biomass partitioning between shoots and roots in transgenic tobacco (Nicotiana tabacum) plants expressing the movement protein (MP) of tobacco mosaic virus (TMV) was investigated. TMV-MP-expressing transgenic plants exhibited a root-to-shoot ratio that was approximately 40% below that of transgenic vector control plants. When transgenic plants expressing the TMV-MP were subjected to water-stress conditions, the root-to-shoot ratio was increased to a value comparable to that of control plants subjected to the same water-stress treatment. Although the root-to-shoot ratio was increased by N or P deficiencies, the TMV-MP-induced alteration in biomass partitioning was not overcome. …

An Interdisciplinary Seminar In Child Abuse And Neglect With A Focus On Child Protection Practice, Suellyn Scarnecchia Jan 1997

An Interdisciplinary Seminar In Child Abuse And Neglect With A Focus On Child Protection Practice, Suellyn Scarnecchia

Articles

Given the myriad of professionals involved in protecting children from abuse and neglect, legal practice in the field of child protection requires an understanding of the various disciplines these professionals represent. Professor Scarnecchia argues that such an understanding is necessary in order for the attorney to serve as a zealous advocate for her client. In hopes of creating this understanding in students at the University of Michigan, an interdisciplinary seminar in child abuse and neglect has been created. Professor Scarnecchia details the substantive content of the seminar, discussing specific issues that arise in protecting children. She explains that by using …

Reading Ella Cara Deloria's Waterlily For Cultured Speech, Gerry Philipsen, Eric Aoki, Theresa R. Castor, Lisa M. Coutu, Patricia Covarrubias, Lorelle Jabs, Melissa Kane, Michaela R. Winchatz Jan 1997

Reading Ella Cara Deloria's Waterlily For Cultured Speech, Gerry Philipsen, Eric Aoki, Theresa R. Castor, Lisa M. Coutu, Patricia Covarrubias, Lorelle Jabs, Melissa Kane, Michaela R. Winchatz

Iowa Journal of Communication

The authors discuss the use of a novel, Waterlily, by Ella Cara Deloria, for courses in communication studies. As a representation of the life and culture of Teton Dakotas in the time before substantial contact with European Americans, the novel reveals a distinctive outlook and system of practices with regard to communication. Thus it provides a striking counterpoint to assumptions commonly presented in courses in communication studies. An interpretive framework for examining such a novel, with particular reference to its portrayal of culturally distinctive ways of communicating, is presented and applied to Waterlily. Issues regarding the validity of …

The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz Jan 1997

The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz

Iowa Journal of Communication

This paper reviews modern scholarship on the Older Sophists that began in the early nineteenth-century. At this time, philosophers and philologists took important steps to salvage the Sophists from the obscurity of history. However, these scholars did so in a way that continued to confuse sophistic fragments and contributions. The tendency of these scholars to view the Sophists from the vantage point of disciplinary perspectives has colored subsequent scholarship, as evidenced in the concept of "sophistic rhetoric."

This essay, extending from the work of Edward Schiappa (1991a, 1991b), reviews (and critiques) the modern scholarship which constructs theories of "sophistic rhetoric." …

Hardware Interfacing In The Broadcast Industry Using Simple Network Management Protocol (Snmp), Walter H. Schuller Jr. Jan 1997

Hardware Interfacing In The Broadcast Industry Using Simple Network Management Protocol (Snmp), Walter H. Schuller Jr.

UNF Graduate Theses and Dissertations

Communication between various broadcast equipment plays a major role in the daily operation of a typical broadcast facility. For example, editing equipment must interface with tape machines, production switchers must interface with font generators and video effect equipment, and satellite ground controllers must interface with satellite dishes and receivers. Communication between these devices may be a simple hardware handshake configuration or a more elaborate software based communications via serial or parallel interfacing. This thesis concerns itself with the software interfacing needed to allow various dissimilar types of equipment to communicate, and therefore, interface with each other. The use of Simple …

In 1979, the United States Supreme Court decided Friedman v. Rogers, a case involving a First Amendment challenge to a Texas statute that prohibited optometrists from practicing under an assumed trade name. Although an important case, Friedman certainly is not one of the major milestones of First Amendment jurisprudence. Prior Supreme Court decisions established that although commercial speech is protected by the First Amendment, government may regulate speech to prevent deception or confusion. Because a majority in Friedman found a possibility of deception, the Court held that Texas could constitutionally prohibit the use of a trade name. Friedman becomes much …

An Examination Of The Relationship Between First Grade Teachers' Theoretical Orientations Toward Reading Instruction And Their Classroom Instructional Practices, John Anthony Luciano

UNF Graduate Theses and Dissertations

This study examined the relationship between first grade teachers' theoretical orientations toward reading and their classroom instructional practices. The study, which was conducted in Duval County Florida, used the Theoretical Orientation to Reading Profile (DeFord, 1985) and the Luciano Reading Instruction Practices Survey to gather self-reported data from the 102 study participants.

The sample teachers reported the frequency with which they used 25 specific instructional practices to assist students in learning to read. Ten percent of the sample teachers were observed by the researcher for thirty minutes and their instructional practices were documented on a checklist which corresponded to the …

The Tax Lawyer’S Duty To The System, Linda Galler Jan 1997

The Tax Lawyer’S Duty To The System, Linda Galler

Hofstra Law Faculty Scholarship

Americans are losing faith in lawyers. An American Bar Association poll conducted during the O.J. Simpson criminal trial revealed a substantial erosion in the public's respect for criminal defense lawyers. One article reporting on the ABA poll asked, "Would it be surprising if, in the public mind, quality lawyering is coming to be equated with a Machiavellian disregard for the truth?" Indeed, trial lawyers and their ethics were the subject of caustic political rhetoric during the 1996 presidential campaign. Clearly, lawyers' ethics are under public scrutiny. It is thus particularly good timing for a new edition to Bernard Wolfman, James …
